About this file

This is a Darfur Contracting Act Certification form issued by the State of California's Department of General Services, applicable to companies bidding on state contracts, including the Mobile Radiology and Ultrasound Services contract for the Veterans Home of California - Yountville. The certification document addresses compliance requirements under Public Contract Code Sections 10475-10481, which mandate that any company with business activities or operations outside the United States within the previous three years must certify its status prior to submitting a bid or proposal. Companies without international operations during this period are exempt from the certification requirement.

The form provides two compliance pathways for eligible bidders. Option 1 allows non-scrutinized companies to certify under penalty of perjury that they do not meet the definition of a scrutinized company as defined in Public Contract Code Section 10476, with certification requiring the company name, Federal ID Number, and an authorized signature. Option 2 accommodates scrutinized companies that have obtained written permission from the Department of General Services Director on a case-by-case basis to submit bids or proposals, provided such permission is deemed in the best interests of the state under Public Contract Code Section 10477(b), requiring submission of supporting documentation from DGS with the bid or proposal. All certifications must be executed by an authorized representative of the prospective proposer or bidder under the laws of the State of California.
