In the 2020 PTEMS procurement, the Government provided a list of programs with a Potential OCI due to other awarded activities, specifically Demand Management Division (DMD), Technology Incubation Services (TIS) and Digital Transformation Center (DTC). Can the Government confirm that the same programs continue to have a potential OCI for PTEMS 2.0? Can the Government provide an updated list of Potential OCI for PTEMS 2.0 to include both current and anticipated programs/awards?
The DTC ecosystem consists of the following services contracts:
Technology Incubation Services (TIS): Technology Incubation Support and Management Support contract
Digital Transformation Center (DTC): Platform-as-a-Service (PaaS)/Software-as-a-Service (SaaS) platform management and governance contract
Product and Technology Ecosystem Management Services (PTEMS): Systemystem Integration (SI) contract
Veteran Enterprise Module & System Integration Services (VEMSIS): SI contract
The DTC contract is the PaaS/SaaS platform management and governance contract for the DTC ecosystem. Therefore, the DTC Prime Contractor and its subcontractors are conflicted out of being a Prime or subcontractor of any DTC SI contracts (PTEMS/VEMSIS).
The TIS contract is the Technology Incubation Support and Management Support contract for the DTC ecosystem. Therefore, the TIS Prime and its subcontractors that provide support under PWS Section 5.2, Traditional PM Organizational Lifecycle Tasks and 5.3 Traditional Cross Functional Support are conflicted out being a Prime or subcontractor of any of the other DTC contracts (PTEMS/VEMSIS/DTC). This is due to the support under PWS 5.2 and 5.3 consisting of budget, acquisition, finance, and strategy.
The SI Prime Contractors and their subcontractors are conflicted out of all other work in the DTC ecosystem as described above, however Primes and subcontractors can be subcontractors on the other SI contracts.
Note: All potential OCIs are reviewed on a case-by-case basis and are determined by the Contracting Officer.

In the 2019 DTC procurement, the Government indicated that “restrictions on future activities of the awardee may be required in accordance with FAR 9.5 and the clause entitled, Organizational Conflict of Interest, found in Section H of the T4NG basic contract.” Should the Government decide to procure PTEMS 2.0 on an alternative contract vehicle other then T4NG, will similar restrictions extend across contract vehicles, or will those stated restrictions be eliminated?
Regardless of contract vehicle, FAR 9.5 and VA policy regarding OCI applies. All terms and conditions will be set forth in the solicitation documentation.

In the 2020 PTEMS procurement, the Government provided a list of companies with a Potential OCI due to other awarded activities. That list included both Prime and Sub Awardees; however, not all of the Sub Awardees were listed as having a Potential OCI. Can the Government provide clarity as to what performance work statements create a Potential OCI between PTEMS and other contract awards?
See Answer to Question #2
Upon solicitation release, Offerors should do their due diligence as it relates to OCIs.
