SECTION 2 – RFP PROJECT INFORMATION
1. Overview and Goals.
MMCAP Infuse (MMCAP Infuse) is a governmental cooperative serving thousands of state and local government facilities across the United States. MMCAP Infuse is operated by the State of Minnesota (State) Department of Administration’s Office of State Procurement (OSP) and is governed by Minnesota laws and procurement policies.
MMCAP Infuse Members are state agencies and political subdivisions throughout the United States. For more information on MMCAP Infuse and its membership, visit www.infuse-mn.gov (Members or Membership).
Membership is available to government-operated facilities, and the extent to which a Member participates in the program is voluntary.
MMCAP Infuse is seeking proposals from qualified vendors that will provide both Department of Transportation (DOT) and non-DOT regulated drug and alcohol testing, products and services. The program serves MMCAP Infuse Members requiring drug and alcohol testing of existing and prospective employees, as well as potential testing associated with harm reduction efforts nationally.
Proposals may include any combination of testing, products and services related to drug and alcohol testing and/or harm reduction. MMCAP Infuse will evaluate the responder’s capabilities in the technical proposal content. Responders must submit a proposal that services at minimum 10 states. Responders may subcontract to provide a more comprehensive offering of products and services, so long as those arrangements comply with the requirements of this RFP and resulting agreements.
This RFP cannot be used as a procurement vehicle by which the Responder and Member enter into their own stand-alone agreement. Please note the following product categories are already covered by MMCAP Infuse contracts and cannot be included in the drug and alcohol testing program: medical supplies, diabetic supplies, condoms, incontinence products, nutritional supplements, vaccines, and pharmaceutical products, unless specifically requested by MMCAP Infuse for this RFP.
2. Agreement and Duration
We anticipate that MMCAP Infuse will enter into agreements for an initial two (2) year term with an option to extend in increments determined by MMCAP Infuse, in compliance with Minnesota law. MMCAP Infuse will provide a draft of an Agreement to the awarded Responders. MMCAP Infuse will also request a final listing of testing, products, and services with “best and final” offers.
http://www.infuse-mn.gov/
3. Scope of Work and Services (SOW)
The Scope of Work (SOW) for this RFP will be developed using the responses to the Technical Proposal Questionnaire. The following categories are examples of the expected tasks that may be generated from the responses to this RFP:
Drug and Alcohol Testing Services
MMCAP Infuse Members may conduct drug and alcohol testing both on employees and non-employees based on agency requirements, as well as state and local law. Positions requiring testing may include:
• Security sensitive positions in law enforcement (corrections, courts, probations and parole programs, police, deputy and state patrol departments);
• Safety-sensitive positions (public works, air and maritime servants, among others);
• Any other positions or programs requiring testing, including but not limited to employee testing, public assistance programs (Children and Family Services among others), Veterans Affairs (VA) homes, and Racing Commissions among others, as established by the State of Minnesota’s Drug and Alcohol Testing Plan, and subsequently, any other requirements by agencies participating from the resulting cooperative Contract(s).
If providing testing services, Vendors must operate as the service agent or Third-Party Administrator (TPA) to provide the following, in accordance with Member and/or Federal requirements:

• Reasonable suspicion testing;
• Return-to-duty testing;
• Follow-up testing;
• Confirmation testing; and

Federally Regulated DOT Testing
In response to the Omnibus Transportation Employee Testing Act of 1991 (OTETA), the agencies that comprise the US DOT have established regulated testing to be conducted on employees and applicants within non-federal government agencies and authorized non-profit entities who perform safety-sensitive functions. These employees and applicants are subject to testing requirements, as specified by the DOT agencies as follows:

CFR Part 16
All testing based on the requirements of the federal agencies listed above, will be in accordance with DOT Rule 49 CFR Part 40, as amended.
Drug and Alcohol Testing Product Fulfillment

Relevant items may include:
• CLIA1 waived drug and alcohol testing devices/kits
• Alcohol detection devices
• Fentanyl, xylazine, and other test strips for harm reduction

In addition to the tasks or activities set forth above, the Responders are encouraged to propose additional testing, products and services that may improve the results of this RFP.
