About this file
This document is an Addendum (#1) to a Request for Proposals (RFP #6000001843) issued by the Port Authority of New York and New Jersey for expert professional services in asset life cycle management, operations analysis, and data collection. The RFP seeks consulting firms to perform services on a task order basis over a four-year term, with proposals originally due on December 21, 2023. The document includes a detailed pre-proposal meeting attendance sheet and a comprehensive Q&A section addressing potential bidders' questions about proposal submission requirements, scope of work, and contract terms.
Key details include that firms may propose on subset service areas and are not required to cover all aspects of the scope. Only one proposal is required per firm, and proposers must demonstrate compliance with requirements by providing at least two relevant projects completed within the past ten years. The cost section should only include consultant labor rates and multipliers, with no markup allowed on subconsultant fees. Hourly rates should be listed for 2024, with subsequent year rate adjustments following the Standard Agreement. Proposers can adjust small business assignments based on specific task order requirements, and firms already working as consultants for the Authority can include those individuals in their proposals.

SUBJECT: REQUEST FOR PROPOSALS FOR THE - PERFORMANCE OF EXPERT
PROFESSIONAL ASSET LIFE CYCLE MANAGEMENT, OPERATIONS
ANALYSIS, AND DATA COLLECTION SERVICES AS REQUESTED ON
A “TASK ORDER BASIS” FOR A FOUR-YEAR TERM (RFP# 6000001843)
– ADDENDUM #1: AS PER THE QUESTIONS RECEIVED DURING THE
PRE-PROPOSAL MEETING HELD ON NOVEMBER 28, 2023
Dear Sir or Madam:
The following are questions from Request for Proposals (RFP) recipients. The questions and the corresponding Port Authority of New York and New Jersey (the Authority) answers are provided for your information and use, as appropriate.
Please Note: The date for receipt of proposals for the subject RFP has changed to 2:00 P.M.
on December 21, 2023.
The following are questions from Request for Proposals (RFP) recipients. The questions and the corresponding Port Authority of New York and New Jersey (the Authority) answers are provided for your information and use, as appropriate.
Question #1: Is the Authority able to provide the list of the subject RFP’s attendees and presentation from the November 28, 2023, pre-proposal meeting?
Answer #1: The Authority has attached the subject pre-proposal meeting’s attendee list and presentation for your reference.
Question #2: Are firms required to cover all aspects of the scope or can firms specialize in certain service areas and not others? For instance, could a firm be selected to be eligible to compete on task orders in 2 of the 3 service areas?
Answer #2: Firms may propose on any of the subset area(s) for this RFP.
Question #3: Will there be a separate procurement limited to SBE-certified firms?
Answer #3: A separate SBE set-aside solicitation for these services is not anticipated at this time.
Question #4: Can you respond as a Prime vendor and also joint partner with another Prime on their RFP proposal?
Answer #4: Joint venture partnerships shall not be considered per Section V, item 4.
Question #5: Are you looking for a proposal per category/scope area or just a single one?
Answer #5: Only one proposal is required to submit on both categories. Should firm or staff qualifications be utilized for multiple categories, an indication of such is needed.
Such indication can include, but not be limited to, an indicator after the staff name or project title, or an outline in the transmittal letter.
Question #6: We did not see a place for Organizational Chart – where would that be included?
Answer #6: An organizational chart is not required and is a business decision if a firm would like to submit an organization chart within their Proposal.
Question #7: For the Transmittal Letter, would you like more than just the form entries/boxes checked or a write-up/letter around that section?
Answer #7: It is a business decision of the firm whether or not to provide a letter in addition to the Proposer Requirements in Section 4.
Question #8: Can the Proposer Requirements be met by a subconsultant or do they need to be met by the Prime Proposer?
Answer #8: Proposer Requirements must be met by the Prime Proposer.
Question #9: Is the selection process an all or nothing?
Answer #9: No. Firms may be considered for award for select categories. Multiple firms may be awarded for this RFP for all categories.
