SECTION C - Description/Specifications
DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
C.1 Title of Project
Nuclear Regulatory Commission Issuances and Opinions Indexing and Editing Support Services
C.2 Background
U.S. Nuclear Regulatory Commission’s Issuances and Indexes Publications Program
This is a nonpersonal services contract to acquire editing, proofreading, indexing, formatting, layout, and archiving support services for the U.S. Nuclear Regulatory Commission (NRC) Issuances and Indexes Publications program.
In order to comply with Freedom of Information Act (FOIA) requirements, the NRC must publish all issuances of the Commission, the Atomic Safety and Licensing Boards, the Administrative Law Judges, Directors' Decisions, and Decisions on Petitions for Rulemaking. Additionally, the NRC must produce and publish indexes to these issuances.
The contractor shall provide all personnel, equipment, supplies, facilities, tools, materials, supervision, and other items and non-personal services necessary to perform editing, proofreading, indexing, formatting, layout, typesetting, and archiving services for the NRC Issuances and Indexes Publications program as defined in this SOW, except for those items specified as Government-furnished property and services. The contractor shall perform to the standards specified in this contract.
The FOIA (5 U.S.C. 552(a)(2)) requires the NRC to comply with the following:
"(2) Each agency, in accordance with published rules, shall make available for public inspection and copying-
(A) final opinions, including concurring and dissenting opinions, as well as orders, made in the adjudication of cases;
... Each agency shall also maintain and make available for public inspection and copying current indexes providing identifying information for the public as to any matter issued, adopted, or promulgated after July 4, 1967, and required by this paragraph to be made available or published. Each agency shall promptly publish, quarterly or more frequently, and distribute (by sale or otherwise) copies of each index and supplements thereto... A final order, opinion, statement of policy, interpretation, or staff manual or instruction that affects a member of the public may be relied on, used, or cited as precedent by an agency against a party other than an agency only if-
(i) it has been indexed and either made available or published as provided by this paragraph; or
(ii) the party has actual and timely notice of the terms thereof,"
The issuances to be edited, formatted, printed, typeset, indexed, and archived are those final orders, opinions, statements of policy, interpretations, staff manuals or instructions of the NRC’s Commission, the NRC’s Atomic Safety and Licensing Boards, Administrative Law Judges, Directors’ Decisions, and NRC Decisions on Petitions for Rulemaking.
C.3 Objective
The objective of this contract is to acquire editing, proofreading, indexing, formatting, layout, typesetting, and archiving support services for the NRC Issuances and Indexes Publications program. The contractor shall provide timely and complete preparation of camera-ready print-quality hardcopy or electronic versions of issuances produced by the Commission, the Atomic Safety and Licensing Boards, Administrative Law Judges, Directors’ Decisions, and Decisions on Petitions for Rulemaking intended for publication as the “NUCLEAR REGULATORY COMMISSION ISSUANCES—OPINIONS AND
DECISIONS OF THE NUCLEAR REGULATORY COMMISSION WITH SELECTED
ORDERS,” NUREG-0750, which includes the monthly issuances, quarterly and semiannual indexes, semiannual hardbound compilations of issuances, a comprehensive 5-year index, and archives. The contractor shall compile the monthly publications, the indexes, and the six-month hardbound and electronic editions from the issuances of the Commission, the Atomic Safety and Licensing Boards, the Administrative Law Judges, Directors' Decisions, and Decisions on Petitions for Rulemaking. This contract requires completion of five (5) years of monthly issuances, quarterly and semiannual indexes, 6-month compilations for separate print and electronic publication, archived indexes in editable format, and one 5-year index. These products shall consist of up to sixty (60) monthly editions of issuances and opinions total; up to ten (10) quarterly and up to ten (10) semiannual indexes; preparation of the tables of contents, corrected text, and modified semiannual indexes for each of the up to 10 six-month hardbound editions; preparation of up to an additional ten (10) PDF versions of the six-month hardbound editions including front matter (provided by the NRC) and indexes suitable for Web posting; a compilation of comprehensive indexes for 5 years of issuances (January 2016–December 2020); and archival versions of these products.
