1.0 INTRODUCTION

Mabbett and Associates, Inc. (Mabbett®) performed a survey for regulated building materials (RBM) as part of the Old Dental Asbestos Abatement project at the Castle Point VA Medical Center located at 41 Castle Point Road, Wappinger Falls in Castle Point, New York. Site survey work was performed on October 18, 2023, and February 6, 2024, by appropriately credentialed regulated building material inspectors and consisted of the following activities:

A review of the existing facility regulated building reports and renovation history;

An Asbestos Containing Material (ACM) survey of suspect materials (Analysis by Polarized Light

Microscopy [PLM] and Transmission Electron Microscopy [TEM]); and Limited Lead Containing Paint (LCP) and Lead Containing Material (LCM) sampling (Analysis by atomic absorption [AA]).

The survey was limited to materials and areas of the Ground Floor of Building 16 as specified in the Statement of Work and on the drawings provided by the client that will be impacted by the project. Areas and materials outside of this scope of work were not included in the survey and report.

1.1 Purpose and Objectives

This regulated building material survey was comprised of three primary project tasks including:

Evaluation of existing site conditions and formulation of a sampling plan.

Site survey to collect building material samples for laboratory analysis.

Development of this Regulated Building Materials Survey Report.

This project was designed to accomplish two primary objectives: (1) to collect a representative number of building materials for laboratory analysis and reporting; and (2) to use data from the laboratory analysis efforts to estimate the volume of hazardous and regulated building materials present within the building’s interior and exterior for subsequent use in development of an abatement scope. These two objectives were met through a combination of a site inspection to collect building material samples for laboratory analysis; interpretation of qualitative data collected in the field; and the quantitative laboratory data generated from analysis of the building materials as summarized in this survey report.

1.2 Summary of Survey Results

As required by State and Federal regulations, bulk samples of suspected ACM were collected by Mabbett and NY licensed asbestos sub-consultant Hillmann Consulting LLC (Hillmann) and submitted under chain of custody (COC) for laboratory analysis to Hillmann’s asbestos laboratory in Union, New Jersey (Certified Proficient by New York State Department of Health (NYSDOH) Environmental Laboratory Approval Program (ELAP), Laboratory ID #10926). The Environmental Protection Agency (EPA), the NYSDOH and the Occupational Safety and Health Administration (OSHA) defines ACM as any material that contains greater than one percent (>1%) asbestos.

Paint chip samples and building material samples were collected by Mabbett for lead analysis using AA spectroscopy and submitted under COC procedures to Scientific Analytical Institute (SAI) of Greensboro, North Carolina.

Survey efforts yielded the following results:

Eighty-six (86) bulk samples for suspect ACM were collected for laboratory analysis and reporting. fifteen

(15) of the materials were determined to contain asbestos or were assumed ACM. One (1) of the materials were determined to contain trace amounts of ACM.

Two (2) LCP samples collected from building surfaces revealed concentrations of lead in paint that exceed the U.S. Department of Housing and Urban Development (HUD) threshold of 0.5 percent by weight and

1.0 mg/cm² by XRF.

One (1) LCM sample collected from wall shielding material was identified as 56% lead by weight.

2.0 ASBESTOS SURVEY

A visual screening inspection was conducted by New York State licensed asbestos inspectors to identify locations of suspect ACM and conceptualize the sampling program. Only areas that were included in the scope of work and that were accessible during the fieldwork phase were inspected. Reasonable efforts were made during the initial field survey to access areas as necessary to complete the asbestos survey and sampling program.

2.1 Sampling Methodology

Site inspection work was performed on October 18, 2023, and February 6, 2024, by New York State licensed Asbestos Inspector Mr. Kevin M. Donovan (#927987383) and Victor J. Escalona (#133737250). Bulk asbestos samples were collected using EPA National Emissions Standards for Hazardous Air Pollutants (NESHAP), 40 CFR Part 763, and Asbestos Hazard Emergency Response Act (AHERA) protocols. The inspection was limited to the Old Dental Clinic in Building 16. Bulk suspect ACM sampling was generally conducted according to the following sampling protocol:

Friable surfacing material:

At least three bulk samples shall be collected from each homogeneous area that is 1,000 ft2 or less.