Question #10: For Tab 1, Scope of Services, do we simply include Attachment A or do we need to write an approach to providing the services as well? Previous RFPs contained a
Management Approach section.
Answer #10: This is not required, as it is not a factor that is considered in the evaluation. A management approach would appear at a task order level, where the specific Scope of Services has been defined. While not required, you may include one with your
Proposal, but that is a business decision of a firm and is not considered in the evaluation of this solicitation.
Question #11: Does the Authority still require commercial auto insurance if your work doesn't require usage of an automobile directly on the task being performed?
Answer #11: If the awardee is not using a vehicle to perform a task as outlined in the SOW, they do not need to have commercial auto insurance. We will need a letter from the awardee if this is the case.
Question #12: Is it required to include a technical approach to address the Scope of Work? If so, in what section should that be addressed?
Answer #12: No.
Question #13: In what section should the completed Attachment D forms be added to the proposal?
Answer #13: Completed Attachment D forms shall be added with a numbered tab in the order as shown in the table in Section 5.
Question #14: If a consultant is a subconsultant to another Prime firm submitting a Proposal, can that subconsultant also submit a Proposal as a Prime without penalty to either firm/submittal?
Answer #14: Nothing precludes a firm from submitting as a prime and being included as a subconsultant in other proposals.
Question #15: Regarding the Standard Agreement, does the Authority require this be agreed to as-is, or are respondents able to submit comments/redlines?
Answer #15: The Port Authority is not currently accepting exceptions under this Call-In
Program. This is part of the Authority’s efforts to maintain a fair and equitable process for all awardees.
Question #16: On Attachment E (Firm Qualifications and Experience) could you clarify the parameters for relevant projects? It states to provide a minimum of 5 and no more than 7 - is this per category?
Answer #16: Proposers must demonstrate compliance with the Proposer Requirements as noted in Section IV of the RFP Letter. They shall provide a minimum of two projects, within the past ten years, for the category(ies) to which they are proposing.
Question #17: If a firm has an individual already working as a consultant for the Authority, can we still include them on this RFP?
Answer #17: Yes.
Question #18: Small business mechanics that will need to change across the task order scopes -is this acceptable
Answer #18: Using Attachment F, please describe the proposed Scope of Work to be performed by any subconsultants.
Question #19: The instructions on page 1 state that proposers should separate each section of the proposal by using a numbered tab as shown in the table below. Is this referring to the Instructions and Additional Information Table format?
Answer #19: Yes.
Question #20: Is the cost section to include only the consultant labor rates and multipliers?
Answer #20: Yes.
Question #21: Does the Authority expect a cost budget for a specific scope of services?
Answer #21: No.
Question #22: Does the Authority have a level of effort estimate for each of the specific scopes of services that we would apply the labor rates and multipliers?
Answer #22: No.
Question #23: Can a prime include a markup on a sub fees?
Answer #23: No. Please factor any subconsultant fees into your multiplier(s).
Question #24: Please define SDVOB.
Answer #24: Service-Disabled Veteran-Owned Business
Question #25: Given that you anticipate firms that are not only engineering firms responding --can you please confirm that firms that do not maintain audited cost overheads for contracting purposes and contract with the Authority routinely on the basis of fully loaded hourly rates may do so for all staff here, not just partners and principals?
(with appropriate back-up to be provided evidencing that such rates are charged typically for similar services to similar clients)
Answer #25: This is acceptable for submittal of proposal.
Question #26: Is the Port expecting an increase in fees for each year of the agreement?
Answer #26: The hourly rates should be listed for 2024 and rate adjustments will follow the language in the Standard Agreement, Section 9.A. for following years of the program.
Question #27: Along the lines of a prior question given the diversity of tasks (e.g. data collection versus operations or strategy), we would anticipate that different small businesses might be more appropriate teaming partners for different types of work. Would primes be able to adjust small business assignments based on the specific requirements of each task order?
Answer #27: Yes.
