About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition for a bridge contract modification to extend the current Facility Investment Services task order N6247321F5431 for Building 750 at Naval Base San Diego.
The current task order is set to expire on September 29, 2024, and NAVFAC Southwest plans to incorporate these services into a new Base Operations Service Contract (BOSC) for the base. However, the new BOSC contract will only be for 6 months starting April 1, 2025, which is not sufficient time for a new contractor to gain the necessary accesses, learn the complex systems, and successfully perform the services. Therefore, NAVFAC is proposing a 6-month base period with six 1-month option periods to extend the current contract with the incumbent, , to ensure continuity of services until the BOSC is in place. The anticipated cost for the bridge contract is $574,336.59, to be funded with FY24 and FY25 Operations & Maintenance, Navy funds.

4. Statutory Authority Permitting Other Than Full and Open Competition:
The statutory authority permitting other than full and open competition is 10 USC § 3204 (a)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 Only One Responsible Source, which permits contracting without providing for full and open competition in situations where only one responsible source will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority:
The current facility investment contract N62473-18-D-5608 Task Order N6247321F5431 expires on September 29, 2024. The task order was awarded with a one year Base Period, and two (2) one-year Option Periods for a total of 36 months. This requirement did not account for the potential need of a 6-month extension. Consequently, the 6-month extension of performance permitted under FAR 52.217-8 was not evaluated at the time of award.
After award of Task Order N6247321F5431, NAVFAC Southwest determined a Base Operations Service Contract (BOSC) should be implemented for Naval Base San Diego, with the services of the current task order falling under the new BOSC. While sufficient time exists for a follow-on contract to be awarded, the new contract duration would only be for a term of six months, as the BOSC is scheduled to be awarded with a period of performance start date of April 1, 2025. Due to the complexities and highly specialized nature of this service contract, a six month long new contract would not be successful to meet the requirements of the Scope of Work. This contract requires the use of Maximo, which requires several months in which to gain access. Also, the contract requires substantial work related to HVAC, boiler, plumbing, generator, and fire systems, which require extensive time to learn and understand how to maintain and repair.
When the current contract was awarded in FY21, the contractor required up to eight (8) months to fully gain accesses to Maximo due to base security standards and work timelines. Contractor and sub-contractor base DBIDS also took time to acquire, as several different sub-contractors are required for the multitude of different systems requiring work and certification. Due to these intricacies, a new contract under a potential new contractor would not have sufficient time in a six month period to meet the requirements of the contract.
Six one (1) month options are also included for this extension of the task order. Historically, BOSC procurements in the San Diego area of responsibility have been challenged by disappointed offerors either in the federal courts or the United States General Accountability Office. Should the Naval Base San Diego BOSC procurement be challenged, the start of the new performance period may be unacceptably delayed. These one-month option periods would ensure a continuity of service until the BOSC is awarded and operational.
The current contractor, , is successfully performing the current task order, and continues to receive successful Monthly Performance Assessment Summaries (MPAS). They have the accesses required for the building and all its systems, including Maximo. . is presently on-site and has the resources, equipment, and familiarity with requirements to continue the services without interruption. Due to the timeline of the BOSC and the uniqueness of the requirements at B750, it is not possible for an alternative company to successfully perform the support services. Procuring the required services for a follow-on six-month contract with an alternative source would jeopardize critical Navy missions.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
The task order N6247321F5431 was competed under MASC N6247318D5608 among the following contractors:
. ’s proposal was determined to be the lowest priced offeror, and fair and reasonable. Adequate competition for the task order was obtained.
Due to the intricacies of this project, standard market research procedures for other qualified firms could not be conducted in accordance with FAR Part 10. Other than full and open competition is necessitated by only one responsible source being able to satisfy agency requirements under the authority of 10 U.S.C. § 3204 (a)(1). The approved J&A will be released in accordance with FAR 6.305(a). NAVFAC Southwest is in the process of a competitive BOSC procurement for Naval Base San Diego services, which includes the services under this task order N6247321F5431.
7. Determination of Fair and Reasonable Cost:
The Contracting Officer has determined the anticipated cost to the Government of the supplies and services covered by this J&A will be considered fair and reasonable in accordance with FAR 15.404- 1(b)(ii) Comparison of the proposed prices to historical prices paid.
8. Actions taken to Remove Barriers to Future Competition:
This is a one-time bridge contract modification to extend the current task order for a six month period.
NAVFAC Southwest is pursuing a competitive procurement to award a Base Operations Service Contract to obtain the required services. No barriers to promote future competition are anticipated.
