About this file
This is a Confidential Treatment Form issued by the State of Michigan for RFP 260000002152 concerning Microcystin Field Test Strips. The form provides instructions for bidders to declare whether they are requesting confidential treatment of materials submitted with their proposals. Bidders must complete and submit either Section 1, confirming no confidential treatment is requested, or Section 2, formally requesting confidential treatment of specified proprietary or trade secret information. The form must be signed by the same individual who signed the bidder's proposal, and failure to submit a completed form constitutes grounds for rejection of the proposal as non-responsive.
Section 2 requires bidders requesting confidential treatment to identify specific information by proposal page number, section number, and paragraph number, classify the material as Trade Secret (TS), Proprietary Financial Information (FI), or Proprietary Information (PI), and provide detailed legal justification citing applicable Michigan Freedom of Information Act (FOIA) exemptions. Bidders may not request confidential treatment for resumes, pricing, or marketing materials. Those selecting Section 2 must also submit a redacted "Public Copy" of their proposal with all protected information clearly marked. The State of Michigan reserves the right to make final determinations regarding FOIA exemptions and has no obligation to notify bidders of FOIA requests or public disclosure decisions. The Confidential Treatment Form itself and any justification letters are not exempt from FOIA release.
