52.212-2 Evaluation-Commercial Products and Commercial Services (NOV 2021)

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

EVALUATION-COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Price: The total evaluated price will include the total price of all line items. The price will be evaluated but not scored. Award will be made to the Best Value to the government.

(2) Technical acceptability: The government will evaluate quotes on the basis of whether or not the offer conformed to the submission instructions and minimum requirements identified in the attached PWS dated 19 Apr 21.

(3) Past Performance: The contractor shall provide a description of the proposed team’s experience on efforts (no more than three) of similar content and scope, to include scope and outcome of the project. The past performance references must include Government or Commercial point of contact information to include name, organization, title, e-mail address, mailing address, and phone number. Factors influencing past performance include experience on similar tasks of the same scope and meeting schedules. The Government may supplement the experience information provided with information obtained through Federal Awardee Performance and Integrity Information System (FAPIIS), Contractor Performance Assessment Reporting System (CPARS), and Supplier Performance Risk System (SPRS) databases or any other reasonable basis. Offerors with derogatory marks or terminations for default/cause will not be considered for award.

The government intends to award without discussions with respective vendor. The government however, reserves the right to conduct discussions if deemed in its best interest.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
