About this file

This is a Trench Safety Affidavit form for a Pond Improvements project at Cadillac Drive and RJ Conlan in Florida, establishing compliance requirements with the Florida Trench Safety Act (Chapter 90-96, Laws of Florida) effective October 1, 1990. The document requires bidders to acknowledge that all costs associated with trench safety compliance are included in their bid price and to provide detailed identification of these costs by trench safety measure, including units of measure, quantities, unit costs, and extended costs. Bidders must complete the affidavit with an authorized signature and date; failure to complete the form will result in the bid being declared non-responsive. The document specifies that Occupational Safety and Health Administration excavation safety standards under 29 CFR 1926.650 Subpart P will be in effect throughout the project construction period.

The trench safety costs identified on this form are for informational purposes only and are not a separate pay item in the contract. Contractors will not receive additional compensation if actual quantities differ from those estimated or if different safety measures are employed than those listed in the bid. The form serves as a disclosure mechanism to ensure bidders have fully considered and incorporated all trench safety compliance costs into their total bid price, and completion of this affidavit is a mandatory requirement for bid responsiveness.
