About this file

This document contains questions and answers regarding a draft request for proposal for a Medical/Surgical Prime Vendor program to service the Department of Veterans Affairs facilities in Puerto Rico. The solicitation seeks to award a single vendor to provide medical, surgical, cleaning, rescue and safety supplies to VA facilities through a master listing of approved products. The vendor will be responsible for managing supplier agreements and approved items, while the VA remains responsible for the overall formulary management. Questions addressed include clarifying the response due date once issued, defining a facility service level election form, setting expectations for on-site customer service at five days per week for eight hours to resolve issues, and separating FSS-priced items on consolidated invoices.

Dr. Jaime Friedel Contracting Officer Draft RFP 36C10G19R0003 Questions and Answers

1. On page 2, last paragraph in the Notice to Offerors there is a statement that reads; " THIS IS NOT A SOLICITATION. The Government does NOT invite offerors to submit proposals in response to this pre-solicitation notice. NO awards are anticipated to be made in response to this pre-solicitation notice.” Will December 20th remain as the closing response date?

Answer: This was a “Draft” RFP Notice, in which December 20, 2018, was a projected due date. Once the solicitation is posted, it’ll have the actual due date in Block 8.

1. On page 26, section 2.8 there is mention of a Government provided master listing of approved medical/surgical supplies and on page 142 says that “The offeror is provided with the MSPV-Puerto Rico listing of Government approved medical/surgical supplies for Puerto Rico”. When will such list be provided?

Answer: Attachments 2A – Product Pricing Data and 2B – Products Pricing Data Attachment Top 40, are the approved medical/surgical supplies for Puerto Rico. Please note, these lists are subject to change. Attachment 2A is the overall list of products, whereas Attachment 2B, is the Top 40 most procured items for Puerto Rico.

1. There are different contract price categories in the MSPV formulary; MSPV Competed, Mandatory Source, LSJ (Limited Source basis), VISN Specific, Pricing Agreement or PV J&A (Prime Vendor sourcing), which categories will be managed by the SAC which will be managed by the MSPV?

Answer: The Government will be responsible for management of the overall Formulary. However, MSPV will be responsible for managing the supplier agreements and approved MSPV supplied items.

1. Page 33, section 6.8 it is stated that the Facilities will provide the MSPV with a Facility Service Level Election form. Please define what is that form and what does it contain.

Answer: Facility Service Level Election Form will be added to the solicitation.

1. On page 33 and 58, sections 6.9 and 44.10 respectively, it is stated that “An on-site representative shall be available for one day per week for eight hours to follow up with back orders, per facility, take new orders work in conjunction with the item manager to increase the usage of the formulary and have the capability to work with invoicing issues.” However, on page 58, section 44.12 it is stated that “MSPV shall provide on-site customer service to each facility five days a week for eight hours to resolve contract service issues, including resolving open invoices.” (NEED TO CLARIFY 1 day per week for 8 hours or 5 days @ 8 hours or 5 days @ per day)

Answer: 5 Days a Week 8 hours day.

5a. Will the Will the VASAC select frequency according to the selected option in the CLIN pricing sheet? Answer: YES! Need to check if CLIN Pricing Will the final version of the RFP be modified with the desired time option?

Answer: Yes.

1. Page 65, section 52.0 describes an On-Site Strategic Sourcing Liaison that will work 5 days a week on VA facilities performing functions described on section 52.5. This resource is described separately form the on-site customer service rep, however, on the CLIN Pricing Structure Sheet there is no section to quote the Strategic Sourcing Liaison (SSL). How will this SSL be quoted?

Answer: Verbiage will be changed throughout the contract as “on-site customer service rep.

1. On pages 50 – 51, section 32 there is a list of Primary fees; Bulk fee, LUM fee, Drop fee and Strategic Sourcing Liaison fee. Please confirm that these are distinctions in invoice types the VA will receive from the Prime Vendor.

Answer: These are the types of fees that will be applied per line item, depending on which category they fall into. Invoice can have a mixture of the different fee types.