At least five bulk samples shall be collected from each homogeneous area that is greater than 1,000 ft2 but less than or equal to 5,000 ft2.

At least seven bulk samples shall be collected from each homogeneous area that is greater than

5,000 ft2.

Thermal system insulation:

At least three bulk samples shall be collected from each homogeneous area of thermal system insulation.

At least one bulk sample shall be collected from each homogeneous area of patched area of thermal system insulation.

Sufficient samples shall be collected from elbows and fittings to determine if they contain ACM.

Bulk samples shall not be collected from any homogeneous area where the state licensed asbestos inspector determined that the thermal system insulation is fiberglass, foam glass, rubber, or other non-ACM.

Miscellaneous material:

At least two bulk sample shall be collected from each homogeneous area that is less than

100 ft2.

At least three bulk samples shall be collected from each homogeneous area that is greater than 100 ft2.

Areas that were inaccessible, or where the survey was limited to visual observation only, are identified below:

Within walls Enclosed pipe/duct chases Electrical equipment Fire Doors

2.2 Analytical Methodology

The collected bulk samples were submitted under chain of custody (COC) for laboratory analysis to Hillmann’s asbestos laboratory in Union, New Jersey and Scientific Analytical Institute (SAI) of Greensboro, NC (Certified Proficient by New York State Department of Health (NYSDOH) Environmental Laboratory Approval Program

© 2024, Mabbett & Associates, Inc. Page 2 April 4, 2024

(ELAP), Laboratory ID #10926) for PLM and TEM analysis as required by the New York State Environmental Laboratory Approval Program (ELAP). PLM analysis of friable materials was performed using NYS ELAP Method

198.1. Samples of Non-Friable Organically Bound (NOB) materials were analyzed by PLM (NYS ELAP Method 198.6) subsequent to matrix reduction, NOB samples that were identified as non-ACM by PLM methods were re-analyzed by TEM (NYS ELAP Method 198.4) for confirmation purposes. Hillmann Consulting is accredited by the American Industrial Hygiene Association (AIHA) and participates in the National Voluntary Laboratory Accreditation Program (NVLAP). Additional bulk samples were collected on February 6th, 2024, by Mabbett and were submitted to Scientific Analytical Institute Inc. (SAI) of Greensboro, North Carolina. Additional bulk sample laboratory reports, and COC documentation are provided in appendix E.

Bulk sample results from this inspection are summarized in Appendix A, Summary of ACM Sampling Results. The EPA, Occupational Safety and Health Administration (OSHA), and Part 56 of Title 12 of the Official Compilation of Codes, Rules, and Regulations of the State of New York (12 NYCRR Part 56) defines any material that contains greater than one percent (>1%) asbestos as being an ACM. As such, the analytical laboratory identified bulk samples as positive for asbestos that met the regulatory criteria of greater than one percent (>1%) asbestos.

Laboratory reports and COC documentation are provided in Appendix B of this report.

2.3 Summary of Asbestos Containing Materials Findings

Mabbett identified thirty-four (34) homogenous materials and collected forty (80) representative bulk ACM samples. Eighty-six (86) samples were analyzed by PLM and forty-three (43) samples were analyzed by TEM. The laboratory-reported analytical data indicated that thirteen (13) of the materials sampled as part of this survey contained 1% or greater asbestos and are classified as ACM. One (1) material contained less than 1% asbestos and is considered trace asbestos containing material. Estimated quantities of materials identified as containing ACM during this survey are presented in Table 1.

3.0 LEAD CONTAINING MATERIALS SAMPLING

The limited LCP and LCM sampling included the collection of paint chips and materials from surfaces and systems in the areas surveyed in Building 16 Old Dental Clinic. Thirteen (13) LCP samples of different homogenous areas of paint were collected during this survey. One (1) bulk sample of suspect materials was collected during this survey. Paint chips and bulk samples were submitted under standard COC procedures to Scientific Analytical Institute, Inc. (SAI) in Greensboro, North Carolina. Analysis was conducted using AA EPA method SW-846 3050B/6010C/7000B.

