About this file

This is a Small Business Reserve (SBR) Affidavit for the State of Maryland, applicable to a contract opportunity for Kodak Scanners and Flatbed Accessories. The document establishes eligibility requirements and certification standards for small businesses seeking to participate in Maryland's Small Business Reserve procurement program. Bidders and offerors must affirm under penalty of perjury that their firm meets the statutory qualifications for small business certification as defined in the State Finance and Procurement Article, Section 14-501(c) of the Annotated Code of Maryland. Additionally, bidders must commit to notifying the Procurement Officer within 30 days if their firm ceases to meet small business qualifications during the contract term, with failure to do so resulting in potential contract termination for default.

The affidavit specifies distinct small business criteria based on operational category, including employment and gross sales thresholds: wholesale operations (up to 50 employees and average gross sales not exceeding $4,000,000 over three fiscal years); retail operations (up to 25 employees and average gross sales not exceeding $3,000,000); manufacturing operations (up to 100 employees and average gross sales not exceeding $2,000,000); service operations (up to 100 employees and average gross sales not exceeding $10,000,000); construction operations (up to 50 employees and average gross sales not exceeding $7,000,000); and architectural and engineering operations (up to 100 employees and average gross sales not exceeding $4,500,000). The firm must be independently owned and operated, not a subsidiary, and not dominant in its field. Penalties for providing false information include determination of non-responsibility, contract voidability, suspension and debarment, criminal prosecution for procurement fraud or perjury, and other remedies available under law. Newly formed businesses are evaluated based on projected gross sales and current employment levels.
