About this file

This document contains an amendment to a solicitation for a medical/surgical prime vendor program in Puerto Rico. The amendment extends the closing date for proposals to January 10, 2019 and provides additional clarification to questions from offerors. The solicitation is seeking a contractor to provide medical/surgical products and value-added services to facilities of the Department of Veterans Affairs in Puerto Rico. The contractor will be responsible for delivery of products from electronic catalogs to individual facilities, with delivery requirements and service levels determined in coordination with the facilities and contracting officer. The amendment clarifies language around notice periods for changes to delivery terms, removes duplicative language from the statement of work, and confirms that the appropriate trade agreement certification for offerors' responses is the Trade Agreements Certificate rather than the Buy American Certificate. Full text of representations and certifications are required to be included in proposals unless otherwise permitted.

1. Section B.9 (STATEMENT OF WORK), paragraphs 6.8.1 and 6.10 appear to have similar / duplicative language, but with inconsistencies in terms of the advance notice that will be provided to the MSPV:

0. 6.8.1 At the discretion of facilities and in coordination and concurrence of the Government Contracting Officer, changes to delivery service levels and/or value-added deliveries may be made by facilities by providing the awarded MSPV contractor 30 days advance notice. Facilities desiring to convert to LUM distribution will provide no less than 120 days notification to the MSPV.

0. 6.10 At the discretion of facilities and with the concurrence of the Contracting Officer, changes to delivery service levels and/or value-added services may be made by facilities by providing the awarded MSPV contractor 15 calendar days’ notice.

Can the Government please revise and/or consolidate paragraphs 6.8.1 and 6.10 to remove duplicative and conflicting language?

Answer: Section 6.10 will be removed from the RFP and marked as “reserved” as to not effect numbering. Past Performance as identified in the solicitation Section 52.212 is up to the most recent five years.

1. This question is a follow up to an earlier question related to Volume II – Past Performance and the requirement to “demonstrate a minimum of 5 Year’s relevant Past Performance”. Our intention is to give you five (5) Past Performances that are most relative to the Puerto Rico MSPV RFP, but we also plan to give you an overview of our 20+ year history as a Med-Surg Prime Vendor to the US Healthcare market. Does that sound like it will answer the 5 Year part of this requirement? Otherwise, we can give you a Past Performance of a commercial account where we have been the MSPV for 5+ years

Answer: Refer to Amendment 0002 Questions and Answers, Answer number 2 as follows:

Offerors are required to demonstrate how the experience, work performed, under past contracts is related to this current requirement by outlining things like the number of end users and coverage requirements and devices provided.

The requirement to demonstrate five years of relevant Past Performance in Puerto Rico will be evaluated. Please be advised that any and all information that exceeds the requested information per section 52.212 Instructions to Offerors, submitted with an Offeror’s proposal, may not be evaluated by the Government.

1. Would the Government find it helpful for offerors to provide a general “RFP Compliance Summary and Proposal Cross Reference Matrix” (i.e., a chart that crosswalks all RFP requirements (listed by RFP Section/Page #) to an offeror’s corresponding Proposal Volume(s) and Section Reference(s))? If so, can such an “RFP Compliance Summary and Proposal Cross Reference Matrix” be excluded from any current RFP page limitations?

Answer: The Government is not requesting the use of a general “RFP Compliance Summary and Proposal Cross Reference Matrix. However, if an offeror chooses to they can submit an RFP Compliance Summary it will count against the page limitations.

1. Can we get a current list of items that the VA PR is purchasing today both direct and through the Prime Vendor? If at all possible purchases for the Gov’t 4th Qtr Jul-Sept’18 would be great or any 3-6 month period showing the item, the Mfr / vendor and Qty purchased with $ spend

Answer: No. The current list of items the Government is purchasing for VA PR are listed in the solicitation attachments.

1. SOW #48. Electronic Catalogs (ECATs). - currently ECATs are held by manufacturers or vendors, and when facilities wish to order, that order goes via EDI directly to that manuf/vendor, is received, then shipped and invoiced directly to the ordering facility. Our question is how do you anticipate ECATs being utilized by the facility within the MSPV program in PR?

Answer: SOW#48 addresses ECATs. The facility within the MSPV program in PR determines how they utilize the system.

1. Included in the solicitation Section E.6.5.b.vi. (page 146), is a requirement to complete the FAR 52.225-2 Buy American Certificate (See E.15 Page 175) for purposes of Volume IV of the Offeror’s proposal. Per Section C. of the solicitation, the resulting contract is subject to FAR 52.225-5 Trade Agreements and NOT FAR 52.225-1 Buy American – Supplies. Would the Government please confirm that the inclusion of FAR 52.225-2 in Section E.6.5.vi. and E.15., is in error. Should the correct certification have been FAR 52.225-6 Trade Agreements Certificate?

Answer: The Government confirms that the inclusion of FAR 52.225-2 is in error and the correct certification is FAR 52.225-6, Trade Agreement Certificate. FAR 52.225-2 in section E.15 on page 175 will be replaced by FAR 52.225-6 as shown below.

52.225-6 -- Trade Agreements Certificate. (May 2014)

(a) The offeror certifies that each end product, except those listed in paragraph (b) of this provision is a U.S.-made or designated country end product, as defined in the clause of this solicitation entitled “Trade Agreements.”

(b) The offeror shall list as other end products those supplies that are not U.S.-made or designated country end products.

Other End Products

Line Item No.
Country of Origin:

[List as necessary]

(c) The Government will evaluate offers in accordance with the policies and procedures of Part 25 of the Federal Acquisition Regulation. For line items covered by the WTO GPA, the Government will evaluate offers of U.S.-made or designated country end products without regard to the restrictions of the Buy American statute. The Government will consider for award only offers of U.S.-made or designated country end products unless the Contracting Officer determines that there are no offers for such products or that the offers for those products are insufficient to fulfill the requirements of this solicitation.

(End of Provision)

7. Could the Government please clarify the requirements of what specific Representations and Certifications (Reps and Certs) need to be included in the Volume IV Proposal in terms of the actual text of the specific clauses. In Section E.6.5.b.i. – viii., this lists the specific Reps and Certs that need to be included in the Volume IV. All of these FAR Reps and Certs are also included in the System for Award Management Representations and Certifications, which we have completed in the SAM system. Is it acceptable to just reference our SAM Reps and Certs for all of the specified Reps and Certs listed in this RFP Section.

Answer: The Offeror must provide full Representations and Certifications as required unless links are accepted. See Section E.6.5.b.iii.

7a. There are also two additional Reps and Certs included in Section E.4. (Page 133-134) and E.16. (Page 175-176), of the RFP that are not included in the Volume IV requirements (see Section E.6.5.b. – Page 146). Would the Government please clarify whether these should also be included in Volume IV or not. If these are to be included in Volume IV, should these be in full text or is it appropriate to reference our SAM Reps and Certs?

Answer: The two additional Reps Certs in Section E.4, (Pages 133-134) should be included in Volume IV.

Answer: All of reps and certs should also be included in Volume IV in full text except where links may be permitted.
