Evaluation Factors for Award
52.212-2 ADDENDUM - EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
Addendum to Paragraph (a). Paragraph (a) is changed to read as follows:
Submission of Offers.
The Government intends to award a single Firm-Fixed Price (FFP), Indefinite Delivery/Indefinite Quantity (IDIQ) contract to the Offeror whose proposal represents the best value to the Government. This acquisition will be conducted in accordance with FAR Parts 12 and 15, utilizing the Best Value Tradeoff approach as described in FAR Subpart 15.101-1. In addition, prior to award, the awardee must be determined responsible in accordance with the standards set forth in FAR Part 9.
The Government reserves the right to not consider for award any proposal that fails to comply with the administrative requirements outlined in Addendum52.212-1, Instruction to Offerors. By submitting a proposal, the Offeror agrees to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in the proposal being deemed unacceptable and excluded from further consideration for award.
The Government intends to award without discussions. Therefore, Offeror's are advised to submit initial proposals that reflect the Offeror's best approach/terms for all evaluation factors, including technical approach, past performance, and price. Notwithstanding this intent, the Government reserves the right to conduct discussions if deemed necessary by the Contracting Officer. As stated in the Addendum to FAR 52.212-1, Instruction to Offerors, failure to comply with proposal instruction or any other administrative requirements may result in the proposal being excluded from further evaluation.
To make the best value award decision, the Government will evaluate proposals based on the following four (4) Factors and their associated Subfactors, using the Best Value Tradeoff process outlined in FAR 15.101-1:
1. Factor 1-Technical Approach
Subfactor 1 - Staffing Capability
Subfactor 2 - Vehicle Capability
2. Factor 2-Past Performance
3. Factor 3-Price
4. Factor 4-Representations and Certifications
The relative importance of the evaluation factors is as follows: Technical Approach (Factor 1) is more important than Past Performance (Factor 2). Technical Approach (Factor 1) and Past Performance (Factor 2), when combined, are more important than Price (Factor 3). Technical Approach (Factor 1), Past Performance (Factor 2) and Price (Factor 3), when combined, are important than Representations and Certifications (Factor 4). All Technical Approach (Factor 1) Subfactors are of equal importance. The complete evaluation criteria are outlined below:
Evaluation Factors:
Factor 1: Technical
The Government will evaluate the Offeror's Attachment 2_Technical Proposal to determine whether the Offeror's proposal meets or exceeds the requirements outlined in the Evaluation Factors. The specific subfactors in which the Offeror will be evaluated are: Subfactor 1: Staffing Capability and Subfactor 2: Vehicle Capability. The Offeror's Attachment 2: Factor 1 - Technical Proposal shall provide sufficient information for the Government to assess the Offeror's capability to successfully perform the requirements in accordance with the Evaluation Factors. The Government reserves the right to evaluate the Offeror's responses across all tabs of Attachment 2 and apply relevant information to any of the two subfactors, as appropriate, during the evaluation process.
The Government shall evaluate the following Subfactors:
Subfactor 1 - Staffing Capability
The Government shall evaluate the Offeror's ability to maintain uninterrupted student transportation services through effective personnel management, based on the Offeror's responses to Attachment 2, Subfactor 1. The Government shall evaluate the Offeror's strategy for maintaining continuity of services, minimizing disruptions and ensuring ongoing compliance with PWS requirements throughout the life of the contract. Specifically, the Government will evaluate the following:
Personnel Availability o Offeror's capability to provide qualified personnel in each labor category by 01 August 2026 and each contract year.
o Offeror's approach to ensuring full coverage of all routes in Attachment 7(a) and alignment with anticipated student ridership populations as outlined in Attachment 5 Pricing.
Staffing Sufficiency o Adequacy of proposed staffing levels and labor categories (e.g. Contract Manager, Alternate Contract Manager, Drivers, Safety Aides, Safety Attendants) to meet operational requirements outlined in the PWS.
