Two-part question: In "Factor 1 Experience," the solicitation requests details of projects
Part 1 Answer: No, the disclaimer in factor 3 applies to factor 3. It does not apply to factor 1.
completed jointly by the design-build team.
Similarly, "Factor 3 Past Performance" requires referencing the same projects. However, in "Factor 3," there's a disclaimer stating, "Contractors without relevant past performance, or for whom past performance information is not available, will neither be rated favorably nor unfavorably based on past performance." Does this stipulation apply to "Factor 1"? If the only way to meet the criteria for "Factor 3" is by fulfilling "Factor 1," why does this disclaimer exist?
If a proposal addresses Factors 1 and 3 using projects not jointly completed by the design-build team, but instead by one or both members separately, will it be deemed non-responsive?
Factor 1 is for displaying a contractor’s experience. The information required are completed projects and their meta-data. Such as: title, period of performance, location, sub-contractors, client, completion dates, scope of the project and more as outlined in the section.
This section shows what projects the company has successfully worked on.
Factor 3 is for displaying a contractor’s past performance.
The information required are past performance evaluations and/or past performance questionnaire.
This section shows the quality of work a contractor provided to the client on the aforementioned projects.
Past Performance ratings (such as a CPARS report) are not given to every project. Formal evaluations are regulated by dollar values and length of the Period of Performance when dealing with the Government and FAR part 42.15. Therefore, since the two factors request different information, addressing factor 1 does not address factor 3.
Additionally, since it is possible for a company to have worked on many projects under the dollar/time thresholds (resulting in no formal past performance ratings being conducted), the disclaimer was put in place to address this situation. Hence, why the disclaimer exists.
Part 2 Answer: Factor 1 requires proposals include a minimum of one project in which the Offeror’s Design-Build team has worked together on previous projects. If a proposal is received that does not show the Design-Build team working together, then Factor 1 requirements cannot be met, and the offeror will receive a low rating from the review board when they evaluate the proposals. The only instance in which separate projects for members are acceptable is when the company is a Joint Venture; per the information provided in section E.9 Part 3.C.1.i. “Factor 1 Experience”.
