This is an Invitation to Bid (ITB) issued by the Alaska Railroad Corporation (ARRC) for the supply, production, quality control, handling, delivery, and stockpiling of Type 5 Yard Ballast material at the ARRC Seward Yards facility in Seward, Alaska. The ballast material will support Terminal Track Rehabilitation projects and maintenance activities across the southern Railbelt region. Bidders must submit sealed bids by 3:00 PM Alaska local time on April 15, 2026, to Rob Walker at ARRC's Supply Management office in Anchorage. The base bid quantity is 2,000 tons with an additive alternative for an additional 2,000 tons on a per-ton basis. All material must be stockpiled at a designated staging site within ARRC's Seward Yard, with the exact location to be determined prior to delivery. The anticipated final delivery completion date is October 1, 2026. No formal bidders' conference or mandatory site visit is specified in the solicitation documents. Minimum bidder qualifications include authorization to serve Alaska as either the original manufacturer or an authorized distributor, demonstrated capacity to provide full product support including technical troubleshooting, and documented financial ability to perform the contract.

Bidders must submit a complete bid package including the Supply Bid Form, Cost Schedule, Bidders' Questionnaire, and federal certifications. Unit prices must remain firm for thirty days from bid opening and continue as firm prices throughout contract performance. Payment is due thirty days after receipt of supplies and proper documentation. The ballast material must meet rigorous quality control standards, with sieve analysis testing required at minimum once per 1,000 tons of production across seven particle size categories. A pay factor adjustment mechanism applies compensation ranging from approximately 79 to 93 percent of the base unit price depending on conformance to specification limits. The contract is funded in part by the Federal Transit Administration (FTA) and/or Federal Railroad Administration (FRA), requiring compliance with Buy America provisions, Davis-Bacon wage requirements, and Disadvantaged Business Enterprise (DBE) program regulations. ARRC operates a race-neutral DBE program with an overall annual participation goal of 4 percent on federal contracts, though no specific contract goal has been established for this individual solicitation. ARRC reserves the right to reject any or all bids and to reject material failing to meet compliance standards.

SPECIAL PROVISIONS

Unless noted otherwise herein, the March 2025 edition of ARRC’s Standard Specifications for Construction (SSC) are to be referenced. Furthermore, unless explicitly noted, “Section” or “subsection” shall be in reference to the SSC. The above-mentioned reference manual can be found at:

SECTION 309

RAILROAD BALLAST

309-3.01 MATERIALS.

Delete Subsection in its entirety and replace with the following:

Ballast shall be unloaded as close as possible to the point of use so that unnecessary handling is prevented.

Excess ballast shall be picked up and redistributed at the Contractor's expense. Ballast shall be handled in such a manner as to ensure it remains clean of deleterious materials and within specifications. The Contractor shall coordinate work to avoid unnecessary stockpiling of ballast material. In the event that the material is required to be stockpiled, the Contractor shall take care not to mix in fines and other deleterious materials. The Contract Manager may reject stockpiled material or require the Contractor to perform additional testing on field samples if the material does not appear to meet the standard gradation or other physical properties for ballast specified in Subsection 703-2.17.

Add the following Subsections:

309-4.02 ACCEPTANCE SAMPLING AND TESTING.

Prior to the Contractor entering full production of ballast in support of this Contract, the Contractor is to ensure that its key personnel have read and thoroughly understand the contents of this portion of the work. The Contractor’s key personnel will determine compliance both visually and through the implementation of field testing throughout the “Start-up Period.” The length of this period is solely dependent on the Contractor’s confidence level in the material it’s producing. However, for payment purposes; the “Start-up Period” shall not exceed ten (10) percent of the total quantity generated under this Item. Once the Contractor has dialed in their operation, it is to submit its projected gradation to the Owner for review prior to entering full production. The submitted gradation will become the target gradation which will be used to track the consistency of the Contractor’s material production operation. Price adjustments will be calculated based on the sieve analysis results as compared to the gradation envelope outlined in Table 309-1 below. Material found to conform to the Contract Documents during the “Start-up Period” shall be entered for payment as outlined herein.