Operational Readiness o Daily availability of Drivers and Safety Aides/Attendants.
o Contingency plans for unexpected absences or resignations.
o Teaming arrangements, if applicable, including roles and responsibilities of each partner. Offeror is to provide a completed Enclosures 3:
Letter of Commitment for each subcontracting/teaming partner that is proposed in meeting the solicitation requirements. Failure to submit a completed Enclosure 3, as applicable, will result in the Offeror's proposal being assessed a deficiency and an "Unacceptable" rating for Subfactor 1.
Note 1: The Government will use Attachment 7(a) and the Ridership Populations in Attachment 5 - Price Template in evaluating whether the Offeror's staffing levels are adequate in ensuring continued, uninterrupted services. The Government may identify a weakness if the Offeror's proposal reflects only the minimum required staffing levels without demonstrating flexibility, scalability, or contingency planning to address potential changes in route requirements or personnel availability. In addition, proposals that demonstrate a proactive and well-integrated personnel management strategy may be evaluated more favorably.
Note 2: Any cells, marked in yellow and "response required," in Attachment 2 must be completed by the Offeror. For cells requiring a quantity in each labor category to be provided, a blank cell will not be assumed to offer zero quantity - it is assumed to be a non-compliant response. The Offeror may be given a weakness, significant weakness, or deficiency if the yellow/"response required" cells are not completed due to insufficient information and/or if there are discrepancies in the responses provided by the Offeror in this attachment. The Offeror is not required to provide a response to cells marked in purple as responses provided in purple cells may be considered an offering that exceeds the government's minimum requirements.
Subfactor 2 - Vehicle Capability
The Government shall evaluate the Offeror's ability to maintain uninterrupted student transportation services through effective vehicle fleet management, based on the Offeror's responses to Attachment 2, Subfactor 2. The Government shall evaluate the Offeror's strategy for maintaining continuity of services, minimizing disruptions and ensuring ongoing compliance with PWS requirements throughout the life of the contract. Specifically, the Government will evaluate:
Route and Ridership Alignment o Offeror's strategy for covering all routes listed on Attachment 7(a) Route List, in alignment with anticipated student ridership populations outlined in the solicitation.
Vehicle Compliance o Offeror's proposed vehicles to determine whether they meet or exceed requirements in the PWS, Attachment 7(a) Route List, and are in compliance with Federal, State, and Host Nation regulations.
• Vehicle specifications that exceed minimum PWS requirements may be considered strengths in the Offeror's proposal.
Operational Readiness o Daily availability of vehicles, to include replacement vehicles.
o Offeror's regular and preventative maintenance plan.
o Teaming arrangements, if applicable, including roles and responsibilities of each partner. Offeror is to provide a completed
Enclosure 3: Letter of Commitment for each subcontracting/teaming partner that is proposed in meeting the solicitation requirements. Failure to submit a completed Enclosure 3, as applicable, will result in the Offeror's proposal being assessed a deficiency and an "Unacceptable" rating for Subfactor 2.
Note 1: The Government will use Attachment 7(a) and the Ridership Populations in Attachment 5 - Price Template in evaluating whether the Offeror's staffing levels are adequate in ensuring continued, uninterrupted services. The Government may identify a weakness if the Offeror's proposal reflects only the minimum required number of vehicles without demonstrating flexibility, scalability, or contingency planning to address potential changes in route requirements or vehicle availability.
The Offeror will be given a deficiency if the proposed vehicles do not cover all anticipated routes included in Attachment 7(a). In addition, proposals that demonstrate a proactive and well-integrated fleet management strategy may be evaluated more favorably.
Note 2: Any cells, marked in yellow and "response required," in Attachment 2 must be completed by the Offeror. For cells requiring a vehicle quantity to be provided, a blank cell will not be assumed to offer zero quantity - it is assumed to be a non-compliant response.
Factor 1 and all Subfactors will be rated in accordance with the following Adjective Rating Method:
Combined Technical
/Risk Rating Method
Adjectival Rating Description
Outstanding
Proposal demonstrates an exceptional approach and understanding of the requirements and contains multiple strengths and/or at least one significant strength, and risk of unsuccessful performance is low
Good
Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength or significant strength, and risk of unsuccessful performance is low to moderate.
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Marginal
Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Unacceptable
Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is unawardable, and/or risk of performance is unacceptably high.