Digests and indexes to be produced for these issuances are intended to serve as guides to the issuances. Information elements common to the cases heard and ruled upon include:
1. Case name (owner(s) of facility)
2. Full text reference (volume and pagination)
3. Issuance number
4. Issues raised by appellants
5. Legal citations (cases, regulations, statutes, and others)
6. Name of facility, docket number
7. Subject matter of issues and/or rulings
8. Type of hearing (for construction permit, operating license, etc.).
9. Type of issuance (memorandum, order, decision, etc.)
In each index these information elements are displayed in a separate index formatted independently. The five indexes shall be arranged in the following order:
1. Case Name Index
2. Digests and Headers
3. Legal Citations Indexes (cases, regulations, statutes, and others)
4. Subject Index
5. Facility Index
C.4 Scope of Work/Tasks
The contractor shall provide all resources necessary to accomplish the tasks and deliverables described in this Statement of Work (SOW).
As directed by the Contracting Officer’s Representative (COR) in accordance with clause G.4 entitled “Work Order,” the contractor shall prepare and deliver high quality edited, formatted, and proofread page proofs for each of the deliverables and, following the COR’s review, final corrected print-quality camera-ready copy as specified below, each in hard copy or electronic format as required by the COR for all publishable deliverables, all of which are subject to the COR's review and written approval. The COR will specify in writing the format of the deliverable prior to the delivery of the Work Order for each deliverable.
When directed in writing by the COR, the requirements for the work to be performed are as follows:
1. The contractor shall accept, via mail or e-mail, manuscripts (hardcopy or electronic at the NRC’s discretion) and transmitted keystrokes of these manuscripts, including headnotes and issuances. These manuscripts are created on word processing packages such as Microsoft Word, Corel WordPerfect, or an equivalent. The manuscripts may include graphic elements such as maps, or photographs supplied separately. The COR reserves the right to stipulate and change the required software versions. The contractor shall produce manuscripts from scanned or hard copy when no electronic version is available. The COR shall provide manuscripts in hard copy or electronic format at their discretion to the contractor on a monthly basis or as available. The contractor should expect to receive an estimated 1,600 hardcopy manuscript pages per year, which would result in a total of approximately 1,200 typeset camera-ready print-quality pages for issuances (excluding indexes). These quantities and the deliverable quantities are merely estimates based on historical precedent. The COR will order services listed in the SOW in writing via a Work Order. In the Work Order, the COR will relay the format of the deliverable. The contractor shall submit an email confirmation of receipt of Work Orders to the COR by close of business the following work day. The Work Order can task the Contractor to perform one or more requirements listed in the Statement of Work.
The Contractor shall not accept any Work Order received from the COR that contains tasks/duties not listed in the Statement of Work and in such an event shall notify the Contractor Officer.
2. The contractor shall copy edit, proofread, format, and typeset up to 60 monthly compilations of the full text of the NRC Issuances issued during the month beginning with those issued January 2020 and ending with those issued December 2024 (Volumes 91-100 of the NRCIs). This includes copy editing and proofreading transmitted text against the manuscript, researching and completing incomplete or abbreviated citations where necessary, and inserting cite page numbers and cross-reference page numbers to conform to the final typeset and printed page numbers. Text shall consist of the opinion, headnotes if any, and associated text such as additional views by Commissioners or ASLBP authors as available. The format is detailed below. The contractor shall advise the COR of any edits proposed for these documents and only proceed with typesetting once the COR has approved in writing these proposed edits. The contractor shall then provide the COR with typeset page proofs for their review. Upon completion of COR review of page proofs, the contractor shall make such additional corrections as are required by the COR and shall provide the COR with a corrected print-quality, camera-ready copy in hardcopy or electronic format as specified by the COR for final review, approval and printing.
3. The contractor shall prepare all tables of contents required for the monthly issuances (some issues may contain more than one table of contents, i.e., some unusually large opinions may include a separate, internal table of contents) for the aforementioned monthly issuances.
4. The contractor shall make additional changes to the pages of the camera-ready print-quality copy of monthly issuances after delivery and printing and to the master database, as requested in writing by the COR, to prepare copy for use again in the six-month hardbound compilation. Additional changes may include revisions requested in writing by the COR, errors noted since original publication, or other.
