About this file
This is a Questions and Answers document for IFB No. 36C24226B0020, Pave Lot G at Building 5, a Department of Veterans Affairs Veterans Health Administration project at the Montrose VAMC. The document addresses three primary contractor inquiries regarding scope clarification and environmental requirements.
The first question concerns concrete removal obligations, specifically whether concrete encountered below the explored depths of core borings (7.75-9.75 inches) within the approximately 14.5-inch full pavement section should be removed at no additional cost. The Government clarified that concrete within the pavement section limits or interfering with construction shall be removed as incidental work at no cost, but concrete below the pavement section not impacting construction may remain in place and is outside the contract scope. The second question addresses contractor responsibilities for environmental due diligence and clean fill determination under Drawing CN-1. The Government clarified that environmental investigations are limited to imported or exported fill material and existing on-site material only if reason exists to believe a spill or release occurred. Analytical testing is not required unless visual inspection or source history indicates contamination risk. Environmental documentation need not be submitted unless requested by the Contracting Officer or required for NYDEP regulatory compliance. The third question confirms that full-depth pavement replacement is required throughout the entire parking lot, including both existing pavement areas and proposed parking areas, using the same pavement section shown in the construction details.

36C24226B0020 QUESTIONS AND ANSWERS
1. Pavement Section Note #1 – concrete removal clarification Reference: Sheet CN 3, Detail 5, Pavement Section Note #1; Sheet GR 1 Core Boring Plan.
CN 3, Detail 5, Note #1 states that if concrete is encountered within or below the pavement section, it shall be removed and disposed of as part of the pavement improvements at no additional cost to the Government.
The core borings shown on GR 1 provide profile at depths of approximately 7-3/4"–9-3/4". The full pavement/subbase section is shown as approximately 14-1/2", so deeper conditions are not confirmed.
Please confirm the design intent and basis for Note #1. If concrete is encountered below the explored depths, please confirm whether removal/disposal is still considered incidental at no additional cost, or whether it will be addressed as a change to the contract.
Pavement Section Note #1 on Sheet CN-3, Detail 5 acknowledges variability in the existing pavement cross section and the potential presence of concrete within or directly below the proposed pavement section.
The design intent is that concrete encountered within the limits of the proposed pavement section or that interferes with construction of the pavement section shall be removed and disposed of as part of the pavement improvements at no additional cost to the Government.
The subsurface information shown on Sheet GR-1 represents conditions at the boring locations to the depths explored and is not intended to represent complete subsurface conditions across the site.
Concrete encountered below the pavement section and not impacting construction of the pavement improvements is outside the limits of the work as shown in the Contract Documents and may remain in place.
2. Drawing CN-1, NOTES-Clean Fill & Environmental Due Diligence. In the Environmental Due Diligence section of the note, #4 it states; see snip below.
This section of the due diligence suggests that a Phase I Environmental Site Assessment should be conducted by the contractor. Section #1 of this note states, “Responsibility of clean fill determination and Environmental Due Diligence rests on the applicant, and further Section #6 states, “Contractor is responsible for providing clean fill and performing environmental due diligence”.
Can you clarify the limit of the contractor’s responsibility with respect to the existing property and providing clean fill? Additionally, the section does not delegate who or what entity the Due Diligence must be sent to upon completion. Please clarify.
The Clean Fill and Environmental Due Diligence notes on Drawing CN-1 define the requirements associated with fill material imported to or exported from the project site and do not require the Contractor to perform environmental investigations of the existing property beyond what is necessary to comply with applicable NYDEP clean fill requirements.
As stated in Note 1, clean fill determination and environmental due diligence are only required for material being exported off-site or if there is reason to believe that a spill or release of a regulated substance has occurred on the site. Material used solely on-site and without indications of contamination does not require environmental due diligence.
The Contractor’s responsibility for environmental due diligence applies to fill material provided by the Contractor, including verification that imported fill qualifies as clean fill in accordance with NYDEP policies. Environmental due diligence is intended to consist of reasonable investigative measures appropriate to the source and nature of the fill material. Analytical testing is not required unless visual inspection or review of known fill source history indicates the potential for contamination, as stated in Note 4.
The notes do not assign responsibility to the Contractor for characterization or investigation of existing subsurface conditions unrelated to fill material being imported or exported as part of the Work, except that clean fill determination of existing on-site material is required only if there is reason to believe a spill or release of a regulated substance has occurred. Environmental due diligence documentation, if generated, is not required to be submitted unless requested by the Contracting Officer or required to demonstrate compliance with NYDEP regulations.
3. We are reviewing the construction drawings and specifications for IFB No. 36C24226B0020 – Pave Lot G at Building 5, and would like to request clarification regarding the pavement section shown in the drawings.
Specifically, the pavement notes illustrate a full-depth pavement section (including asphalt top course, binder course, and stone subbase). We would like to confirm whether this detail represents the specific required scope for this project, or if it is intended as a standard paving detail, with the intent being partial pavement removal and replacement only where directed.
For reference, we have attached the pavement notes pdf from the drawings.
Could you please advise whether:
Full-depth pavement replacement is required throughout the project limits, or The detail is a typical section, and full-depth reconstruction is only required in select areas as identified elsewhere in the solicitation or in the field?
We have reviewed the RFI questions and updated the layout plan to clarify the comments provided. In addition, the geotechnical report for the project is attached for your records.
In response to the RFI, full-depth pavement replacement is proposed throughout the entire parking lot. This includes both the existing pavement areas and the proposed parking areas. The same pavement section will be installed throughout the parking lot, as shown in the construction details.
