About this file

This is a Small Business Reserve Program Affidavit document for the State of Maryland related to an Oracle Software Upgrade procurement opportunity. The affidavit establishes eligibility requirements and certification procedures for small businesses seeking to participate in a Small Business Reserve procurement, which restricts award to certified small business vendors only. Bidders must meet statutory requirements set forth in the State Finance and Procurement Article and be registered with the Department of General Services Small Business Reserve Program to be eligible for contract award.

A small business is defined as an independently owned and operated entity that is not a subsidiary or dominant in its field and meets specific employment and gross sales thresholds based on business type over the most recently completed three fiscal years. Thresholds vary by industry: wholesale operations (50 employees, $4,000,000 average gross sales), retail operations (25 employees, $3,000,000 average gross sales), manufacturing (100 employees, $2,000,000 average gross sales), service operations (100 employees, $10,000,000 average gross sales), construction (50 employees, $7,000,000 average gross sales), and architectural and engineering operations (100 employees, $4,500,000 average gross sales). Bidders must affirm under penalties of perjury that their firm qualifies as a small business and must notify the Procurement Officer within 30 days if circumstances change during the contract term. False information submission may result in bid rejection, contract termination, suspension and debarment, or criminal prosecution for procurement fraud or perjury.
