About this file

This is a technical specification document for dry media procurement issued by the North Texas Municipal Water District (NTMWD) under contract number 25-196-B for activated carbon and exchange services. NTMWD is seeking a vendor to provide procurement and delivery services for activated carbon and permanganate-impregnated polishing media for approximately 150 odor control systems, with estimated annual volumes of 3,000 cubic feet of 0.3 g H2S/cc breakthrough capacity carbon, 1,000 cubic feet of 0.2 g H2S/cc breakthrough capacity carbon, and 1,500 cubic feet of polishing media. The contract also includes procurement of polypropylene mesh media retaining screens and 110-gallon media vessels (both metal and fiberglass reinforced plastic options) for approximately 87 vessels requiring periodic replacement. All deliveries must be made within 60 calendar days of order placement, with a minimum order requirement of five palletized packages per delivery to specified facilities in Allen and McKinney, Texas.

The specification requires virgin activated carbon from approved manufacturers including Evoqua, ECS, PureAir Filtration, or Purafil, with suppliers needing ISO 9001:2000 certification and minimum 15 years of experience in wastewater applications. Media must be packaged in waterproof sealed containers on pallets not exceeding 1,000 pounds, and NTMWD reserves the right to test all media for compliance with specified breakthrough capacities and physical characteristics. The contract includes liquidated damages of $500 per day for late deliveries, and suppliers are responsible for reimbursement on a prorated basis if carbon fails to meet specified H2S breakthrough capacity requirements, with full replacement required if performance falls below 50% of specifications.

D. MEDIA TESTING

1. NTMWD retains the right to have the MEDIA tested by its own lab and/or a certified laboratory of its choice at any time to verify the supplied media meets all specifications.

2. If supplied CARBON fails to meet the specified H2S Breakthrough Capacity, the successful bidder shall have the option to retest up to three times by a certified laboratory of NTMWD’s choosing at the expense of the successful bidder. Test results shall be averaged.

3. If supplied CARBON fails to meet the specified H2S Breakthrough Capacity by less than fifty (50) percent, it shall be the responsibility of the successful bidder to reimburse NTMWD on a prorated basis of double the deficient capacity. For example, if test results indicate the supplied CARBON has an H2S Breakthrough Capacity of ten (10) percent less than specified, the SUPPLIER shall reimburse NTMWD for twenty (20) percent of the expense of the defective media. If supplied CARBON has only fifty (50) percent of the specified H2S Breakthrough Capacity, the successful bidder shall reimburse NTMWD for the full expense of the defective media.

4. If supplied CARBON fails to meet the specified H2S Breakthrough Capacity by greater than fifty (50) percent, it shall be the responsibility of the SUPPLIER to replace the defective CARBON, reimburse NTMWD for all test expenses, and

SPECIFICATION – DRY MEDIA PROCUREMENT PAGE 5 OF 6

reimburse NTMWD for all costs associated with disposal and replacement of the CARBON if not replaced by the SUPPLIER within fourteen (14) calendar days.

5. If supplied MEDIA exceeds the allowable pressure drop, fails to meet the specified hardness number, or exceeds the moisture limit, it shall be the responsibility of the successful bidder to replace the defective MEDIA, reimburse NTMWD for all test expenses, and reimburse NTMWD for all costs associated with disposal and replacement of the defective MEDIA if not replaced by the SUPPLIER within fourteen (14) calendar days.

6. If at any point NTMWD believes the SUPPLIER cannot supply the MEDIA as specified, NTMWD may purchase the MEDIA from another supplier and any additional costs incurred shall be the responsibility of the SUPPLIER.

E. REQUIRED DOCUMENTATION

The SUPPLIER shall supply the following information with the bid and as requested by NTMWD:

a. Specification sheets with technical information.

b. Point of origin and manufacturer of the MEDIA.

c. Raw material of the MEDIA.

d. CARBON capacity test reports following ASTM D6646 protocol to verify H2S Breakthrough Capacity.

PART 3 – EXECUTION

3.01 GENERAL

A. NTMWD has approximately one hundred fifty (150) odor control systems that require MEDIA and MEDIA SCREEN. The estimated annual volume of .3 H2S Breakthrough Capacity CARBON is three thousand (3,000) cubic feet, .2 H2S Breakthrough Capacity CARBON is one thousand (1,000) cubic feet and POLISHING MEDIA is approximately one thousand five hundred (1,500) cubic feet. The SUPPLIER shall procure and deliver MEDIA and MEDIA SCREEN upon request by NTMWD.

B. NTMWD has approximately eighty-seven (87) MEDIA VESSELS that require periodic replacement. The SUPPLIER shall procure and deliver MEDIA VESSELS upon request by NTMWD.

C. All MEDIA, MEDIA SCREEN and MEDIA VESSELS shall be delivered and offloaded to one of the following addresses identified at time of order:

SPECIFICATION – DRY MEDIA PROCUREMENT PAGE 6 OF 6

1. Wilson Creek Regional Wastewater Treatment Plant, 3020 Orr Road, Allen, Texas 75002

2. Sister Grove Water Resource Recovery Facility, 3360 FM 2933, McKinney, Texas 75071

3. Sister Grove Water Resource Recovery Facility, 2436 CR 336, McKinney, Texas 75071

D. MEDIA shall be packaged in waterproof sealed containers on a pallet of a weight not to exceed one thousand (1,000) pounds.

E. NTMWD reserves the right to place orders, on an as-needed basis and NTMWD and SUPPLIER agree to the following:

1. NTMWD will order a minimum of five (5) palletized packages of MEDIA per delivery.

2. All deliveries shall be made within sixty (60) calendar days of order placement.

PART 4 – LIQUIDATED DAMAGES

SUPPLIER and OWNER (the Parties) recognize that time is of the essence in this Agreement and that OWNER will suffer financial loss if SUPPLIER fails to timely complete all obligations required by the Agreement. The parties also recognize the delays, expenses, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by OWNER if the deliveries are not completed by the SUPPLIER in a timely manner. Accordingly, instead of requiring any such proof, the OWNER and SUPPLIER agree to the following:

That as liquidated damages for delay (but not as penalty) in delivery of MEDIA, SUPPLIER shall pay OWNER five hundred dollars ($500.00) per day after the delivery time included in Section 3.01, E., 2. This amount was calculated based on labor and material costs expended by NTMWD in monitoring and responding to an odor complaint. The OWNER will be the sole judge as to whether the delivery has been timely completed. Assessment of Liquidated Damages by the OWNER shall not constitute a waiver of the Owner’s right to sue and collect additional damages which OWNER may sustain by the failure of the SUPPLIER to perform in accordance with the terms of this Contract. This Liquidated Damages provision only covers SUPPLIER’S failure to timely deliver pursuant to the Contract.