A sieve analysis shall be performed, in accordance with ATM 304, Method A (Sieve Analysis of Fine and Coarse Aggregates and Material Finer than No. 200 Sieve in Mineral Aggregates by Washing), for every 1,000 tons of material produced and/or delivered. The result(s) shall be submitted to the Owner prior to issuance of payment for the material that said result(s) represents. The Owner shall perform Quality Assurance testing using a third party testing firm at a minimum frequency of 10% of the Contractor’s required frequency. The Contractor’s results will be used to calculate the Ballast Price Adjustment as mentioned below.

https://www.alaskarailroad.com/sites/default/files/procurement/2025%20ARRC%20SSC.pdf

In addition to the sieve analysis, the Contractor shall also submit test results outlined in Table 309-1 below:

TABLE 309-1

AGGREGATE TESTING FREQUENCIES FOR BALLAST

Test results shall be submitted within 24 hours of the Contractor receiving the results. Said results shall be reviewed and approved by a Professional Engineer registered in the State of Alaska, provided to the Owner in a format that is acceptable to it, and shall indicate whether or not the sample conforms to the Contract Documents.

309-4.03 EVALUATION OF MATERIALS FOR ACCEPTANCE.

The Owner will share its Quality Assurance testing results with the Contractor upon receiving the Contractor’s Quality Control results. Furthermore, should any gradation test result be called into question, it is recommended that the Contractor retain a split of sufficient size, for each sub-lot , to run a sieve analysis in accordance with the procedure identified above in Table 309-1. The ARRC will retain a split of each of its tests until the lot that said tests represent are accepted by both it and the Contractor. In the event that there is a disparity, the splits will be tested by an independent testing firm that is not associated with the project. All costs associated with the testing of the splits will be the responsibility of the Contractor, with the exception of costs associated with testing the splits retained by the Owner.

Remedial Actions. Should any test fail to meet the Contract Documents, the Contractor is to notify the Owner as soon as practicable. Upon notification of a failed test, the Contractor may elect to institute one of the following measures:

1. Waste the material at no cost to the Owner;

2. Accept the penalization for material that is marginally non-conforming; or

3. Reprocess the material prior to its stockpiling within the indicated stockpile location.

If the Contractor’s means and methods continually fail to produce a product that conforms to the Contract Documents, the Contractor will cease its operations and is to submit a detailed work plan outlining its means and methods to bring its operation back into conformance. At a minimum this remediation plan may include, but is not limited to, the following:

TEST PROCEDURE FREQUENCY

Sampling Aggregate ASTM D7 5 & ASTM C 702 1 per 1,000 tons

Sieve Analysis ATM 304, Method A 1 per 1,000 tons Clay Lumps & Friable Particles ASTM C 142 1 per 1,000 tons

Fractured Particles ASTM D5821 1 per 1,000 tons Bulk Specific Gravity (SSD) AASHTO T 85 1 per source Absorption ASTM C 97 1 per source Magnesium Sulfate Soundness

ASTM C88 (Five Cycles) 1 per source

L.A. Abrasion AASHTO T 96 1 per source Wet/Dry ASTM D 5313 1 per source Freeze/Thaw ASTM D 5312 1 per source

1. Frequency of testing to be performed by the Contractor to ensure that remedial efforts are producing a product that conforms to the Contract Documents prior to returning to full production;

2. Additional equipment required to bring the operation into conformance (e.g. additional cone crusher, additional jaw crusher, additional screen deck, fine material screw washer, wash screens, etc.);

3. Sourcing material from different geological formations within the quarry; or

4. Adjusting the feed rate of the plant.

A maximum of three (3) consecutive failing gradations and/or five (5) failing gradations within in a 10,000 tons will be the basis for the Owner requiring the reprocessing of said material at no cost to the Owner.

309-4.04 BALLAST PRICE ADJUSTMENT.

