Answers to Lead Abatement IDIQ Solicitation Questions

PROJECT NUMBER: Sample Project 1 PROJECT TITLE: Exterior Wood Lead Paint Removal, Building 11 & 25

1. Scope of Work: Is there any target housing within this RFQ? No Housing in either Bldg 11 & 25.

2. Scope of Work: The Statement of Work includes, “… and other lead painted exterior wood…”. Does this mean any additional work not listed is an amendment to the contract? Yes any non-wood exterior surface that is found would be an amendment to this contract.

3. Section 02 83 33.13 Lead-Based Paint Removal and Disposal- Central MA, paragraph K Lead Control Area, page 02 83.13-2: This paragraph states “enclosed area or structure with full containment…”. Erecting and maintaining a completely enclosed area on the exterior of the buildings for the duration of the work is not industry standard and is not required by state or federal requirements. It is prohibitive and almost impossible, and must also include safety issues (i.e., security, high winds). Is the VA requiring the containment system described for this exterior work? No VA requires adherence to state and federal requirements and industry standards.

4. Section 02 83 33.13 Lead-Based Paint Removal and Disposal- Central MA, 3.7 Cleaning and Disposal, paragraph E Waste Disposal, page 02 83 33.13-12: Will the VA be receiving lead waste from the abatement contractor for disposal by the VA? No the Contractor will be responsible for disposal. VA Environmental Protection will sign off on the manifest and will require the final manifest and original disposal documents delivered upon completion.

5. The specifications references drawings for this RFQ. Can the VA please provide the drawings? Included. These are just the first floor plans.

FOR ADD: Include repainting in primer and 2 coats of Sherwin Williams Acrylic Latex Exterior Antique White with no VOC or equivalent. Must meet VA requirements.

PROJECT NUMBER: Sample Project 2 PROJECT TITLE: Abatement of Lead-Based Paint from the Exterior of Buildings 3, 4, 5, 6, 7, 8 & 9

1. Statement of Work: Is there any target housing within this RFQ? No. However, these building are considered historic building with primary administrative functions.

2. Statement of Work: The Statement of Work states, “The areas that require abatement include but not limited to the following:” Does this mean any additional work not listed is an amendment to the contract? Yes

3. Section 01 35 26 Safety Requirements, Table of Contents, 1.13, page 01 35 26-1: Tuberculosis Screening is included in the Table of Contents. Is tuberculosis screening required, as 1.13 is not included in this Section? If yes, is tuberculosis screening required for all contract employees, the CIH (or CIH’s Industrial Hygiene Technician) and the CSP (or CSP’s certified Construction Safety and Health Technician)? The work required is in Exterior of Buildings 3-9 where they are primary administrative office areas, we don’t believe TB screening is required for workers and IH & CSP personnel since the risk of TB infection or transmission is minimal.

4. Section 01 35 26 Safety Requirements, page 01 35 26-13: This section states “Each subcontractor shall designate a minimum of one CP …” If no subcontractors are used, is the Prime Contractor required to designate a CP? If yes, can the Prime Contractor’s SSHO also be the CP? Yes, VA requirement is OSHA 30-hour construction safety training on site. It is Primary contractor’s responsibility to determine and delegate a qualified person to be the CP.

5. Section 01 35 26 Safety Requirements, paragraph 1.9.B, page 01 35 26-15: If the contract work is completed in less than a month, is a random monthly site inspection by a CSP or CSHT required? Yes, at least once.

6. Section 02 83 33.13 Lead-Based Paint Removal and Disposal, paragraph 1.5.C.3., page 02 83 33.13-3: Can a state-licensed lead paint inspector perform inspection of the lead-containing paint removal work instead of the CIH or the CIH’s Industrial Hygiene Technician, when required? Yes, CT-DPH licensed Lead Inspector or Risk Assessor is qualified to perform inspection.

7. Section 02 83 33.13 Lead-Based Paint Removal and Disposal, Part 3 Execution, paragraph 3.1.B. Lead Control Area Requirements, page 02 83 33.13-6-7: 3.1.B.1. states: Establish a lead control area by completely enclosing the area where lead-containing paint removal operations will be performed.” 3.1.B.2 states “Contain removal operations by the use of a negative pressure full containment system …”. Erecting and maintaining a completely enclosed area on the exterior of the buildings for the duration of the work is not industry standard and is not required by state or federal requirements. It is prohibitive and almost impossible, and must also include safety issues (i.e., security, high winds). Is the VA requiring the containment system described for this exterior work? The specification is primary for interior lead abatement work. A negative pressure full containment system is not required for exterior lead abatement. However, the contractor is required to establish a lead abatement work area. Engineering controls are required to prevent lead dust & debris from entering occupied buildings and spreading in air and contaminating adjacent ground and soil. Engineering controls shall be used to prevent VA employees and patients from exposure to lead. Some abatement areas are in highly visible and traffic areas (e.g. courtyard, driveway, etc.) Examples of engineering controls include but not limited to tarp/poly on ground 15 feet from exterior walls, critical barriers on windows or openings from interior side, poly around security fencing and scaffold/platform or lift, angled plastic shed with HEPA vacuum machines, etc. The contractor is required to submit a lead-paint removal plan to VA for review and approval prior to beginning work.

