The final 5 locations have yet to be determined. At this time there is no plans to move beyond 60 total locations.

On page 35, it states “If the proposed solution is considered a SaaS solution. The Contractor shall be FedRAMP Authorized and VA ATO Approved by November 2024. FedRAMP Moderate is required for this effort.” However, the Base Period table states the contractor has 12 months to complete FedRamp authorization and VA approval. In the Base Period Optional Tasks, pricing for Pilot and Pre-pilot hardware is requested, but the Optional Tasks section doesn’t request/ask for hardware unit pricing. Should that be added or does this reflect an assumption that the hardware costs will be the same after the Pilot as for the Pilot?
Hardware is required for all deployable locations as they are activated. The proposed costs should include this as a requirement.

For cellular network connectivity which is mentioned, should we provide a quote for cellular hardware and cellular contract fees?
If yes, should this be included in the other hardware costs and ongoing fees, or should we add lines? In other words, do we need to provide cellular networking hardware with the solution
There is no requirement for cellular network connectivity or hardware. The solution will be on the VA Network.
1/10/2024 Is the expectation that one tablet and printer be utilized per location or does the number of tablets and printers vary per One tablet and One Printer per location price per month? Or does the price table expect a quote covering all installed locations per month?

VCS says there are a maximum of 60 total locations. However, CLIN 13 (Optional Task 3) has a quantity of 600 locations. If 60 is the maximum, what is meant by CLIN 13? (or, was that a typo?)
The price schedule has been updated to remove CLIN 0013.

B7. LIQUIDATED DAMAGES FOR DATA BREACH- Is the Government willing to negotiate the terms of this clause? The FAR clause that states that tailoring is OK is here: 12.302 Tailoring of provisions and clauses for the acquisition of commercial products and commercial services. | Acquisition.GOV
Any Offeror terms, conditions, assumptions or exceptions shall be detailed in each Offeror's proposal. Note, in accordance with the solicitation, any Offeror imposed terms and conditions and/or assumptions which deviate from the Government's material terms and conditions established by the solicitation may render the Offeror's proposal Unacceptable and thus ineligible for award.

With regard to B.1 “Governing Law” and the sentence: “The Contractor shall deliver to the Government all data first produced under this Order with unlimited rights as defined by FAR 52.227-14”, it is important to note, however, that as broad as unlimited rights are, it does not mean that the government has “exclusive” rights over the technical data/computer software. Even in circumstances where the government obtains unlimited rights, the contractor (in this instance the subcontractor) still retains ownership of the technical data/computer software and may still use it, license it to others, and otherwise profit from it use. (see FAR 52.227-14(d)). Is this acceptable to VCS?
Any Offeror terms, conditions, assumptions or exceptions shall be detailed in each Offeror's proposal. Note, in accordance with the solicitation, any Offeror imposed terms and conditions and/or assumptions which deviate from the Government's material terms and conditions established by the solicitation may render the Offeror's proposal Unacceptable and thus ineligible for award.
This supplier would like to request tailoring of the following sections of FAR 52.212-4 “Commercial Items – please advise if this is acceptable.
a. (a) Inspection and Acceptance
b. (h) Patent Indemnity
c. (o) Warranty
d. (p) Limitation of Liability
Any Offeror terms, conditions, assumptions or exceptions shall be detailed in each Offeror's proposal. Can the VA clarify what is meant by “total cost of the solution”?
Does the total solution include monthly recurring costs associated with Contractor Project Management and Operations and Maintenance CLINS, or does it only include the LOT-based CLINS? Please clarify, as this information affects the way we will calculate our price quote, and has a significant impact on price.
Govt Response: Total Cost of the Solution refers to CLIN 0005 as stated in the CLIN descriptions.
This response is still unclear. Please confirm that the total of CLIN 0005 only includes the following Subclins: 5AA, 5AB, 5AC, 5AD, 5AE, 5AF, 5AG and 5AH and does not include CLIN 0006, Subclin 6AA and CLIN 0007 and Subclins 7AA which are also part of PWS 5.2
The costs associated with priced CLINs should not be included in the cost of the solution.

FACTOR “Offerors shall complete Section B.4 Price Schedule in addition to the submitted quote.” What should be included in the “submitted quote” document that the Government refers to? Is there a specific template that the Government can provide for the “quote” in addition to the completed Section B.4 price schedule?
Government Response: There is no template. Offerors can submit a vendor quote, if needed. Please explain the Government response of “if needed”.
Is there a requirement for any price documentation other than the Section B.4 price schedule?
There is no requirement for price documentation other than what is required by the solicitation.

Section B table for Base Period Optional Tasks the language states “In accordance with FAR 52.217-7, “Option for Increased Quantity-Separately Priced Line Item,” this Optional Task may be exercised one time during the base period of performance once solution is FedRAMP Authorized and VA Authorized. If exercised, the Period of Performance shall be up to 12 months. Work shall not commence until, and unless, a formal modification is issued by the Contracting Officer.”
Question: If FedRAMP is authorized and VA Authorized as an example in 4 months is it correct that the Base Period Optional Tasks would then be for only 8 months? If so, this creates an issue with the Section B Tables that are for 12 months. Please explain.
The solution may be delivered in a shorter timeframe. All CLINs shall be priced in accordance with the solicitation.