1. Regarding invoices; On page 29, section 5.0 it is mentioned that “Invoices submitted for payments shall separate the MSPV FSS medical/surgical supplies from all other Federal Government priced invoiced medical/surgical supplies.” However, on page 46, section 24.2 it is stated “The MSPV shall provide one consolidated delivery and one invoice per task/delivery order by the required delivery date for all core products ordered by facilities.” Also on page 48, section 31.0, it is stated that; “The MSPV shall perform billings for all medical/surgical supplies (supplies delivered and services performed) and shall provide facilities with one consolidated invoice per order”. Separating invoices according to delivery method, fee type and contract price type (FSS) not only causes multiplicity of invoices and increased transactions for both parties, it contradicts the Objective of the MSPV selection according to page 27, section 3 of the pre-solicitation where it states; “This shall provide ease of ordering, reduce the number of purchase orders, reduce the number of shipments and number of invoices processed by medical centers, reduce facility inventory levels, and provide customer flexibility through the establishment of a MSPV contract for all participating facilities”. Please confirm VA’s preferred invoice methodology since we see different directions from the previous citations on questions 7 and 8.

Answer: Government is asking for 1 consolidated invoice, however, in that consolidated invoice, as per section 5.0, whereby the resultant MSPV is also a supplier of medical/surgical supplies under existing Federal Contracts (as provided in paragraph 5.0), product prices are Freight on Board (FOB) destination and the product price includes the delivery fee. MSPV shall not charge any fee on their or any of their affiliates’ Federal Contract medical/surgical supplies ordered by or provided to participating facilities under the MSPV contract(s). Invoices submitted for payments shall separate the MSPV FSS medical/surgical supplies from all other Federal Government priced invoiced medical/surgical supplies.

1. On page 137 it is mentioned a pre-proposal conference call, when will this conference call take place?

Answer: Pre-Proposal Conference will be removed from solicitation.

1. Attachment 2B does not have any references to OEM Name or Part Number; will the information be provided to understand the clinically approved products from the local VA facilities?

Answer: Received the revised 2B Attachment OEM Name, Part No & MedPDB Numbers.

1. On document “018”, pg. 53 section 38, the products used for this award are discussed. It appears that the SAC is moving away from the “formulary” used in the “NG” contract and going back to using FSS & local contracts. Is that a true statement? If not, can you give a more detailed explanation of the contract(s) that will be authorized for the awarded vendor to use for supplying Med-Surg products to the PR VA?

Answer: No this is not a true statement. The formulary is comprised of FSS, VA National Standardization, Ability One Nonprofit Organizations Contracts, VISN and local Federal Government contracts, as well as, VA approved MSPV supplied items.

1. Section 2.12 states The MSPV shall be required to provide Trade Agreement Act (TAA) compliant medical/surgical supplies. Only FDA approved medical/surgical supplies that are compliant with Global Standard 1 (GS1), Health Industry Business Communications Council (HIBCC), and/or International Society for Blood Transfusion (ISBT) 128 standards are included in this requirement.

Question: how can the awarded MSPV be responsible for TAA compliance if the vendor isn’t making the product decisions used on the formulary?

Answer: For all contracted medical/surgical, cleaning, rescue and safety supplies used by a medical facility and identified on a master listing approved by VA, the awarded MSPV will not be responsible for ensuring initial TAA compliance. The awarded MSPV shall be responsible for ensuring TAA compliance for all additional items proposed, sources of supply and product prices, for VA approval and inclusion on the master listing, as requested by VA via a Program Office Item List.

1. Will the awarded vendor be required to submit a Small Business Sub-contracting Plan specific to this contract with their proposal or after award?

Answer: If an award is to be made to a Large Business, the Subcontracting Plan shall be requested and must be approved prior to award.

14. Does MSPV currently receive LUM distribution or are all deliveries Bulk?

Answer: Yes, MSPV PR does currently receive LUM distributions.