8. Section 02 83 33.13 Lead-Based Paint Removal and Disposal, paragraph C, page 02 83 33.13-8: Can an employee of the contractor work under the direction of the CIH to inspect the lead-containing paint removal work? No. The contractor’s employees can do quality control under CIH. However, VA will require a third party lead inspector or qualified CIH to perform inspection during and after lead paint removal.

9. Section 02 83 33.13 Lead-Based Paint Removal and Disposal, paragraph 3.3.A and C, page 02 83 33.13-9: Paragraph A states to remove paint… in order completely expose the substrate”. Paragraph C states “perform manual sanding and scraping to the maximum extent feasible”. What does “perform manual sanding and scraping to the maximum extent feasible” mean? Is the lead-based paint to be removed 100% or is only loose and flaking lead paint to be removed? Yes, 100% removal.

10. Section 02 83 33.13 Lead-Based Paint Removal and Disposal, paragraph 3.3. Paragraph B Mechanical Paint Removal and Blast Cleaning, page 02 83 33.13-9: Are either mechanical paint removal or blast cleaning associated with this RFQ? No, Mechanical Paint Removal and Blast Cleaning will not be allowed unless you use a negative pressure full containment with HEPA filtered exhaust machine that is equivalent to asbestos abatement containment. All waste may become RCRA hazardous waste.

11. Section 02 83 33.13 Lead-Based Paint Removal and Disposal, paragraph 3.4 Surface Preparations, page 02 83 33.13-9: Is full painting or spot painting to be done by the abatement contractor? Is so, can the VA please provide Section 09 91 00 PAINTING? VA will provide painting after abatement is complete.

12. Section 02 83 33.13 Lead-Based Paint Removal and Disposal, paragraph B Disposal, page 02 83 33.10: Will the VA be receiving lead waste from the abatement contractor for disposal by the VA? No. The specification indicates that it is contractor’s responsibility to properly characterize and dispose of lead waste in an EPA approved facility using West Haven VA waste generator ID. The waste characterization, profile, and manifest must be reviewed and approved by VA Safety/GEMS program Manager.

13. The specifications reference drawings for this RFQ. Can the VA provide these drawings? Yes, Contracting will post to the portal.

Question regarding the Cost Breakdown Sheet: how is the bid form to be filled out?

Complete pricing for each Sample Project to include Statement of Proposal Items, Calculation of Self-Performed Work and Itemized Cost Breakdown

Building 5, South elevation: what work is included (overhang, 2 columns)? Please provide/define the scope

Please abate all of the exposed paint at the south entrance to Building 5. This includes the areas above the door and the exposed paint on the columns.

Building 5, East Elevation: is the 2nd story overhang included, above the 6-0’ door? Is it to be scraped and made safe or enclosed and made safe? Can the door be shut down during the work? Please provide the scope/clarification

Please abate the paint on the detailed wood work above and on the sides of the door. This door can be closed for periods of time, but needs to be off normal hours/weekends.

Buildings 8 & 9: Please define of scope of work to be performed

PROJECT NUMBER: Sample Project 1 PROJECT TITLE: Lead Paint Removal Buildings 61 and 62

Building 61:

Please see the attached pictures with clarifications listed.

Please confirm that the only scope of work is the removal of the windowsill and trim piece below the windowsill as was discussed onsite. (see attached picture) Are the sills and trim being replaced under this contract?

If so, please confirm that prime and paint to match is a part of this contract.

If so, please confirm that a detailed profile on the trim and sill is not required on the replacement wood as the mock ups are dimensional lumber (see attached picture) Is the VA responsible for moving all furniture, AC’s and other movable items blocking access to the work?

Building 62:

Please confirm that removal and replacement of all door components are included in this contract (i.e door, frame) Is prime and painting included as a part of this contract?

With this being a residential building, will wipe samples be required?

Can the hardware being re utilized?

What is the turn around time for a single door from start to completion (i.e., how long can a resident be out of their room?)

How many rooms can be taken at one time?

Are there any door openings that are being widened for ADA compliance?

Questions related to IDIQ:

“Will the VA be receiving lead waste from the abatement contractor for disposal by the VA?” We do not “receive” lead waste from anyone, including an abatement contractor.

My understanding has always been that project waste disposal (hazardous or otherwise) was the contractor’s responsibility – is this correct? Yes

Also, in the case of project-generated hazardous wastes, does the VA GEMS Coordinator sign the hazardous waste manifest since the waste is being generated by the VA facility? In the case of non-hazardous (but otherwise regulated) wastes, does the GEMS Coordinator sign the Bill of Lading? I’ve attached a copy of the CFM TIL Lead-Based Paint Removal and Disposal specs (please see Section 3.7, subsections E & F). Depends, usually it is delegated to the contractor, but some facilities will sign the manifest and or Bill of Lading.

Finally, should VA facilities conduct TCLP testing on the construction debris with lead-based paint, or if it’s just lead-based paint assume it’s RCRA hazardous? The facility should evaluate the waste and test as appropriate. It is typically considered construction and demolition debris, unless you are just stripping off the lead based paint. We do not assume that all lead contaminated waste is RCRA Hazardous, we would be doing ourselves in if we did that. The state of Connecticut has a specific protocal for determining whether it is hazardous or not. Since it is the best guidance in New England I have attached. But every state regulates differently.
