About this file

This is Amendment 0002 to solicitation 36C24225B0006 for the renovation of Building 9 at Bath VA Medical Center, issued by the VA Network Contracting Office 2. The amendment adds RFI questions and answers, a submittal log example, and crawlspace photos to the solicitation package. The amendment clarifies that document 36C24225B0006_1.docx posted on November 22, 2024 is invalid, and bids must use the solicitation dated 11-26-2024.

Key clarifications from the Q&A include: liquidated damages do not apply; off-hours work will be minimal since Building 9 is unoccupied; VA staff will handle telephone installation; professional photography is not required; the SSHO/CP responsibilities can be handled by the superintendent; the building is not historically registered; and the Bath VA has an existing Trane contract for the building management system. Bids are due by 12:30 PM on January 8, 2025, with bid opening at 1:00 PM. The amendment includes technical clarifications regarding submittals, crawlspace requirements, door frames, and window specifications.

RFI Questions and Answers for 36C24225B0006 - Renovate Building 9

1. Liquidated Damages are indicated on Page 32 of the solicitation but no dollar amount / penalty is defined. Please clarify.

Answer: Please disregard 52.211-12-Liquidated Damages on page 36 of the solicitation as it does not apply to this project.

2. The solicitation (general requirements) on Page 73 Item B reference ‘implied work’. Please define the parameters of this statement as the contractors bid to the documents to ensure fair and equal bidding practices and we are not to make inferences regarding design intent.

Answer: Implied work is industry standards and quality of workmanship. Contractors should base their bid on the information shown on the contract documents.

3. The Solicitation (general requirements) Item E references the Canandaigua VA. Please confirm this is a typo.

Answer: This is a typo. Please replace any reference to the Canandaigua VA with Bath VA.

4. The Solicitation (general requirements) Item H discusses long lead material payments / stored materials. Please confirm that if stored material invoicing is not allowed that there is a price escalation clause for material price increases.

Answer: The VA does not pay for stored material and your bid should be adjusted to capture the risks associated with price escalations or storage. Exceptions can be made by the CO on rare occasions, but the contractor must submit the request and have it approved by the CO.

5. The Solicitation (general requirements) Items L & M refer to minimizing impacts to patient care due to noise and state that “Off tour work may be required to minimize impact to Veterans and employees “. Please clarify if this is a minimal expectation or if the facility intends for a substantial or quantifiable amount of construction activities to be completed off-hours, and which tasks are impacted by this stipulation.

Answer: Building 9 is unoccupied and is in an area of the campus with low patient traffic. Off hours work is expected to be minimal for this project.

6. The Solicitation (page 74) states that a submittal log is attached, however other areas of the documents indicate this is to be provided by the Contractor. Please indicate if the submittal log is missing from the bid documents as they are referenced.

Answer: A submittal log is included as a reference; contractors are responsible for submitting their own. The reference submittal log is included with these responses.

7. Please verify if the bid issued specifications are construction-ready. The specification set indicates this version is a bid submission.

Answer: Documents are construction ready, this is just the bidding phase of the project.

8. Specification Section 01 00 00 Section 1.3 Statement of Bid has a base item and (2) undefined alternates. Please confirm there is only one lump sum bid price required.

Answer: There will be one lump sum, all-inclusive bid price.

9. Specification Section 01 00 00 Section 1.17: NEW TELEPHONE EQUIPMENT The contractor shall coordinate with the work of installation of telephone equipment by others. This work shall be completed before the building is turned over to VA.

· Please clarify who will be providing and installing the telephone equipment (third party or VA staff?)

Answer: VA staff will install the telephones. These will be relocated from the existing police station.

10. Specification Section 01 00 00 Section 1.24 calls for professional construction photography. Please confirm this requirement as sometimes it is enforced and sometimes it is waived.

Answer: Disregard this section, professional photography is not required.

11. Specification Section 01 33 23 Section 1.5 Submittal Preparation redefines how to process submittals:

· Collect required data for each specific material, product, unit of work, or system into a single submittal. Prominently mark choices, options, and portions applicable to the submittal. Partial submittals will not be accepted for expedition of construction effort. Submittal will be returned without review if incomplete.

· Is this a new VA requirement or the requirement of this specific AE?