5. The contractor shall prepare the quarterly and semi-annual editions of the Indexes to NRC Issuances, and shall compile, edit, summarize, proofread, format, and typeset these indexes for the following periods using the present format and subject headings, with additional headings as determined by the contractor or the COR. The contractor shall provide the COR with page proofs for review. Upon completion of COR review of the page proofs, the contractor shall make such corrections as are required and shall provide the COR with a corrected print-quality, camera-ready copy in hardcopy or electronic format as specified by the COR for final review, approval and printing.
January-March 2020, January-June 2020, July-September 2020, July- December 2020 January-March 2021, January-June 2021, July-September 2021, July- December 2021 January-March 2022, January-June 2022, July-September 2022, July- December 2022 January-March 2023, January-June 2023, July-September 2023, July- December 2023 January-March 2024, January-June 2024, July-September 2024, July- December 2024
6. For each 6-month volume of monthly NRCI publications and indexes, the contractor shall compile and edit and proofread comprehensive tables of contents for use in the 6-month hardbound compilation of the monthly issuances.
More than one set of tables of contents may be necessary, depending on the size of the six-monthly issuances printed during the period, as the six-month hardbound compilation may be sufficiently large to require printing in multiple books. The format is detailed below. The contractor shall deliver these tables of contents along with the revised, updated, and corrected text of the monthly issuances and a modified semi-annual index (less digests and with modified page numbering in the footers) for the 6-month period for each 6-month volume, including any corrections to either text or indexes noted since the monthly issuances or the indexes were prepared. The arrangement of the table of contents, text, and indexes for the 6-month hardbound compilation shall conform to that used in recent hardbound editions of the NRCIs.
7. The contractor shall prepare a PDF version of each camera-ready hardbound edition that shall be proofread and checked for accuracy including all content from the print edition of the 6-month edition and including front matter provided by the COR and removing crop marks. The contractor shall provide the PDF version to the COR after the contractor has completed all corrections for the six-month hardbound edition.
8. The contractor shall prepare an archive on CD or other storage media as determined by the COR using the ASCII or UNICODE character set with fixed length records and fixed blocking for each semi-annual index (without typesetting codes) and for the hardbound volume as an archival editable file in word processor format (e.g., RTF format). (Note: The NRC will not provide the storage media to the contractor; the contractor must provide it.)
9. The contractor shall prepare and deliver to the COR a compilation of the Indexes to the NRC Issuances, NUREG-0750, for a five-year period, January 2016– December 2020 (NUREG-0750, Vols. 83-92) in Year 5 of this contract. The contractor shall prepare this index in conformity to the content, formatting, and typesetting standards and requirements of the semi-annual indexes.
10. All final contractor deliverables intended for print (all issuances, indexes, and hardbounds) shall at least meet standards for camera-ready print quality.
“Camera-ready” or “print quality” shall mean, at a minimum, 300 dot-per-inch resolution, 24 bit color, uncompressed electronic files in PDF format or whatever format the COR specifies for which the text is fully searchable and does not include any scanned, raster-based content except that for which the COR has specifically granted an exemption in writing; or hardcopy on 24 lb. high quality, 98 brightness white glossy paper, as specified by the COR. These standards are subject to change without notice. The COR will specify the required standards and delivery format (electronic or hardcopy) for each deliverable in writing prior to the delivery of the Work Order for the deliverable.
The contractor shall create all PDF deliverables from an electronic source file (e.g., PC- TEX to postscript) and cannot be made from a scanned image or any raster-based reproduction such as a TIF. (Portions of the PDF such as individual graphics, photographs, or charts may be raster-based scans at the discretion of the COR.)
The contractor shall provide all personnel and equipment as may be required to perform all tasks at one or more locations of their discretion and shall not require access to NRC facilities. No regularly scheduled meetings are expected, although the contractor should be available for ad hoc meetings when requested by the COR. The contractor shall be accessible to the COR for routine work process related communications.
