About this file

This is a Memorandum to the File documenting a decision to restrict competition for a commercial acquisition under the Simplified Acquisition Threshold (SAT). The procurement is for 450 units of EOTECH HWS EXPS3 HD weapon-mounted holographic sights (Part Number EXPS3HD-0) manufactured by EOTECH LLC and authorized resellers, located in Plymouth, Michigan (CAGE Code 8PKQ7). The sights are required for direct replacement of damaged and end-of-lifecycle systems. The Required Delivery Date is December 31, 2026, with a funding expiration date of September 30, 2026.

The restriction of competition is justified under the brand name rationale, as the EXPS3 HD represents the newest production sights with enhanced features specifically designed to work cohesively with existing fielded systems. The components are necessary for replacing obsolete systems with direct replacements that have been tested at multiple test events and require no additional retrofitment. EOTECH LLC, as the Original Equipment Manufacturer, maintains proprietary rights to data, design, and manufacturing and is unwilling to provide technical data packages for re-engineering. Procuring equivalent components from alternative sources would require extensive qualification, design, and testing to ensure compatibility, resulting in costs and delays that would exceed the benefits of competitive action. The Contracting Officer has certified that only one source is reasonably available for this procurement under RFO FAR 12.102(a) and RFO DFARS regulations.

☐ OTHER REASONS. Other reasons not identified above. Provide details on mission impact if requirement is not solicited from only one source.

This procurement is for Qty. 450 HWS EXPS3 HD, P/N EXPS3HD-0, Weapon Mounted Holographic Sights which are the newest production sights with cutting edge and enhanced features designed in conjunction with

The components being procured are specifically designed to work cohesively with EXPS3 HD systems and they are necessary in the replacement of currently fielded systems that have become obsolete. Systems to be procured are a direct replacement with enhanced features of currently fielded systems produced by the same manufacturer. Systems have been tested at multiple test events and conform to current needs not requiring additional retro fitment to weapon systems.

The original equipment manufacturer (OEM), EOTECH LLC, has proprietary rights to data, design, and manufacturing of the equipment and is not willing to provide the Government with a technical data package to obtain specifications or re-engineer the system. The purchase of components from another source would require extensive qualification, design, and testing to ensure compatibility. This type of qualification and testing would cost the Government more than and would cause a delay of . These detriments would not be recouped in competitive action.

☐ UNUSUAL AND COMPELLING URGENCY:

Urgent requirements are supplies or services that will result in a work stoppage or are mission critical, and the routine processing time would result in injury to the Government.