3.1 Sampling Methodology

Paint chip samples are collected using a sharp hand tool to score and peel paint off a 1 square inch (or larger) area of the substrate. Different tools such as chisels, putty knives, and hammers may also be needed in the collection of lead-based materials. All tools are cleaned after each sample to prevent cross contamination. Collected samples are submitted under COC procedures to an accredited laboratory and analyzed via Flame Atomic Absorption Spectrophotometry (AA).

3.2 Analytical Methodology

The regulations addressing LCP in non-residential buildings are focused on occupational exposures involved with paint-disturbing activities and related waste-disposal activities. Occupational exposure to lead is regulated by OSHA regulation 29 CFR 1926.62, Lead in Construction, as well as other applicable state and local regulations. An LCP survey cannot determine a safe level of lead for the purpose of paint-disturbing/waste-disposal activities but is intended to provide guidance as to the locations of surfaces containing lead.

Contractors may use this information to better determine where worker exposures to airborne lead and other hazards may occur. They can then assess the potential magnitude of exposure to their employees and identify the controls necessary to limit health risks. This information can also be used for pre-characterization of demolition waste streams prior to toxicity characteristic leaching procedure (TCLP) sampling in accordance with 40 CFR Part 261.

3.3 Lead Sampling Results

A concentration of lead greater than or equal to 0.5 percent by weight (equivalent to 5,000 ppm) or 1.0 mg/cm² exceeds EPA and HUD residential standards and is considered an indicator of risk. The results of the LCP sampling survey identified two (2) of the samples at a level indicative of risk. The results of the Bulk sampling survey identified one (1) of the samples at a level indicative of risk.

The results of the limited LCP sampling are summarized in Table 2, with laboratory reports provided in Appendix C.

4.0 CONCLUSIONS AND RECOMMENDATIONS

4.1 Asbestos

Materials containing asbestos were identified in the areas surveyed. Any suspect materials encountered during demolition or renovation activities that were not identified in this report as being non-ACM, should be assumed to be ACM unless sample results prove otherwise. Suspect ACM that may be present within the walls, above inaccessible hard ceilings, or in other inaccessible locations, should be assumed to contain asbestos if discovered during any demolition or renovation process or until otherwise verified. ACM must be abated and properly disposed of prior to disturbance by state licensed and properly trained contractors. All abatement must be performed in accordance with federal, state, and local requirements.

4.2 Lead Containing Materials

The purpose of the limited Lead Containing Materials survey was to identify similar areas of LCP and building materials. During the on-site survey, representative samples of similar areas of interior building coatings were collected and analyzed for lead content. The regulations addressing lead in non-residential buildings are focused on occupational exposures involved with paint-disturbing activities and related waste-disposal activities.

Occupational exposure to lead during construction is regulated by OSHA regulation 29 CFR 1926.62 “Lead in Construction,” as well as other applicable state and local regulations. These regulations involve air monitoring to determine worker exposure levels when disturbing paint containing measurable levels of lead. This Lead Containing Materials survey cannot determine a safe level of lead for the purpose of lead material-disturbing activities. However, this report is intended to provide guidance as to the location of Lead Containing Materials so it can be controlled, abated, or disposed of properly during this project’s construction related activities.

Information gathered during this Lead Containing Materials survey should be used to determine where worker exposures to airborne lead may occur. Additionally, this information should also be used to assess the potential for exposure to workers, and for determining appropriate controls necessary to limit his or her health risks during this project.

A concentration of lead greater than or equal to 0.5 percent by weight (equivalent to 5,000 ppm) or 1.0 mg/cm2 exceeds EPA and HUD residential standards is considered an indicator of risk. Representative samples of lead containing waste to be generated during building renovation, or following demolition but prior to disposal, should be collected and analyzed using toxicity characteristic leaching procedure (TCLP) in accordance with 40 CFR Part

261. Management and disposal of lead containing waste must be done in accordance with all applicable local, state, and federal regulations.

OSHA regulations may require certain procedures for any paint that contains lead, even if it is below EPA and HUD levels. All LCP identified, regardless of the lead content, should either be sampled and analyzed by TCLP and then handled/disposed of accordingly, or segregated from other large-scale debris and then managed as hazardous waste in accordance with federal, state, and local hazardous waste disposal regulations.