Each contract year, beginning April 1 of each year, the contractor shall produce two volumes of the NRCIs. Odd-numbered volumes shall be produced between April and September, and even-numbered volumes shall be produced between October and March. Each volume includes up to six monthly editions, up to two indexes, up to one hardbound, up to one electronic edition of the hardbound, and up to one archive of the semi-annual index. Each deliverable shall begin production no sooner than the month following the calendar month indicated by the deliverable and shall be completed and published three months after the calendar month(s) indicated by the deliverable (the first three monthly editions for the contract excepted). During each contract year, the contractor shall provide the COR with copyedited, proofread, formatted, typeset print-quality camera-ready files for the following products:

TASKS TO BE ACCOMPLISHED AND SPECIFICATIONS FOR EDITING,
FORMATTING, TYPESETTING, AND DELIVERING CAMERA-READY PRINT-
QUALITY COPY OF MONTHLY ISSUANCES.
Upon receiving the complete set of issuances and headnotes for a month from the COR, the contractor shall:
1. Deliver edited and marked up editable electronic versions (e.g., Word files) including all proposed changes clearly indicated as tracked changes for all original issuance file or files, including headnotes if any, prior to continuing with formatting and typesetting. The issuances (manuscripts) are the legal record of NRC cases reported and the contractor shall not change the text in any way except for correcting obvious typographical errors, errors of grammar, misspelled words, or correcting or completing citations to the U.S. Code and other legal citations. The contractor shall not substitute alternative spellings or paraphrase text. The contractor shall address possible omissions in transmission, inconsistencies in style or format and any other questions regarding the text.
The contractor shall provide all proposed changes, including changes involving formatting or typesetting, as tracked changes to the COR for review. The contractor shall not make any change of any kind to the final text without written approval from the COR. The COR will direct the contractor in writing prior to the delivery of the Work Order for those specific monthly deliverables. The COR may waive this preliminary review requirement in whole or in part at their discretion.
2. Following the review of the proposed edits, the contractor shall prepare copyedited, formatted, proofread, print-quality, camera-ready copy of issuances and headnotes, including only those changes approved during the preliminary review described above, in hard-copy or electronic as specified by the COR.
3. Use the format current to the issuances and indexes published in volume 88 (or later) of the NRC Issuances and Indexes (NUREG-0750) as a general guide to the required standard for formatting, appearance, and layout. The contractor shall consult the NUREG-0750 Volume 88 monthly paperbound issuances, the paperbound quarterly and semi-annual indexes, and the final hardbound for formatting, editing, and layout examples. More specific directions are included in this statement of work, but in the event of ambiguity, the contractor shall submit any questions to the COR in writing for further direction, and the COR will respond prior to the delivery of the final deliverable. The COR will provide a set of sample deliverables from volume 88 of NUREG-0750 (or a later volume, at the COR’s discretion) to the contractor upon receipt of their written request.
4. The contractor shall use the Bluebook - A Uniform System of Citation, Twentieth Edition, or later if available, published and compiled by the Harvard Law Review Association, the Columbia Law Review, the University of Pennsylvania Law Review, and the Yale Law Journal; hereafter referred to as Bluebook, as a reference legal style guide, and the GPO Style Manual for grammatical style not covered in the Bluebook. The COR may modify the requirements for use of that style at their discretion.
5. The contractor shall apply the following format and text conventions:
a. Headings and Paragraphs.
The leading above a boldface heading shall be greater than the leading below such a heading. Turnovers on headings shall be used so that headings are not set margin to margin. First line of heading is to be longer than succeeding lines. No paragraph or heading shall end with only a number on the last line. For example, the following is not permissible:
………………………………………………………………………………Unit 2.
b. Headnotes Headnotes shall be inserted before appearances or the first text heading, such as, "Initial Decision," "Memorandum and Order," etc. Headnotes will be transmitted to the contractor separately for coordination with the appropriate issuance. The COR will ensure that the issuance and headnotes contain the same identifying issuance number when issuances and headnotes are transmitted electronically.
c. Citations Full citations shall be listed in the main heading for each decision.
Citations appearing in the text shall be cited in full the first time and abbreviated thereafter. Refer to the appropriate section of the Bluebook.
The style for citations may be modified by the COR at their discretion.

e. Footnotes Footnotes appearing at the bottom of the page shall be indented and shall contain ½ space leading between footnote number and first letter of text.
