About this file
This is a request for responses (RFR) attachment issued by the Massachusetts Department of Elementary and Secondary Education (DESE) for the procurement of dried cranberries for its Food & Nutrition Department. DESE seeks a vendor to supply low-sugar dried cranberries in two flavors—Fruit Punch and Raspberry Lemonade—made exclusively from cranberries grown and harvested in Massachusetts. The product specifications require case sizes of 200 packets at 1.16 ounces each, with a maximum of 12 grams of sugar per packet, compliance with Child Nutrition regulations for fruit content, peanut-free formulation, and no artificial flavors, colors, preservatives, or sweeteners. All products must comply with federal Food and Drug Administration regulations (21 CFR Part 110.00) and Massachusetts Department of Public Health regulations (105 CMR 500.000). The RFR Bid #BD-27-1026-DOE02-DOE01-130647 (Alternate ID #27NUTRL6) is posted on COMMBUYS, and all responses must be submitted through that platform. The DESE reserves the right to adjust quantities and request additional flavors throughout the contract term.
Pricing will be structured through purchases made under the related RFR #27NUTRL4, with no price increases permitted during the first contract year. Vendors may request price increases for renewal years with at least thirty days' notice, provided increases are justified and do not exceed the Consumer Price Index for Boston-Cambridge-Newton, Massachusetts-New Hampshire, capped at 5 percent. Required submissions include product specification sheets, three references with company details and contract values, proof of delivery commitment to DESE's state-contracted warehouse, a completed fee sheet, current Massachusetts Department of Public Health food licenses and the most recent inspection report, a detailed company profile, and documented continuity of operations, food defense, and food recall procedures. Massachusetts General Law Chapter 7, Section 22O mandates state preference for businesses with principal places of business in Massachusetts. Additionally, the Operational Services Division has established goals requiring at least 15 percent of statewide procurement contracts annually be awarded to independently owned and operated small businesses with principal places of business in Massachusetts that have operated for at least one year.
