About this file

This Consolidation Determination and Findings document details the Department of Veterans Affairs' (VA) plan to consolidate an enterprise-wide infusion pump fleet replacement procurement. The Network Contracting Office 1 (NCO1) intends to award multiple multiple-award Indefinite-Delivery/Indefinite-Quantity (IDIQ) contracts with a five-year ordering period to replace recalled infusion pump equipment across VA Medical Centers. The procurement will cover hardware, software, professional services, large volume infusion pumps, syringe pumps, patient-controlled analgesia (PCA) pumps, and related technical support, installation, and integration services.

Market research conducted through Request for Information (RFI) processes in July 2024 and industry days in September 2024 revealed limited small business and service-disabled veteran-owned small business (SDVOSB) capabilities for meeting the requirement. The VA determined that consolidating the procurement would not negatively impact small businesses and would enable more efficient equipment replacement. The NAICS code for the requirement is 339112 with a small business size standard of 1,000 employees. The solicitation will be unrestricted, with an anticipated Request for Proposal release in May 2025 and potential contract award by September 2025, using FAR 15 evaluation procedures where non-price factors are more significant than price.

. In addition to the RFIs and industry days, required queries of VetCert and SBA DSBS were conducted. A search of the VetCert database using NAICS code 339112 resulted in a total of SDVOSB and VOSB concerns. A search of SBA’s DSBS using NAICS code 339112 resulted in a total of SBA-certified small business concerns. A query of the same tool using NAICS 339112 and keywords Infusion Pump and IV Pump resulted in negligible results. None of the SDVOSBs, VOSBs, or small businesses from the results of VetCert and DSBS were contacted as responses to multiple RFIs did not draw other SBs other than the SDVOSB distributors and small business OEM already mentioned. There were no other sources identified as capable of fulfilling this requirement.

Responses to the RFIs indicated that some manufacturers offer some equipment on non-VA established contracts. However, there are concerns with using the established contracts due to limited capabilities offered and limited number of manufacturers under contract, thereby minimizing the competitive field.

III. CONSOLIDATION.

A. Benefits. To be determined necessary and justified, the benefits of a consolidated acquisition must substantially exceed the benefits that would be derived from alternative contracting approaches that involve a lesser degree of consolidation.

Such benefits may include quantifiable cost savings or price reductions as well as other benefits, regardless of whether quantifiable in dollar amounts, to include quality improvements that will save time or improve or enhance performance or efficiency, reduction in procurement administrative lead time (PALT), better terms or conditions, or any other supportable benefit. The expected benefits of this consolidated acquisition will be discussed in the paragraph below.

The award of a multiple award IDIQ contract resulting from this procurement will enable VA to more effectively and efficiently order infusion equipment to replace the recalled equipment in many VA medical facilities. Even if each individual VA medical facility conducted separate procurements to replace its recalled equipment, it is highly unlikely that the acquisition would be set aside for small businesses or SD/VOSBs because of the unlikelihood that a CO would seek an individual waiver of the NMR since doing so would allow the VA Rule of Two to be met thereby minimizing the field of competition to only a few SDVOSB distributors of only OEMs’ infusion equipment. As such, consolidation of these various VA medical facilities’ infusion pump requirements under an enterprise-wide acquisition would not further impact the small business community. Moreover, issuance of an unrestricted solicitation does not prevent the SDVOSB distributors from submitting proposals.

By establishing a multiple award IDIQ contract, each VA medical facility will be able to select from a pre-approved list of infusion equipment that meets VA’s technical requirements. The fair opportunity competitions under the IDIQ contracts will then present each VA medical facility with the opportunity to consider other
