About this file
Attachment B to RFP No. DMS-24/25-312 is a Performance Guarantees document from the Florida Department of Management Services for Medicare Advantage Prescription Drug Plans. The document details 28 specific performance indicators across seven categories: Implementation, Account Management, Support Services, Customer Service, Data and Interface, Reporting and Deliverables, and Audits. Each performance indicator includes a standard/goal, measurement criteria, frequency of measurement, financial consequences, and measurement methodology. The performance guarantees cover critical operational aspects such as implementation timelines, website and phone line establishment, customer service metrics, claims processing, reporting deadlines, and audit responsiveness. Financial consequences range from $100 to $10,000 per occurrence, designed to ensure contractor compliance and high-quality service delivery.
The financial consequences are structured as monetary penalties for failing to meet specific performance standards, which serve as a contractual mechanism to motivate the contractor's adherence to the state's service requirements. For example, failing to establish a functional website by September 1, 2025, would result in a $1,000 per calendar day penalty, while not meeting customer service call accuracy standards could incur a $2,000 penalty for each percentage point below the 95% threshold. The performance guarantees cover the entire contract lifecycle, with measurements ranging from one-time implementation metrics to ongoing quarterly and annual assessments, providing a comprehensive framework for monitoring and maintaining service quality throughout the contract period.

ATTACHMENT B: PERFORMANCE GUARANTEES
It is critical to the success of the State’s benefits plans that Services be maintained in a timely manner and that the Contractor operates in a reliable manner. It would be impracticable and difficult to repair the actual damage sustained by the State in the event of certain delays or failures in scheduled Services and the provision of Services to Members served by this Contract. The Department and Contractor, therefore, agree that in the event of certain delays and failures, the amount of damage that will be sustained will be the amount set forth in this Attachment.
Further, Contractor agrees that in the event of any such failure of performance, Contractor shall pay such amount as financial consequences under section 287.058(1)(h), F.S., and not as a penalty. At its option, the Department may, for any amount due to the State as financial consequences, deduct such amount from any money payable to Contractor or may bill Contractor as a separate item.