A rating of "Unacceptable" for any Subfactor will result in the proposal being deemed Technically Unacceptable and not eligible for contract award.
Definition of
Strengths
/Weaknesses
/Deficiency
Adjectival Rating Description
Significant Strength An aspect of an Offeror's proposal with appreciable merit or will exceed specified performance or capability requirements of the considerable advantage of the Government during contract performance.
Strength An aspect of the Offeror's proposal with merit or that will exceed specified performance or capability requirements to the advantage of the Government during contract performance.
I Weakness In the proposal, is a flaw that increases the risk of unsuccessful performance
Factor 2: Past Performance.
Past Performance will be evaluated as an indicator of the Government's confidence in the Offeror's ability to successfully perform the contract requirements. The evaluation will consider each Offeror's recent and relevant record of performance in delivering services similar in scope, magnitude and complexity to those outlined in this solicitation. The Government will evaluate the quality and relevance of prior and current contract performance, the Offerors ability to meet performance standards, schedules and customer expectations from responses received from the Past Performance Questionnaire (PPQ), Attachment 4, and the Past Performance Proposal, Attachment 3 - Volume II - Past Performance. The Government may also consider other sources of past performance information, as appropriate, to determine the overall quality and reliability of the Offeror's performance history.
The Government reserves the right to factor in Past Performance information from projects that demonstrate an Offeror's ability to perform a requirement, even if the scope of work is not identical to the requirements in this solicitation.
Past Performance information submitted that is not recent (more than 3 years) will be evaluated as "Not Recent" and will be given a neutral rating. Past
Performance information that is not relevant will be evaluated as "Not Relevant" and will be given a neutral rating.
The Government may choose not to evaluate more than three (3) recent contract references. If more than three (3) recent contract references are submitted, the government will select which three references to evaluate at its discretion.
In evaluating past performance, the Government reserves the right to give greater consideration to individual contracts that are deemed most relevant to the scope, complexity and magnitude described in this solicitation. Additionally, the Government also reserves the right to give greater consideration to the past performance of an individual Offeror rather than the combined past performance of an Offeror and its teaming partner(s) or subcontractors.
Offerors without a record of recent and/or relevant past performance or for whom information on past performance is not available or is so sparse that a past performance rating cannot be reasonably assigned will not be evaluated favorably or unfavorably on past performance and as a result, will receive a "Neutral" rating for the Past Performance factor.
A "Neutral" rating will also be assigned if: 1) The Prime Offeror does not submit at least one past performance reference in which they provided services as a Prime Contractor or Subcontractor/Teaming Partner; and 2) The Prime Offeror fails to describe the specific roles and responsibilities of each proposed subcontractor or teaming partner as outlined in their teaming arrangement. The Government reserves the right to determine that a "Substantial Confidence" or "Satisfactory Confidence" past performance rating is worth more than a "Neutral Confidence" past performance rating in a best value tradeoff.
If the Government chooses to conduct negotiations, Offerors in the competitive range will be provided with an opportunity to address any adverse past performance information not previously addressed. Adverse past performance is defined as past performance information which supports a less than satisfactory rating on any evaluation aspect or any unfavorable comments received from sources without a formal rating system.
The Government reserves the right to reject any proposal if it determines that the Offeror has deleted, misrepresented, or withheld information that could negatively affect its past performance record.
The Government will consider past performance in the aggregate in addition to an individual contract basis when assigning a confidence rating. In addition to past performance information submitted by the contractor, past performance information may be obtained from Contract Performance Assessment Reporting System (CPARS), Federal Award Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; the Defense Contract Management Agency (DCMA); and interviews with Program Manager, Contracting Officers, or other sources known to the government.
A performance confidence assessment rating will be assigned to each Offeror after reviewing recent and relevant past performance information. A performance confidence rating will be based on the following rating method:
Perfor mance
Confid enceA ssessm ent
Adjectival Rating Description
Substantial Confidence Based on the offeror's recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory
Confidence
Based on the offeror's recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence
No recenUrelevant performance record is available, or the offeror's performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the offeror's recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror's recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
In assessing the Offeror's probability of meeting the solicitation requirements, the Offeror's evaluation and Overall Rating of Recency, Relevancy and Quality of the
Offeror's Past Performance will be based on the following ratings methods:
Recency Assessment. An assessment of the past performance information will be made to determine if itis recent according to the following:
Past Performance
Recency Ratings
Adjectival Rating Description
Recent The effort must be ongoing or must have been completed within the last three (3) years by the closing date and time of this solicitation.