· The standard for the VA for at least 10 years has been to submit one item per cover sheet because bundling items under a single cover sheet results in confusing partial approvals or multiple revision sequences to obtain a complete approved package. Submitting in this format eliminates the ability to order materials to keep the construction schedule moving, and leads to extended submittal performance periods as well as longer review cycles increasing costs for everyone, to include the government, when submittals are not reviewed or returned within the allotted time frame due to a perceived formatting issue, though the content is generally acceptable.

· Please clarify this clause.

Answer: The VA standard practices still apply, but dependent items can be grouped when reasonable. This clause is to prevent incomplete information. For example, doors and frames should be submitted together. This submittal would be rejected it only the doors were included since a review could not be done.

12. Please clarify the SSHO requirements; can these responsibilities be absorbed by the onsite superintendent or is a second person required?

Answer: The SSHO and CP can be superintendent or another qualified individual. They must be designated as the responsible party in the various safety plans.

13. Is the building on the historical registry? If so, are there any construction restrictions or implications related to this? Do contractors need to source authentic or matching materials?

Answer: Building is not on the historical registry. Any requirements for matching are included in the contract documents.

14. Please complete the chart in Specification 09 06 00 – Schedule for Finishes. The bulk of the items are unclarified or state additional information is to be provided by the VA.

Answer: Chart is included for coordination purposes. Minimum requirements for finishes or materials are included on the plans and in the respective specifications. Colors and patterns that may vary by manufacturer are to be selected by the VA during the submittal process.

15. A-001: 8. THE CONTRACTOR SHALL VISIT THE SITE TO VERIFY FIELD CONDITIONS, NO ADDITIONAL PAYMENT WILL BE MADE FOR FAILURE TO ACCOUNT FOR OBSERVABLE CONDITIONS

· Please clarify; site visits are not identified as mandatory by the contract documents.

Answer: Site visits are not mandatory but encouraged to allow prospective contractors the opportunity to view the site.

16. Keyed note 2 on Drawing SB 100 states existing basement floor has a headroom clearance of 3’-0” +/. Keyed note 5 on Drawing AD 101 states contractor to “remove debris from crawlspace and level to 6’-0” below first floor”. Please confirm the expectation is remove approximately 3’-0” of dirt from the entire crawlspace area.

Answer: Existing headroom varies and is to be cleared and leveled to a depth of 6’ below the top of the first-floor elevation. Existing crawlspace depth varies, and some soil will need to be removed for leveling purposes. Bids should be based on the information provided on the contract documents and provided pictures.

17. It looks like there are conflicting details on the Door Schedule AE601. Head and Jamb details listed do not match up with the Frame material listed. Could you please confirm frames listed as Type 2 Hollow Metal should just be standard Hollow Metal frames?

Answer: Correct, type 2 hollow metal frames should reverence jamb detail 3, not 8, on the plans.

18. Concrete surface repair is detailed on Drawing SB 502, however there appears to be no plan reference to their use or location. If these details are provided to be used in the event that they become necessary to use, should the bid require an allowance be included if they cannot be quantified at this time?

Answer: This detail is primarily for repair of exterior concrete piers, as indicated by note 3 on SB100.

1. Does the Bath VAMC have a standing controls contract / Contractor in place or is building 9 Bacnet (23 09 23) open to all controls contractors? Please advise.

Answer: The Bath VA currently has a contract with Trane for the building management system. New controls shall be compatible with this.

2. I am currently working through this on another project where Trane specified mini-splits that use refrigerant R410A are the Basis of Design. These units from what I have been told are no longer available. Trane is launching their 2025 models using 454B refrigerant. I can’t say this for sure but wanted to bring it to your attention sooner rather than later. It may be worth an RFI Answer: Job will be quoted with R-454b equipment.

1. I don’t seem to see the W7 transaction window on the floor plans. Its possible I’m just not seeing it but I was wondering if it is there how many are in the building. I’m trying to get pricing for this today.

Answer: The transaction window is located in between the vestibule and dispatch/operator rooms.

2. Is the window system store front or a fixed sash?

Answer: Fixed sash

3. The security screens seem to be operable even though the windows are not. Is this correct?

Answer: Correct, this is for maintenance purposes

4. Will we need to provide glass for all the interior wood doors? Type A

Answer: Glass is required to be provided as shown on the door and glass schedule