Re: Limited Asbestos Inspection

41 Castle Point Road Wappinger Falls, New York 12590 Castle Point VA Medical Center - Old Dental Asbestos Abatement Hillmann Project #: A53120

Dear Mr. Delaney:

Hillmann Consulting, LLC (Hillmann) has completed a limited asbestos investigation at the above-referenced project site on behalf of Mabbett and Associates. The limited investigation was performed to identify potential asbestos-containing materials (ACM) that may be disturbed by a planned construction project at the subject property. Accessible building materials located within the scope of work were assumed or sampled and determined to contain asbestos (as depicted in the attached ACM location drawing).

Based on information, instruction, and plans (no architect listed on plans provided), titled Architectural Plan/Demolition Plan, dated August 29, 2019, provided by Mabbett and Associates, the scope of the investigation was limited to the former dental space in the Basement of Building 16, including designated components of the building exterior (brick mortar and window caulking), at the subject property. The scope excluded all other areas and building materials of the project site.

Hillmann notes the potential that suspect materials may exist within the inspected building areas that were concealed from view or inaccessible at the time of the survey and, therefore, not documented or tested during this investigation. Untested suspect materials may be concealed within enclosed wall and ceiling cavities, sealed pipe chases and risers, beneath flooring materials, and the interior of heating, ventilation, and air-conditioning (HVAC) equipment and ductwork.

The work was performed in accordance with recommended procedures found in the U.S.

Environmental Protection Agency's (USEPA’s) Asbestos Hazard Emergency Response Act (AHERA) Regulation 40 Code of Federal Regulations (CFR) Part 763.85 through Part 763.88, and 12 New York Code of Rules and Regulations (NYCRR) Part 56 (Industrial Code Rule 56). These procedures include the methods for the visual inspection, assessment, sample collection, and analysis of suspect ACM.

The sampling locations were vacant at the time of the survey.

Hillmann Consulting LLC

Page 2 of 5; Hillmann Project A53120

On October 18, 2023, a limited asbestos investigation of the above-referenced location was performed by Victor Escalona, a New York State Department of Labor (NYS DOL) certified Asbestos Building Inspector qualified by experience, education, and training in the recognition of suspect ACM and approved bulk sampling techniques.

Eighty (80) samples of suspect materials were collected and submitted under chain of custody for laboratory analysis to Hillmann Consulting, LLC, of Union, NJ (Certified Proficient by New York State Department of Health (NYSDOH) Environmental Laboratory Approval Program (ELAP), Laboratory ID #10926). The analysis method was polarized light microscopy (PLM) with dispersion staining, as required by the USEPA. Additionally, forty (40) samples of non-friable, organically bound (NOB) materials identified as non-asbestos via PLM analytical methodology were submitted for further analysis by transmission electron microscopy (TEM), as per NYSDOH ELAP. The same Hillmann laboratory analyzed the samples. ACM is defined by federal regulations as any material or product containing more than one percent asbestos.

The laboratory was instructed to stop analysis after the first positive result in any homogeneous group of samples. Six (6) PLM and six (6) TEM samples were collected but not analyzed due to this method. In accordance with USEPA protocol, a positive result indicates that the homogeneous group is considered to be asbestos-containing, and further analysis is not necessary.

Suspect building materials that were observed during this investigation and sampled and were identified as ACM are listed in the following table. All quantities are approximate and subject to field verification and only include materials located in the renovation scope of work areas unless otherwise indicated.

The planned work may impact or otherwise disturb ACM. The removal of ACM must include consulting services (air and project monitoring) and be performed by a New York-licensed asbestos abatement contractor in accordance with all federal, state, and local laws governing asbestos.

If alternative work procedures are implemented that will not impact or otherwise disturb ACM in good condition, removal is not required before renovation. The remaining ACM should be documented by an Operations & Maintenance Program so it can be adequately maintained until such time that abatement is warranted (such as in the event of future damage or planned disturbance).

If suspect building materials not identified in this report are encountered during activities that may disturb those materials, all work that could potentially disturb the material(s) must stop. The unidentified materials must be assumed to be ACM and handled accordingly, pending the completion of additional sampling and laboratory analysis.