Not Recent The effort has been completed for more than three (3) years by the closing date and time of this solicitation.
Relevancy Assessment. The Government will determine how relevant the effort accomplished by the Offeror is to the effort to be acquired through the solicitation.
The Government is not bound by the Offeror's assessment of relevancy. To be relevant, the Offeror must demonstrate that their performance involved similar scope, magnitude of effort, and complexities this solicitation requires.
Scope: Refers to the type of work performed in the Offeror's past performance reference when compared to the type of work required in this solicitation. The type of work required is for student transportation services.
Magnitude of effort: Refers to the size of an Offeror's past performance reference. The Offeror's past performance reference will be compared to the Government's estimated amount to perform the work required in the PWS.
Complexity: Refers to the level of complexity of an Offeror's past performance reference. The level of complexity will be compared to the Government's estimated complexity level. The following factors maybe considered for each past performance reference to determine whether each reference is similar in complexity.
1. Providing safe and reliable Daily Commute/SPED student transportation services from designated stops to school, and vice versa.
2. Appropriately managing personnel and vehicles (i.e., Responsiveness to deficiencies and performance issues and making timely corrections. Taking a proactive approach when known performance issues may hinder mission requirements).
3. Responding and reporting incidents and accidents in regard to transporting students on the bus.
4. Maintaining vehicles in accordance with host nation and contractual requirements.
5. Effectively communicating with all stakeholders. Communicating issues as necessary to ensure all stakeholders were informed.
Relevancy will be rated in accordance with the following Rating method:
Past Performance
Relevancy
Adjectival Rating Description
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
Quality Assessment. The Government will review the Offeror's Past Performance information to determine the quality of the Offeror's performance and general trends in performance, which will also be a factor in the performance confidence assessment. The Government will evaluate the quality of the Offeror's past performance based on the relevance, recency and demonstrated outcomes of previously completed contracts or subcontracts. The assessment will consider evidence of successful performance in meeting requirements similar in size, scope and magnitude to the solicitation requirements based on PPQs, CPARS, and other sources available to the Government.
Factor 3: Price.
This factor will not be assigned an adjectival rating. However, the Offeror's proposal, as submitted in Attachment 5, will be evaluated to determine whether the proposed pricing is fair and reasonable in accordance with techniques and procedures outlined in FAR Subpart 15.404-1.
In addition, the Government reserves the right to conduct a Price Realism analysis to determine whether a low-priced offered reflects a lack of technical understanding, or an inherent performance risk due to unrealistically low pricing. If the Price Realism analysis indicates that the proposed price is unrealistically low and poses unacceptable risk to successful performance, the proposal may be rejected.
Evaluation of Options. For award purposes, the Government will evaluate the total proposed price, including the base period, all option periods and the potential extension under FAR 52.217-8, Option to Extend Services (up to six months). The Offerer must submit pricing for the base period and all option periods, including the "FAR 52.217-8 Option to Extend Services" table in Attachment 5. The Offeror shall provide a Unit Price foreach CLIN Description. If the Government exercises the FAR 52.217-8 option in a period other than the fourth option year, the rate from the last completed year of performance will be applied. The Government may consider an offer unacceptable if option pricing is determined to be significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
Factor 4: Representations and Certifications.
Failure to provide a completed Attachment 6 and Enclosures 1-7 will result in the Offerer's proposal being assessed a deficiency and an "Unacceptable" rating. If the Prime Offeror plans to utilize subcontracting/teaming partners in meeting the solicitation requirements, the Prime Offeror must provide a completed Enclosure 3:
Letter of Commitment from each subcontracting/teaming partner. Failure to submit a completed Enclosure 3, as applicable, will result in the Offerer's proposal being assessed a deficiency and an "Unacceptable" rating for Subfactor 1 and Subfactor 2.
