QUESTIONS #RFP SECTION/PARAGRAPH NO.QUESTIONSGOVERNMENT RESPONSE
1We see that you are accepting proposals for “Equals” in each award group. If we propose “equals,” do we still have to propose pricing for every item within an award group in order to be eligible for an award of that group?Yes, see section E.13 Proposal Submission Instructions Volume II Price for details.
2Request an extension to the proposal due date from Tuesday September 4, 2018 to, at least, Friday, September 7, 2018. To properly respond takes a tremendous amount of work. An extension would recognize the 3-day Labor Day weekend and provide 6 full normal business days to respond to your RFP.An extension will not be granted.
33. Shouldn’t there be an evaluation factor that provides a preference for SDVOSBs over VOSBs? We understand that VetsFirst requires a SDVOSBs to get full evaluation credit and VOSBs ½ of the evaluation credit. Since the original RFP, there have been two major changes that fully support a revised evaluation approach.

a. First, on 01/11/2018 the VA proposed in the Federal Register that the veterans’ preferences in Subpart 819.70 fully apply to Part 812 Acquisition of Commercial Items, such as this PAP IDIQ. On 4/25/2018, the VA published in the Federal Register proposed VAAR changes that fully apply 38 USC 8127-8128 (Vets First) to the VAAR. All of the Federal Register postings appear to be a part of a consistent VA effort to bring the VAAR into compliance with 38 USC 8127-8128.

b. The recent Nation Defense Authorization Act for 2019 directs the agencies, including the VA, to use LPTA only if it would realize no or minimal additional value from an offeror that exceeds the minimum requirements. In this case, the VA is required by law to provide SDVOSBs a preference/priority in awards. Since this SDVOSB preference is a statutory requirement, it seems to add additional value and should be evaluated.

4. Request the evaluation be changed to the following:

The following factors shall be used to evaluate offers:

1. Technical Capability Factor. Technical Capability will be evaluated to determine if the items proposed meet requirements.

2. Socio-economic Factor. Socioeconomic status will be evaluated in order of precedence below

a. SDVOSB (full credit)

b. VOSB (50% credit)

3. Price Factor.

When factors 1 and 2 are combined, they are slightly more important than price alone.

The VA Contracting Order of Priority and U.S. Supreme Court Kingdomware decision on the implementation of Public Law 109-461 (38 U.S.C. 8127 and 8128), also known as the “Rule of Two”, was considered in determining the acquisition strategy applicable to this procurement. The evaluation factors will remain the same.
