About this file
This Anti-Lobbying Certification Form pertains to Request for Proposal 26A-0212 issued by Mohave Educational Services Cooperative (MESC), an Arizona-based statewide purchasing consortium representing approximately 480 public agencies seeking vendors to provide food safety and sanitation consulting, educational training, and related supplies. The procurement encompasses consulting services including hazard analysis, corrective action plan development, HACCP principles instruction, compliance reviews, on-site audits, evaluations, staff training, ANSI certification training and testing, and educational training covering biological and chemical hazards, cleaning and sanitizing, temperature control, food allergies, hand-washing, and personal hygiene. The pre-proposal conference is scheduled for January 29, 2026, with a question deadline of February 5, 2026, and proposals due by February 12, 2026, at 3:00 p.m. through the OpenGov Procurement portal. The initial contract term is one calendar year from the effective date of award with four optional consecutive one-year extensions available based on satisfactory performance and competitive pricing.
The certification form certifies compliance with the Byrd Anti-Lobbying Amendment (31 U.S. Code § 1352) and prohibits the use of federal appropriated funds to influence officers or employees of any federal agency, Members of Congress, or congressional employees in connection with the contract award. Vendors must disclose any non-federal funds used for lobbying activities using OMB standard form LLL and must incorporate this certification language into all subcontract awards, requiring subcontractors receiving awards in excess of $100,000 to certify and disclose accordingly. Violations of anti-lobbying requirements are subject to civil penalties ranging from $10,000 to $100,000 for each violation. The RFP does not specify an overall budget value; pricing will be competitively evaluated based on submitted proposals with weighted evaluation criteria including pricing (30 points), compliance (25 points), vendor qualifications and experience (20 points), supporting documents (15 points), and additional capability information (10 points).
