About this file

This is a Single Source Justification document for a brand-name acquisition under the simplified acquisition threshold submitted by the Department of State's Overseas Post in Panama City.

The acquisition seeks to procure CAMFIL brand high-efficiency Air Handling Unit (AHU) replacement air filters and related spare parts for the New Embassy Compound (NEC) in Panama City at an estimated total cost of $45,307.80. The specific required filter models are: CAMFIL DU4V-ES3-2424-MV13, CAMFIL 30/30 CL2 24242 MV8, and CAMFIL 30/30 CL2 24202 MV8. The justification is based on brand-name authority per FAR 13.106-1(b)(1), as these specific CAMFIL filters are the originally specified/manufacturer-approved products required for compatibility with the existing AHUs and to maintain proper ventilation and indoor air quality (IAQ) in continuously occupied Embassy facilities. The requirement directly supports the Department of State's Safety, Occupational Health, and Environmental Management (SHEM) program as established in 15 FAM 953, 954, and 960. The contracting activity is the Office of Acquisitions Management, and procurement may be made from CAMFIL USA, Inc. or any authorized/certified CAMFIL source. The justification explicitly states that no substitutions, alternate products, "equal" products, or products from other manufacturers will be accepted. The Contracting Officer has determined the anticipated cost to be fair and reasonable.

Panama City- High Efficiency AHU Air filters

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

The action being approved is the acquisition of CAM FIL brand high-efficiency AHU replacement air filters and related spare parts for the Air Handling Units (AHUs) installed at the New Embassy Compound (NEC), Embassy Panama City, at an estimated total cost of $45,307.80.

The required CAM FIL high-efficiency air filters include the following specific models:

• CAMFIL DU4V-ES3-2424-MV13

• CAM FIL 30/30 CL2 24242 MV8

• CAM FIL 30/30 CL2 24202 MV8

These filters are specified as a Brand Name requirement because the identified CAM FIL products are required for continued compatibility with the existing AH Us and to satisfy the established technical and performance requirements of the NEC ventilation systems. The specified CAM FIL filters provide the required filtration efficiency, airflow characteristics, dimensional configuration, and physical and operational characteristics necessary for the proper functioning of the installed AH Us.

The CAM FIL filters are critical components of the NEC HVAC systems and contribute to maintaining proper ventilation and acceptable indoor air quality, as well as supporting the health and safety of personnel occupying the facilities. The acquisition will ensure the continued reliable operation of the AH Us and support compliance with applicable Department of State facility, safety, health, environmental, and indoor air quality requirements.

Accordingly, approval is requested to procure the specific CAM FIL brand filters identified above, and associated replacement filter components/spare parts, from CAM FIL USA, Inc. or an authorized/certified CAM FIL source. The Government will not accept substitutions, alternate products, "equal" products, "equivalent" products, or products of other brands in place of the specified CAM FIL products.

This brand-name justification does not restrict award to a single contractor. A solicitation may be issued to any responsible source authorized or certified to provide the specified CAM FIL brand products.

SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS

The requirement is to provide CAM FIL USA brand high -efficiency AHU air filters, specifically the following models:

• CAM FIL DU4V-ES3 -2424-MV13

• CAMFIL 30/30 CL2 24242 MV8

• CAMFIL 30/30 CL2 24202 MV8

The Embassy Panama City requires the acquisition of CAMFIL high -efficiency replacement air filters and spare parts for the Air Handling Units (AH Us) installed at the New Embassy Compou~d (NEC).

These filters are essential components of the NEC HVAC and mechanical ventilation systems and are necessary to maintain proper equipment operation, adequate ventilation, and acceptable indoor air quality (IAQ) throughout the occupied facilities.

The required CAM FIL filters are high -efficiency filtration products specifically selected for the existing AH Us and are designed to remove airborne particulate matter and other contaminants from the air circulated throughout the NEC. Proper filtration is an integral component of maintaining acceptable indoor environmental conditions in facilities that are continuously occupied by U.S. Government personnel, locally employed staff, contractors, and visitors.

The requirement is directly related to the Department of State 's Safety, Occupational Health, and Environmental Management (SHEM) program. 15 FAM 953 establishes ventilation standards for protection of personnel, while 15 FAM 954 establishes safety, health, and environmental design standards and requires measures to ensure acceptable indoor air quality in Department of State office buildings. In addition, 15 FAM 960 requires posts abroad to implement a comprehensive safety, occupational health, and environmental management program to protect personnel and capital assets.

