37QMA - Section L (Instructions)4L, 1.6.bSection 1.6.b refers to two separate rationales for OCI. The first is FAR based and clearly indicates supporting

the system developers (such as Boeing, Raytheon Northrop Grumman, etc.) presents a clear conflict. We agree with the FAR restrictions referenced.

However, the second rationale does not reference a FAR or other statutory requirement as its basis. As it is currently stated:

“OCI conflict areas have also been identified between this procurement and other Advisory and Assistance Services (A&AS) contracts. Accordingly, certain restrictions will apply to the QMA successful offeror and team members (subcontractor, joint venture, or otherwise) for those A&AS contracts.”

As written, this clause does not provide clarity as to what the restrictions are, nor what the foundation or underlying principles justify this restrictive stance. Please provide the regulatory reference.

* Please provide an updated H-09 table as referenced in section 1.6-b.

H-9 "Organizational Conflict of Interest " clause is provided in the Solicitation. The specific FAR restrictions are identified in paragraph b(2) of the H-09 clause.
