About this file

This is a Request for Bids (RFB No. BL26-00029309) specification document issued by the City of Dallas Building Services Department for the establishment of a 36-month Indefinite Delivery/Indefinite Quantity (ID/IQ) master agreement for lamps and light bulbs. The solicitation extends citywide across all City departments for as-needed purchases, with estimated quantities and expenditures provided solely for cost comparison purposes rather than as binding commitments. Bidders must have at least one year of established business experience in providing lamps, light bulbs, or similar items and must submit three references verifying this experience. A pre-bid meeting will be held to allow prospective bidders to ask questions and obtain clarification from department representatives, though attendance is recommended but not required. All communication regarding the RFB must be directed to the assigned Procurement Specialist through the City's Bonfire electronic bidding portal. Bids must be submitted electronically by the specified deadline through the portal, with hard copy submissions not permitted. The City intends to award by group to the lowest responsive and responsible bidder offering the greatest discount percentage, though it reserves the right to award in the manner most advantageous to the City. The contract will commence upon award by Dallas City Council and execution of contract documents.

Bidders must submit a $100.00 bid security (sealed bid bond, certified check, or cashier's check) with their electronic bid submission to be deemed responsive. The bid evaluation focuses on percentage discounts off manufacturers' most recent catalog price lists, with bidders required to bid all lines within a group to be considered responsive for that group. Bidders must submit current catalog lists in electronic format containing stock numbers, colors, sizes, prices, and pertinent information for citywide usage. All lamps must meet or exceed industry standards established by brands such as General Electric, Sylvania, Westinghouse, TCP, and Philips. Delivery must occur within five working days of receiving the delivery order, with no minimum quantity requirements and acceptance of partial shipments. Emergency orders require 24-hour delivery, and the successful bidder must achieve at least 95% on-time delivery performance in any three-month period. The percentage discount bid at submission will remain firm for the contract term. All freight and shipping charges must be included in the bid price on an F.O.B. City of Dallas basis. The City will pay invoices within 30 days of receipt of correct invoices reflecting delivered goods. Products must include manufacturer's customary warranty or one year, whichever is greater, with defective parts replaced at the awardee's expense during the warranty period.

VII. Sustainable Procurement Policy On May 27, 2020, City Council unanimously adopted the Comprehensive Environmental and Climate Action Plan (“CECAP”) through Resolution No. 20-0688. CECAP is a roadmap that outlines the activities that the City will undertake to improve quality of life, reduce greenhouse gas emissions, prepare for the impacts of climate change, and to create a healthier and more prosperous community. On May 26, 2021, City Council approved the adoption of a comprehensive Sustainable Procurement Policy (“Policy”) through Resolution No. 21-0908. The Policy guides the City in making procurement decisions that positively impact the City’s social, economic, and environmental health. The City is committed to procuring quality goods and services at reasonable costs that support the City in meeting its sustainability goals aimed to improve worker health, conserve natural resources, and prevent pollution. The City gives preference in purchasing to products made of recycled materials if the products meet applicable specifications as to quantity and quality and the average price of the product is not more than 10% greater than the price of comparable nonrecycled products.

· Sustainable Recommendations

· To promote fuel efficiency and reduce greenhouse gases and air pollution, consider using a SmartWay Transport Partner for shipment of products.

· Where suppliers use packaging in addition to manufacturer packaging, the City encourages vendors to select packaging that minimizes or eliminates the use of disposable containers and/or incorporates recycled content. For example, where appropriate, supplier packaging using reusable crates or reusable pallets is preferred over boxed packaging.

· For corrugated cardboard packaging (also known as containerboard packaging), the City encourages Suppliers to use versions that contain a minimum of 25% by weight of post-consumer materials, which is the minimum post-consumer content level for packaging specified by the U.S. Environmental Protection Agency Comprehensive Procurement Guidelines.

· Suppliers are further encouraged to use packaging that does not contain packaging inks, dyes, pigments, adhesives, stabilizers, and additives with levels of lead, cadmium, mercury or hexavalent chromium in packaging inks, dyes, pigments, adhesives, stabilizers, and additives equal to or greater than 100 parts per million, which is consistent with packaging statutes adopted by 19 U.S. states. The following exceptions apply to this heavy metal threshold recommendation for packaging:

· Packaging made from recycled materials.

· Packaging that is essential to the protection, safe handling, or function of the package's contents (e.g., medical product and devices).

· Packages and packaging components for which there is no feasible alternative.

· Reusable packaging for products that are subject to other federal or state health, safety, transportation, or disposal requirements (i.e., hazardous waste).

· Packaging having a controlled distribution and reuse (i.e., beverage containers subject to mandatory deposit requirements).

· Packaging or packaging component that is glass or ceramic where the decoration has been vitrified and when tested, and meets specific requirements.

· For a full explanation of exceptions, see Section 5/Exceptions, Toxic in Packaging Clearinghouse Model Legislation, available at: http://toxicsinpackaging.org/model_legislation.html

VIII. Total Cost of Goods and/or Services Bidders are not required to bid on all groups; however, Bidder must bid all lines in a group to be considered responsive for that group. The items listed are not meant to limit the City to only these items. The City may purchase categorically related items for the same discount percentage offered for that group. Although catalog price lists may change, the Percentage Discount as bid with submission will be firm for the term of the agreement from the date of an award.

Costs not included or calculated in the applicable unit prices as bid will not be paid by the City, regardless of the intentions of the Bidder when the bid was submitted and regardless that those costs were actually incurred. The City will not pay freight, shipping or handling charges. All freight, shipping and/or handling charges should be included in the bid price.

IX. Delivery Orders The successful bidder(s) must receive a hard copy of a City of Dallas delivery order (“DO”) prior to shipping or delivering merchandise. The DO must reflect the specific quantities provided and must reflect percentage discount on the vendor’s bid sheet. The City of Dallas is not liable for any delivery or shipment in which a DO was not obtained first. The vendor shall be responsible for obtaining all information required for invoices at the time they receive the DO. It is also the vendor’s responsibility to obtain the delivery and invoicing address, contact name and phone number of the ordering department at the time the order is placed.

X. Location & Invoicing The City shall pay invoices in 30 days. In order for the City to pay invoices in 30 days, the Supplier’s invoice must be correct, and reflect the work or goods delivered to the City. The 30 days begin when the City has received a correct invoice reflecting the work or goods delivered. If the City receives an invoice that is not correct and/or reflective of work or goods that have been delivered, the City will request a corrected invoice and the 30-day period will begin once the correct invoice has been received. All work described in the Supplier invoice must have been delivered in compliance with the terms of these specifications. Invoices shall be submitted monthly to the City for payment, unless both parties agree to alternative arrangement based on project milestones. Each invoice submitted for payment shall include, at a minimum, the following information:

· Name, address, and phone number of the department where product(s) were delivered

Incorrect invoices or invoices sent to the wrong address will delay payment. Suppliers who fail to follow this procedure risk having their agreement with the City cancelled.
