About this file
This is a Darfur Contracting Act Certification form issued by the State of California for solicitation 26FS0001, which concerns Back-up Generator and Automatic Transfer Switch Maintenance and Incidental Repair Services at the Veterans Home of California at Fresno. The solicitation is restricted to certified Small Business (SB) firms only. The form requires prospective bidders to certify their compliance with California Public Contract Code Sections 10475-10481, which govern companies with business activities or operations outside the United States within the previous three years. Bidders must either certify that they are not a scrutinized company or provide written permission from the Department of General Services authorizing them to submit a proposal. Companies without international business activities in the previous three years are exempt from completing this certification.
The certification form provides two compliance pathways for eligible bidders. Option 1 requires companies to certify under penalty of perjury that they are not scrutinized companies as defined in Public Contract Code Section 10476 and that the signatory is authorized to bind the company. Option 2 allows scrutinized companies to submit bids if they have obtained written permission from the Department of General Services on a case-by-case basis, provided such permission is included with the bid or proposal. Both options require submission of the company name, Federal ID Number, authorized signature, and printed name and title of the signing official. All questions regarding the solicitation must be submitted via email, and specific timelines are provided in the accompanying Solicitation for Quote letter.
