36C10G19Q0036 Exam Tables

1. Will there be subsequent NX exam table listings on MSPV 2.0? Perhaps a dual or multi source, not just a single source?

Answer: Exam Tables will not be on MSPV. NX is awarding a single Requirements contract in accordance with FAR 16.503.

2. I was told by SAC members at the MSPV Industry Day that the SAC analyses utilization rates at each VA facility in order to determine quantity & quality i.e. best in class products... Did you adhere to this/or examine utilization rates prior to making this decision and posting this solicitation?

Answer: The methodology used to determine the equipment that will be placed on a national contract is based on anticipated replacement dates of currently fielded equipment.

3. The specification herein is for a "small business manufacturer" Is the SAC required to shop small business manufacturers first, prior to large business firms?

Answer: Yes, per FAR 19.502-2 (b) the contracting officer shall set aside any acquisition over $150,000 for small business participation when there is a reasonable expectation that—

(1) Offers will be obtained from at least two responsible small business concerns offering the products of different small business concerns (but see paragraph (c) of this section); and

(2) Award will be made at fair market prices. Total small business set-asides shall not be made unless such a reasonable expectation exists (see 19.502-3 as to partial set-asides). Although past acquisition history of an item or similar items is always important, it is not the only factor to be considered in determining whether a reasonable expectation exists. In making R&D small business set-asides, there must also be a reasonable expectation of obtaining from small businesses the best scientific and technological sources consistent with the demands of the proposed acquisition for the best mix of cost, performances, and schedules.

4. Was the non-manufacturer waiver invoked for this category of supply? If so, will this change if the non-mfg. waiver is applied, thus opening the door to SD/VOSB VARs

Answer: As the Government Accountability Officer ruled in Manus Medical, B-412331 (January 21, 2016), the VA is not obligated to seek a Non-Manufacturer Waiver and the determination to seek the waiver is discretionary. As such, the Contracting Officer has made the determination not to request and Individual Non-Manufacturer Rule Waiver for this requirement.

5. Will the individual facilities be required to purchase their NX exam tables from the MSPV, or can they shop around using alternate vehicles, ECAT, FSS, open market?

Answer: This requirement is not on MSPV, NX is awarding a Requirements contract in accordance with FAR 16.503 which make it a required source. This contract once awarded, is mandatory for those facilities who are procuring the brand on contract.

6. Since we aren't a "small business" presumably it won't make a difference if we qualify as an "equal to" in this solicitation. We estimate that 80% of VA sites order Midmark exam tables today, how do we continue to sell our exam tables to these sites in the future?

Answer: To qualify as a small business a vendor must comply with FAR clause 52.219-6 Notice of Total Small Business Set-Aside. This contract once awarded, is mandatory for those facilities who are procuring the brand on contract. Facilities that are in the market for a different brand (i.e. Midmark) will continue to use local contracting to procure other brands.

7. Is there a list of Ship To addresses?

Answer: As a Indefinite Delivery Requirements contract, the exact quantity and delivery location is not known at this time. Deliveries will be at a VHA facility

8. Is this an all or nothing solicitation?

Answer: Yes, only one award will be made.

9. Given the type of patients VA serves and their mobility issues, we do not quite understand why the VA would consider procuring a table that is not ADA compliant. Therefore, we respectfully ask the salient characteristics to only accept tables that are ADA compliant (table lowers between 17"-19" above the floor)?

Answer: Salient characteristics and product list are being reviewed and an amendment may be issued in the future to included ADA recommendation standards.

10. Along with the same mobility concerns, would the VA also be willing to change the requirements to 650 lbs vs. 400 lbs? We believe it is in the government's best interest to include this in the RFQ's salient characteristics and respectfully ask the change be made.

Answer: The minimum weight limit is staying at 400lbs.

11. In 2018, the VA updated its Barrier Free Design Standard document. It can be found attached. The concerns we raised above would only compliment the VA's intentional move to make it easier for their patients with mobility issues to access their facilities as well as the equipment they procure. This acquisition is much too big in size and scale to ignore these critical initiatives mobility and accessibility issues.

Answer: One of the objectives of this requirement is to replace the existing equipment currently in facilities that adhere to current safe patient handling and patient mobility initiatives. The SC's are functional and physical characteristics to promote competition. SC's addressing ADA recommendation have been identified.

12. The brand name exam table boasts a Three-Year Limited warranty. We believe this is in the best interest of the government as it lowers their total cost of ownership and respectfully ask the VA to change the salient characteristics to reflect this.

Answer: Standard commercial warranty or better is expected from vendors.

13. In light of the "Rule of 2" and the market research we have completed, we ask that this opportunity be set-aside for a Service Disabled Veteran Owned Small Business. After searching GSAAdvantage, we found multiple SDVOSB vendors that can provide equal exam tables. They are as follows:

a. Altamira, LTD.

b. TSPS Industries

c. ERA Health dba Veterans Health Medical Supply

d. 1st American Medical Answer: All SDVOSB/VOSB vendors identified did not manufacture the end items making them ineligible for a valid set aside.

14. Finally, if the VA is unwilling to take the risk of setting the opportunity aside for SDVOSB, at the very least, we encourage the VA to include the "cascading language" clause into this RFQ.

Answer: The solicitation is being evaluated as a comparative analysis in accordance with FAR 13.106-2 Evaluation of Quotations or Offerors.
