| Proposal Submission Instructions |
(ii) Volume II- Past Performance The government requests that “Offerors shall submit up to five (5) contracts (including Federal, State, and local government and commercial) (prime contracts, and/or task/delivery orders) in performance at any point during the three (3) years immediately prior to the proposal submission date, which are relevant to the efforts required by this solicitation.”
Please clarify whether, in this context, “Offerors” refers to the proposed prime contractor only, or whether the past performance volume may include performance from one or more proposed major subcontractor(s).
In the Evaluation Approach “draft” posted, under (2) PAST PERFORMANCE EVALUATION APPROACH, it states, the Past Performance evaluation will assess the relative risks associated with an Offeror's likelihood of success in fulfilling the solicitation's requirements as indicated by that Offeror's record of past performance. In this context, “Offeror” refers to the proposed prime contractor, only.
The Past Performance evaluation or its proposal submission instructions does not include major subcontractors.

| Can the Government confirm that the Prime and a similarly situated small business subcontractor can count towards the 50% performance rule associated with the Small Business Subcontracting Limitations? |
Yes. In accordance with 13 CFR 125.6, in order to be awarded a full or partial small business set-aside contract with a value greater than the simplified acquisition threshold (as defined in the FAR at 48 CFR 2.101), a small business concern must agree that:
(1) In the case of a contract for services (except construction), it will not pay more than 50% of the amount paid by the government to it to firms that are not similarly situated. Any work that a similarly situated subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded.
File details come from the government source that posted it.