Footnotes and quotations appearing within the text shall be indented left (when necessary), and right at all times and shall contain leading between paragraphs. The type shall be reduced to 8 point.
Where an asterisk is used in the manuscript copy, do not replace the asterisk with a number. Footnotes shall continue to be numbered consecutively throughout each issuance.
f. Tables and Figures Tables and figures shall be set according to written instructions furnished by the COR prior to delivery of the Work Order for the specific issuance.
The contractor shall provide scaling, coding, and interface information for reductions, when necessary.

July through December issuances, starting with page 1, and January through June issuances, starting with page 1.
h. Dissenting Opinions Type for dissenting opinions shall be the same size as type used for decisions.
i. Stylistic Variation The COR may modify the requirement to use these stylistic standards at any time in writing to the contractor.
6. Manuscript Review Follow the manuscript copy verbatim as long as it is uniformly consistent, complies with the Bluebook, and is in conformity with any variations specified by the COR.
7. Format for Composition Format issuances with the PC TEX Software package or equivalent (must be approved by the COR.) Encode format codes to justify margins, align indentations, paginate, enter headnotes where indicated, and enter page numbers in citation headings and cross-references in text. Use codes to set Times Roman type style for headings and text, and Helvetica type style for front matter, cite line, and index.
8. Table of Contents Prepare tables of contents (some issues may contain more than one). All applicant, licensee, and petitioner names shall be in alphabetical order by type of issuance on contents page.
The tables of contents are part of the Scope of Work for this requirement;
therefore, they are not considered author's alterations.
9. Final Review The contractor shall provide the COR with page proofs of edited, formatted, typeset, and proofread issuances and indexes. Upon completion of review by the COR, the COR will return to the contractor such corrections as are required, and the contractor shall provide to the COR final, print-quality, camera-ready copy in the format specified by the COR. All deliverables are subject to COR review and written approval.
PREPARATION OF CONSOLIDATED TABLES OF CONTENTS AND TEXT FOR
CAMERA-READY PRINT QUALITY NRC 6-MONTH HARDBOUND EDITIONS
1. Table of Contents The contractor shall:
Compile and prepare page proofs of tables of contents for up to ten (10) volumes (each compiled from up to six monthly issues, a single volume of the issuances) for the NRCI hardbound editions.
Any six-month compilation may be issued in two or more books depending on the number of pages. In this event, the COR will determine the page breaks.
Compilation of the tables of contents shall be alphabetized by utility name with subsets appearing in date order. The contractor shall follow the exact style (English Times) as contained in Volume 88 (or later) of the hardbound editions as provided by the COR. The contractor shall not use italics nor alter the style in any way.
2. Camera-Ready Print-Quality Copy Contents The contractor shall maintain and make changes in a text master, as necessary, after monthly issuances have been printed, as requested by COR, to prepare corrected monthly text for use again in the 6-month hardbound compilation. After corrections to page proofs, camera-quality pages shall be delivered to the COR in a format specified by the COR.
3. Final Review The contractor shall provide the COR with page proofs of edited, formatted, and proofread issuances. Upon completion of COR review, the COR will return to the contractor such corrections as are required, and the contractor shall return to the COR final, print-quality, camera-ready copy in the format specified by the NRC.
All deliverables are subject to COR review and written approval.
DEVELOPMENT AND PREPARATION OF INDEXES
The contractor shall:
1. Maintain the available list of subject terms used in indexing the issuances and add to them as new terms are developed in indexing new issuances. The COR may request a copy of the current list of subject terms a maximum of two times during any contract period.
2. Indexes to be developed include:
a. Case Name
b. Digests and Headers Issuances of Nuclear Regulatory Commission Issuances of Atomic Safety and Licensing Boards Issuances of Administrative Law Judges Decisions on Petitions for Rulemaking Directors’ Decisions
c. Legal Citations Cases Regulations Statutes Others
d. Subject
e. Facility
3. Case Name Index The case name index is an alphabetical arrangement of the facility owners or petitioners for the individual issuances. Each facility owner or petitioner listing is followed by an alphabetical breakdown by type(s) of hearing in order of issuance number. These separate entries are further defined by type of issuance, docket number, issuance number, and full text reference.
