About this file

This is a Questions and Answers document for solicitation 26WS0015, a biohazard waste removal and disposal services contract issued by California Department of Veterans Affairs (CalVet) through the California Department of General Services (DGS). The contract solicitation addresses collection, transportation, treatment, and disposal services for biohazard waste streams. The document clarifies that the contract term is three years with fixed rates throughout the initial term and any extensions, and pricing is based on per-pound rates for waste disposal and per-pickup fees for service calls as detailed in the rate sheet and Exhibit B-1 of the solicitation.

This is a DGS-certified DVBE (Disabled Veteran Business Enterprise) set-aside solicitation exclusively open to DVBE prime contractors, though non-DVBE subcontractors may be utilized for portions of the work provided they meet commercially useful function requirements. All pricing must be all-inclusive, covering transportation, fuel, labor, treatment, disposal, containers, supplies, manifests, environmental compliance, regulatory fees, and other applicable charges with no separate surcharges permitted. California prevailing wage requirements do not apply to this contract. Specific details regarding container types and quantities, pharmaceutical waste classifications, pickup frequency parameters, weight calculation methodologies, and after-hours service provisions are referenced in Exhibit A (Scope of Work) and the Rate Sheet rather than detailed in the Q&A responses. Historical volume data, incumbent contractor information, and subcontractor details from the previous contract are not available at this time.

BIOHAZARD WASTE REMOVAL AND DISPOSAL SERVICES

QUESTIONS AND ANSWERS

1. Prevailing Wage Requirements

Please confirm whether California prevailing wage requirements apply to any portion of the collection, transportation, treatment, or disposal services performed by the prime contractor or its subcontractors. If applicable, please identify the relevant wage classifications, DIR registration requirements, and certified payroll obligations.

Answer – No Prevailing Requirements Apply

2. DVBE Prime Contractor & Subcontracting

May a DGS-certified DVBE prime contractor subcontract portion of the collection, transportation, treatment, or disposal services to a properly licensed non-DVBE subcontractor? Are there any subcontracting percentage limitations or minimum self-performance requirements beyond the commercially useful function (CUF) requirements? Please also confirm what subcontractor information and documentation must be provided with the bid.

Answer – Yes a Non-DVBE vendor can be Sub-Contracted for this contract.

3. All-Inclusive Pricing, Transportation & Surcharges

Please confirm whether the per-pound rates in Exhibit B-1 must include all transportation, fuel, labor, treatment, disposal, container, supply, manifest, environmental, regulatory, and other applicable fees or surcharges incurred by the prime contractor and its subcontractors. Are any separate charges permitted, including for future increases in government-mandated fees or disposal facility surcharges?

Answer – Please Reference the rate sheet in the solicitation for all charges the included.

4. Fixed Pricing & Rate Adjustments

Please confirm whether all Exhibit B-1 rates must remain fixed throughout the initial three-year contract and any extensions. Would adjustments or contract amendments be permitted in the event of substantial changes in waste volumes, operating expenses, transportation costs, or disposal facility pricing?

Answer – All the rates for this solicitation are for the full term of this contract.

5. Historical Volumes, Contract Value & Incumbent

Can CalVet identify the current or previous incumbent contractor and confirm whether any subcontractors were utilized under the previous agreement? If so, please identify the subcontractors and the services they performed, if available.

Additionally, can CalVet provide the total number of scheduled and unscheduled pickups performed under the previous contract, preferably broken down by year and waste category, along with historical waste quantities and the previous contract award amount or total expenditure?

Answer – This information is not available at this time.

6. Container Inventory & Supply Requirements

Please identify the container types, sizes, and approximate quantities currently used for each waste stream, including sharps containers. Are the prime contractor and its subcontractors responsible for providing all containers, liners, replacement supplies, and initial container inventory at no additional charge?

Answer – Please reference the Exhibit A (Scope of Work) in the solicitation.

7. Container Replacement & Sharps Pricing

Are sharps containers billed exclusively under the Line A per-pound rate regardless of container size? Additionally, who is responsible for replacement costs associated with containers lost, damaged, or rendered unusable while in CalVet's possession?

Answer – Please reference the Exhibit A (Scope of Work) in the solicitation.

8. Pharmaceutical Waste Classification & Disposal Requirements

Can CalVet provide representative waste profiles or manifests identifying the pharmaceutical and RCRA hazardous pharmaceutical waste streams? Please clarify whether controlled substances, chemotherapy waste, or other specialized waste categories are included, whether any specific waste classifications are excluded, and whether waste requiring disposal outside the Exhibit B-1 categories would be separately authorized and priced.

Answer – Please reference the Exhibit A (Scope of Work) in the solicitation.

9. Pickup Frequency, Minimum Charges & Low-Volume Pickups

If CalVet increases or modifies scheduled pickup frequency, will additional transportation or service charges be permitted, or will compensation remain solely based on per-pound rates? Are minimum pickup charges or compensation for scheduled visits where little or no waste is available permitted?

Answer – Please reference the Rate Sheet for all charges for this contract.

10. Unscheduled Pickup Charges

Please confirm that unscheduled pickups are compensated using both the applicable per-pound rate and the Line D unscheduled pickup fee. How is the fee applied when multiple waste streams are collected, multiple pickups occur on the same day, or an unscheduled pickup coincides with a scheduled visit?

Answer – Please reference the Rate Sheet for all charges for this contract.

11. Waste Weight Calculations & Verification

Are billable weights based on gross or net waste weight, and are disposable containers, sharps containers, bags, and liners included? Which weight measurement governs invoicing if collection-site and disposal-facility weights differ?

Answer – Please reference the Rate Sheet for all charges for this contract.

12. Nonconforming Waste & Additional Handling

If waste is improperly segregated, mislabeled, or otherwise nonconforming and requires repackaging, reclassification, additional handling, or specialized disposal, how will the associated costs be addressed under Exhibit B-1?

Answer – Please reference the Rate Sheet for all charges for this contract.

13. Bid Evaluation Methodology

As Exhibit B-1 lists three per-pound rates and one per-pickup rate without estimated quantities or a total-price calculation, please clarify how CalVet will determine the lowest responsive quote. Will estimated quantities or weighting factors be provided for each line item?

Answer – The lowest responsive and responsible vendor will be selected.

14. After-Hours, Weekend & Holiday Services

If CalVet authorizes services outside standard business hours, on weekends, or on State holidays, will additional labor, transportation, or emergency service charges be permitted, or must those costs be included in the existing rates?

Answer – Please reference the Rate Sheet for all charges for this contract.

15. Pricing Assumptions & Qualifications

May bidders submit supporting pricing assumptions, exclusions, or an itemized cost breakdown with Exhibit B-1, or must the quote contain only the four-unit rates?

Would including pricing qualifications or exclusions cause a bid to be deemed non-responsive?

Answer – Please reference the Rate Sheet for all charges for this contract.