Maintaining the specified CAM FIL filtration products is necessary to support the intended performance of the ventilation system and the indoor air quality objectives established for the facility.

The use of products other than the specified CAM FIL filters could result in differences in filtration efficiency, pressure drop, airflow characteristics, dimensions, construction, fit, or other operational characteristics that could affect HVAC performance, equipment loading, designed airflow, or the effectiveness of the building's air-cleaning system.

The replacement filters must therefore be the specific CAMFIL-manufactured products identified in this requirement and must conform to the specified model numbers, dimensions, construction, • filtration characteristics, pressure-drop characteristics, airflow characteristics, and equipment compatibility requirements established for the existing AHUs. CAM FIL-manufactured filte rs supplied by CAM FIL USA, Inc. or an authorized/certified CAMFIL source are required.

No substitution will be permitted. Products identified as another brand, alternate product, "equal, " "equal to, " "equivalent," "or equal," "or equivalent," or otherwise offered as a substitute for the specified CAM FIL products are not acceptable and will not be considered for award.

The timely replacement of the specified CAM FIL filters is necessary to maintain the proper operation of the NEC ventilation systems, support acceptable indoor air quality, protect the health and well -being of building occupants, and maintain compliance with applicable Department of State SHEM and facility-management requirements. Failure to obtain the specified CAMFIL filters could result in degraded HVAC performance, reduced filtration effectiveness, deterioration of indoor environmental conditions, and potential health and safety concerns within buildings that are in continuous occupation.

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COM~ETITION

In accordance with Federal Acquisition Regulation (FAR) 13.106-l(b)(l), the Contracting Officer has deemed only one source reasonably available based on the following :

D Urgency

□ Exclusive licensing agreements

~ Brand-name

□ Industrial mobilization

SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY

CITED

The nature of this acquisition requires the use of a brand-name justification for CAM FIL filters because the replacement filters must be the specific CAM FIL products identified in this requirement for continued use with the existing Air Handling Units (AHUs) installed at the New Embassy Compound (NEC).

The requirement is not based solely on a preference for the CAM FIL brand. The specific CAM FIL filters are required because they are the originally specified/manufacturer-approved filtration products for the existing HVAC systems and provide the filtration, airflow, pressure, dimensional, construction, and equipment-operational characteristics required for proper operation of the AH Us.

The filters are high-efficiency components of the NEC ventilation system and contribute directly to maintaining appropriate indoor air quality (IAQ) and the environmental conditions required for continuously occupied Embassy facilities. The use of a different brand or product could introduce differences in filtration efficiency, pressure drop, airflow, construction, dimensions, fit, or other performance characteristics that could adversely affect airflow, HVAC performance, equipment operation, and the effectiveness of the building's filtration system.

FAC contacted the manufacturer of the AH Us to identify authorized sources capable of providing the required replacement filters. CAM FIL USA, Inc. was identified as an authorized source for the specified

CAM FIL filters. The identified CAM FIL products are the required products for continued operation of the NEC ventilation systems.

The Government has determined that the specific CAMFIL products identified in this requirement are necessary to meet the Government's needs. A generic, alternate, substitute, "equal," or "equivalent" filter is not acceptable. The Government will not evaluate or consider another manufacturer's product as a substitute for the specified CAM FIL products.

The brand-name requirement is therefore established specifically for the CAM FIL products and model numbers identified in this justification. Only the specified CAM FIL products, obtained from CAM FIL

USA, Inc. or an authorized/certified CAM FIL source, will satisfy the requirement.

Therefore, the CAM FIL brand-name requirement is necessary to maintain the established configuration and operational characteristics of the existing HVAC systems, support the designed performance of the ventilc::ttion systems, support indoor air quality, and satisfy the Embassy's facility and SHEM requirements. The acquisition is appropriately supported by the authority cited in this justification because the Gqvernment's requirements are for the specified CAM FIL brand and models and are not satisfied by substitution of products manufactured by another brand.

SECTION 6. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST

TO THE GOVERNMENT IS FAIR AND REASONABLE

By signing the justification, the Contracting Officer makes a determination that the price to the Government is anticipated to be fair and reasonable.

All reviews and approvals should be completed in the order listed unless otherwise authorized or required.