4. Digests and Headers Digests shall be separated according to the issuance source and be presented in issuance-number order. Each issuance is identified by a header containing the following information: issuance number, case name, facility name, docket number, type of hearing, date of issuance, and type of issuance. The header is compiled from the citation heading in the original opinion and precedes the digest. Digests are compiled from headnotes written for the opinion. A digest is a brief narrative of the legal issue followed by its resolution, and any references used in resolving the issue. If a given issuance covers more than one issue, separate digests are provided for each issue and are designated alphabetically.
5. Legal Citations Index The legal citations index for cases, statutes, and others is an alphabetical listing of citations found in the issuances. The legal citations index for regulations is a numeric listing of citations that follows The Code of Federal Regulations format.
The references to cases, regulations, statutes, and others are followed by phrases that show the application of the citation in the particular issuance.
These phrases are followed by the issuance number and the full text reference.
6. Subject Index Subject words and/or phrases, arranged alphabetically, indicate the issues and subjects covered in the issuances. The subject headings are followed by phrases that give specific information about the subject, as discussed in the issuance being indexed. These phrases are followed by the issuance number and the full text reference. Cross-references are provided between related subject headings. Synonyms are provided with "see" references to the subject headings and are used in an inverted form to group like information. For example: "Atomic Safety and Licensing Board, Jurisdiction" instead of "Jurisdiction of Atomic Safety and Licensing Board"; "Time, Extension" instead of "Extension of Time"; and "Effluents, Radioactive" and "Effluents, Thermal" instead of "Radioactive Effluents" and "Thermal Effluents."
7. Facility Index The facility index consists of an alphabetical arrangement of facility names from the issuances. The name is followed by docket number, type of hearing or petition, date, type of issuance, issuance number, and full-text reference.
8. Index Issues Camera-quality page proofs of the indexes (copyedited, formatted, typeset, proofread, and checked for accuracy) shall be supplied for the quarterly periods July through September and January through March, and for the semiannual periods July through December and January through June for each of the volumes 91 through 100 in a format (electronic or hardcopy) specified by the COR prior to the delivery of the Work Order for that specific deliverable. The first page of each index (a sink page) of the camera-quality copy shall be placed on a page with strips indicating the index name.
9. The contractor shall provide a modified version of the corrected semiannual index (less digests and with a modified footer) for publication with the 6-month hardbound edition of the issuances.
QUALITY CONTROL
1. Transmission Verification The contractor shall compare transmitted keystrokes with hard-copy manuscript to ensure text matches word for word and make any changes according to the hardcopy manuscript and insert format codes.
2. Proofreading The contractor shall proofread final copy of all deliverables for correctness of text and format. Where errors attributable to the contractor's performance appear in the page proofs, i.e., those which change or obscure the meaning of the opinion, or typographical errors in excess of 2 percent, the contractor shall immediately correct the error(s) and furnish corrected copy to the COR for same, regardless of the delivery time the original schedule specified.
Page Proofs The contractor shall provide the COR with a copy of the original Word or WordPerfect document clearly marking all proposed edits as tracked changes for COR review. The contractor shall then include any revisions to these proposed edits as specified by the COR. The contractor shall then provide the COR with copyedited, formatted, proofread, and typeset page proofs of each deliverable for review by the COR. Following the COR’s review of the page proofs, the contractor shall return to the COR a complete and corrected print-quality camera-ready file in hardcopy or electronic or both as requested by the COR.
Author's Alterations Author's alterations are any changes, additions, or deletions made by authors or by the COR after receiving page proofs if those changes, additions, or deletions were not errors on the part of the contractor or were not part of the original manuscript. Queries from the contractor that result in changes are not author's alterations.
Master File Corrections The contractor shall make and proofread all indicated corrections and changes before preparation of a final version. The copy used for indexing must be the same as the camera-quality copy and the electronic archives and PDF versions must be the same as the camera-ready print-quality copy.
PREPARATION AND DELIVERY OF 5-YEAR COMPILATION OF THE INDEXES TO
THE NRCIs (YEAR 5)
The contractor shall prepare and deliver a compilation of the Indexes to the Nuclear Regulatory Commission Issuances for a 5-year period, January 2016-December 2020.
