About this file

This document is an ordinance (Ordinance 18-37) adopted by the Bergen County Board of Chosen Freeholders in New Jersey on December 5, 2018, establishing regulations for qualifying prospective bidders on public works contracts. The ordinance focuses on ensuring that contractors and subcontractors on public works projects with engineering estimates equal to or exceeding $250,000 demonstrate participation in approved apprenticeship programs or have verifiable on-the-job experience equivalent to apprenticeship training. Contractors must provide evidence of workers' training, including documentation of full-time employment (1,800 hours per calendar year) for the past six years in their trade, or proof of active participation in a registered apprenticeship program recognized by the U.S. Department of Labor or a state apprenticeship agency.

The ordinance aims to promote a highly skilled workforce by requiring contractors to demonstrate workers' comprehensive training and competence, with the goal of improving safety, quality, and cost-efficiency in public works projects. The requirement applies to craft workers in various trades, including building trades, mechanics, electricians, and similar skilled occupations. Bidders who fail to comply with these apprenticeship program requirements will not be considered responsible bidders under the ordinance. The document emphasizes that these requirements support state policy, ensure lower long-term maintenance costs, and provide a fair and level playing field for contractors. The ordinance will remain in effect for five years from its adoption date.
