About this file
This document is a Certification Pursuant to Section 103-g of the New York State General Municipal Law for Iranian Energy Sector Divestment. The certification requires bidders/proposers to affirm that they are not on a list of entities with investments in Iran's energy sector, as defined by Section 165-a of the New York State Finance Law. Bidders must certify under penalty of perjury that they do not have ongoing investment activities in Iran, with specific provisions for bids that cannot meet this requirement.
The document outlines two potential exceptions to the divestment requirement: 1) If investment activities in Iran occurred before April 12, 2012, have not been expanded since that date, and the bidder has a formal plan to cease Iranian investments, or 2) If the political subdivision determines that the goods or services are necessary to perform its functions and cannot be obtained without an exemption. In such cases, the political subdivision must provide a written determination that becomes a public document. The form requires bidders to provide signature, name, title, company name, and date to complete the certification process.
