Accordingly, the pcrmittec is apprised that noncompliance with this permit may lead to an enforcement action and may result in publication of its name in an appropriate newspaper in accordance with this section.
H. Significant Non-Compliance
In accordance with the United States Environmental Protection Agency regulations, 40 CFR 403.8
(f)(2)(vii) and the City of Brockton Sewer Use Ordinance, the City is required to publish annually, at a minimum, a list of all companies that are or have been in significant noncompliance (SNC) with federal, state, or local wastewater discharge pretreatment standards or other pretreatment requirements during a twelve (12) month period. An industrial user is determined to be in SNC if it meets one or more of the following criteria:
a) Chronic violations of wastewater discharge limits, defined as those in which sixty-six percent of more of all of the measurements taken during a six-month period exceed (by any magnitude) the daily maximum limit or the average limit for the same pollutant parameter;
b) Technical Review Criteria (TRC) violations, defined as those in which thirty-three percent or more of all of the measurements for each pollutant parameter taken during a six-month period equal or exceed the product of the daily maximum limit or the average limit multiplied by the applicable TRC (TRC = 1.4 for BOD, TSS, fats oil, and grease, and 1.2 for all other pollutants except pH);
c) Any other violation of a pretreatment effluent limit ( daily maximum or longer-term average) that the Control Authority determines has caused, alone or in combination with other discharges, interference or pass through (including endangering the health of POTW personnel or the general public);
d) Any discharge of a pollutant that has caused imminent endangerment to human health, welfare or to the environment or has resulted in the POTW's exercise of its emergency authority under paragraph 403.8 (f)(l)(vi)(B) to bait or prevent such a discharge;
e) Failure to meet, within 90 days after the schedule date, a compliance schedule milestone contained in a local control mechanism or enforcement order for starting construction, completing construction, or attaining final compliance;
f) Failure to provide, within 45 days after the due date, required reports such as baseline monjtoring reports, 90 day compliance reports, periodic self-monitoring reports and reports on compliance with compliance schedules;
g) Failure to accurately report noncompliance;
h) Any other violation or group of violations which the Control Authority determines will adversely affect the operation or implementation of the local pretreatment program.
As directed by the EPA, SNC is calculated using a system of rolling quarters. Each six-month period is made up of two quarters that are evaluated. Data evaluation begins with the last quarter of the previous year. Data is reviewed to determine if 66% or more of the data for any single parameter exceeds the limit or 33% or more exceeds the TRC limit. The data is evaluated for the periods of October I - March 31;
January 1 - June 30; April I - September 30; and July 1 - December 31. Each six-month period is reviewed independently to determine SNC. An industrial user (Ill) cannot be published in SNC for the same parameter twice. If the l U was published for violations that occurred during the last quarter of the April - June period, then the IU could not be determined to be in SNC for those same violations in the next pretreatment year.
I. Civil and Criminal Liability
Nothing in this permit shall be construed to relieve the permittee from civil and/or crimfoal penalties for noncompliance under Section 23-104 of the Sewer Use Ordinance or State or Federal laws or regulations.
