Work (SOW) for the Mid-Term Availability (MTA) of the USNS PATUXENT (T-AO 201) under RFP N3220521R4110. This J&A covers only the portion of the acquisition, to which an
Original Equipment Manufacturer (OEM) Authorized Facility / Manufacturer / Representative are required and the approval level requirements then only apply to that portion. This J&A applies to sole source, limited source, and brand names only as indicated in the separate justifications.
Where an OEM has qualified additional companies to service the OEM’s equipment, this J&A will embrace those companies as well. This J&A does not preclude brand name or equivalent products where an OEM is not the sole source, but venders must proffer independent technical and engineering analysis sufficient to support their assertion of equivalence, as MSC lacks the technical equipment and staff to perform suchanalysis.
3. Description of Supplies/Services: MSC requires OEM authorized technical field service representatives and OEM parts to accomplish the requirements of WI 203, 206, 305, 308, 401, 404, 405, 415, 451, 452, 453, 454, 455, 459, 513B, 514, 517, 523, 530, 531, 562, 563, 575, 651, and 653 for a fifty (50) day MTA. (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements, as implemented by FAR 6.302-1(a).
(2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The
Government intends to post a synopsis and a Request for Proposal (RFP) for the Ship Repair
Availability at the Government Point of Entry, beta.SAM website, with the intent of awarding a firm-fixed-price contract to the lowest price technically acceptable offeror. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work on the related WIs.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will make a determination if the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR Part 15.
8. Market Research: The USNS PATUXENT (TAO-201) is home ported in Norfolk, VA and therefore, is known as an east coast asset. All non-emergent vessel repairs are conducted on the east coast. The basis for the market research was to collect historical information from the ship’s last four (4) vessel repair availabilities. Purchase Order’s N32205- 18-C-4003, N32205- 17-C-4003, N32205-16-C-4003 and N32205-15-C-1003 were the contract numbers identified.
In researching this information, similarities were discovered in that each of the (4) contracts were procured as a 100% small business set-aside under NAICS, 336611, with a standard business size standard of 1,000 employees and that all of the identified contracts were awarded as a FFP, type of contract.
9. A Listing of the Sources, if any that Expressed, in writing, an Interest in the Acquisition: A
Sources Sought Notification was posted beta.SAM on 12 December 2020. This was conducted in order to identify potential sources that were capable of performing the work identified in thework package. Gulf Copper and Manufacturing; GI Industrial-Marine, LLC; East Coast Repair and
Fabrication, LLC; Boston Ship Repair, LLC; BAE Systems Ship Repair, Inc.; and Alabama
Shipyard, LLC sent responses indicating they were interested and had the resources available to perform the work.
10. Actions to Removed Barriers to Future Competition: For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC
Norfolk will assess whether competition for future requirements is feasible.
