About this file

This document is a Q&A for a formal Request for Proposal (RFP) issued by the Nevada Department of Education (NDE) for a College and Career Readiness High School Assessment. The assessment is required for all 11th grade students in Nevada. The selected vendor must demonstrate alignment to Nevada Academic Content Standards, provide consistent data for year-over-year student progress, and reduce the total number of assessments given to high school students. The RFP requires the vendor to attend Technical Advisory Committee (TAC) meetings, provide secure data transfer capabilities, and have no state-wide testing irregularities in the past 5 years. The anticipated first administration is planned for Spring 2024.

The RFP does not specify an administrative fee to be imposed, and the State confirms that computer-based Refreshable Braille is an acceptable accommodation, though paper-based assessments are preferred. The State estimates a total of approximately 123 large print and Braille test materials will be required across grades 3-8 ELA, Math, and grades 3, 5, and high school Science. Student participation in the high school assessment is a graduation requirement under Nevada law.

Attachments for Signature p. 3, Vendor Information, 2.4 Current or Former Employee

Regarding the requirement of disclosure of current or prior state employees, Pearson presumes that this requirement only applies to key personnel involved in the overall management and administration of the tasks to be performed under the contract and not to temporary employees that may serve as scorers, item writers, trainers, and other positions. Is this correct?

Yes.

24 PROPOSALS@PEARS

ON.COM RFP p. 5, 7.4. Indemnification

Regarding Pearson?s obligation to indemnify the State, if there is some degree of fault shared between the State and Pearson, is it correct to assume that Pearson is only responsible to indemnify up to the extent to which Pearson is the cause of the damage or the breach and not the portion for which the State is at fault?

The duty to defend applies no matter the apportionment of responsibility, but it is correct that the duty of indemnification relates to the extent the vendor is responsible.