As the gradation of the ballast is paramount to the integrity of the ARRC’s rail infrastructure, the Contractors Quality Control gradation results will be utilized as acceptance results, in addition to the Owner’s Quality Assurance gradation results, for use in the Ballast Price Adjustment. Said test results for each individual lot (maximum increments of 2,500 tons) are analyzed collectively and statistically as defined in the attached Microsoft excel workbook to determine the total estimated percentage of the lot that is within specification limits. The Contractor’s test results will be weighted evenly with the Owner’s results.

A lot containing material with less than a 1.00 pay factor is accepted at an adjusted price, provided that the pay factor is at least 0.80 and there are no isolated defected identified by either the Owner or its representative. A lot containing material that fails to obtain the minimum pay factor is considered unacceptable and rejected under Subsection 105-1.11.

309-5.01 BASIS OF PAYMENT.

Delete Subsection in its entirety and replace with the following:

Water, added to the aggregate at the final stockpile location, is subsidiary.

Mobilization and demobilization to complete the work will not be measured for payment.

Any traffic control measures required to complete the work will not be measured for payment.

Payment will be made under:

The following terms and conditions supersede the terms and conditions on the reverse side of ARRC’s purchase order to the extent that they are inconsistent therewith and shall be deemed to have the same force and effect as though expressly stated in any such purchase order into which this document is incorporated.

1. Definitions.

“ARRC” shall mean the Alaska Railroad Corporation.

“Vendor” shall mean the person or entity entering into the contract to provide the supplies specified therein for ARRC.

“Contract” shall mean these General Terms and Conditions, the contract form to which they are annexed, and all other terms, conditions, schedules, appendices or other documents attached to the contract form or incorporated by reference therein.

“Supplies” shall mean the equipment, goods, materials or other items to be provided by Vendor to ARRC under the contract.

2. Inspection and Reports. ARRC may inspect all of the Vendor's facilities and activities under this contract in accordance with the provisions of ARRC Procurement Rule 1600.9. The Vendor shall make progress and other reports in the manner and at the times ARRC reasonably requires.

3. Claims. Any claim by Vendor for additional compensation or equitable adjustment arising under this contract which is not disposed of by mutual agreement must be made by Vendor in accordance with the time limits and procedures specified in sections 1800.12 et seq. of ARRC's Procurement Rules, which by this reference are hereby incorporated herein.

4. Nondiscrimination.

4.1 The Vendor may not discriminate against any employee or applicant for employment because of race, religion, color, national origin, ancestry, physical or mental handicap, sex, marital status, change in marital status, pregnancy or parenthood when the reasonable demands of the positions do not require distinction on the basis of age, physical handicap, sex, marital status, changes in marital status, pregnancy, or parenthood. To the extent required by law, the Vendor shall take affirmative action to insure that the applicants are considered for employment and that employees are treated during employment without unlawful regard to their race, color, religion, national origin, ancestry, physical or mental handicap, age, sex, marital status, changes in marital status, pregnancy or parenthood. This action must include, but need not be limited to, the following: employment, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff or termination, rates of pay or other forms of compensation, and selection for training including apprenticeship. The Vendor shall post in conspicuous places, available to employees and applicants for employment, notices setting out the provisions of this paragraph.

4.3 Full cooperation in Paragraph 4.2 includes, but is not limited to, being a witness in any proceeding involving questions of unlawful discrimination if that is requested by any official or agency of the State of Alaska; permitting employees of the Vendor to be witnesses or complainants in any proceeding involving questions of unlawful discrimination, if that is requested by any official or agency of the State of Alaska; participating in meetings; submitting periodic reports on the equal employment aspects of present and future employment; assisting inspection of the Vendor's facilities; and promptly complying with all State directives considered essential by any office or agency of the State of Alaska to insure compliance with all federal and state laws, regulations, and policies pertaining to the prevention of discriminatory employment practices.

Vendor shall not be paid for any work done after receipt of a notice of cancellation or for any costs incurred by Vendor's suppliers or subcontractors which Vendor could reasonably have avoided. However, in no event shall ARRC be liable for incidental, consequential, or punitive damages, overhead or other direct or indirect costs, or lost profits.
