Fiscal Service Procurement, on behalf of the National and Community Service (AmeriCorps), National Civilian Community Corps (NCCC), is hereby requesting quotes for a single award Blanket Purchase Agreement (BPA), for Drug Screening Services requirement in accordance with the Statement of Work (SOW) and the attached Pricing Schedule.
The Government anticipates awarding a single award Blanket Purchase Agreement (BPA), firm-fixed price (FFP), BPA orders may be issued under the planned BPA fixed-price rates. One BPA award may be issued to assist AmeriCorps in satisfying the demand for Drug Screening Service compliance for the Bureau. The anticipated period of performance will include one (1) 12-month base period and four (4) 12-month option period years.
This will be a 100% Small Business Set-Aside using North American Industry Classification System (NAICS) Code 621511 for Medical Laboratories.
In addition to the quotation for the specifications, all information required on the clause package, including any instructions to vendors, must be completed and included with your quote.

BLANKET PURCHASE AGREEMENT (BPA) TERMS, CONDITIONS, AND PROCEDURES
1. DESCRIPTION OF BLANKET PURCHASE AGREEMENT (BPA) - The purpose of this blanket purchase agreement (BPA) is to establish an acquisition vehicle for use by the Bureau of the Fiscal Service, Division of Procurement Services (DPS), on behalf of the Corporation for National and Community Service (AmeriCorps) to obtain Drug Screening. This BPA provides for the issuance of Firm-Fixed Price (FFP) BPA orders. A BPA order becomes a binding contract when it is accepted for a specific service and amount.
2. EXTENT OF OBLIGATION - The Government is obligated under this BPA only to the extent of the authorized orders placed by authorized personnel and accepted by the Contractor. This BPA will not obligate any funds.
3. ORDER OF PRECEDENCE All BPA Orders are subject to the terms and conditions of the BPA. In the event of conflict between a BPA Order and the BPA, the BPA will take precedence unless otherwise stated in the order.
4. NOTICE OF INDIVIDUALS AUTHORIZED TO PLACE ORDERS - All orders under this BPA must be issued by a warranted Bureau of the Fiscal Service, Division of Procurement Services, Contracting Officer (CO).
5. COR- The Contracting Officer’s Representative (COR) and Alternate Contracting Officer’s Representative (ACOR) will be named at the time of the BPA award. The BPA Contracting Officer’s Representative (COR) and Alternate Contracting Officer’s Representative (ACOR) will be the same COR and ACOR on all orders.
6. BPA PRICING - Pricing for all services purchased under this BPA shall be in accordance with the established rates, or the Contractor’s quoted price at the individual order level; whichever is less. The Contractor warrants to the best of its knowledge that the prices of all products purchased under this BPA are not in excess of those charged to its other customers for like products at like quantities and represent the best available pricing. The Contractor shall notify the CO of any discounts that may apply to this BPA. The CO reserves the right to request additional pricing discounts
7. AWARD BPA ORDER PROCESS - The following is an explanation of how services will be requested and obtained under this BPA. An order specifies and authorizes work to be accomplished by the Contractor to satisfy a definite Government requirement.
a. Requests for BPA Order Quote:
The Government will issue requests for quote (RFQ) to the Contractor for anticipated orders for specific needs. RFQs will include the technical specifications of the requirement, a corresponding statement of work (SOW), any other relevant and/or necessary information, and will denote the anticipated type of BPA order to be issued as a result.
RFQs neither commit the Government to pay any costs incurred in the submission of quotes nor to ultimately proceed with the issuance of orders subsequent to such requests.
b. Preparation and Submission of BPA Order Quote:
The Contractor shall prepare and submit quotes in response to Government RFQs as quickly as possible; at a maximum the Contractor shall provide such quotes within ten (10) calendar days of the request. Discussions and/or negotiations may be held to clarify requests, specifications, and/or pricing as needed up until the point of acceptance by the Government.
The Contractor is encouraged to provide any appliable discounts to their price quote.

8. FREQUENCY OF ORDERING- The intent is to issue two BPA calls per year with two campuses being on each of those calls at 6-month intervals or one call per year with four campuses represented on each call depending on resources and requirements.
9. INTERPRETATION OF BPA AND BPA ORDER REQUIREMENTS - If the Contractor finds clarification necessary with respect to the scope of the services to be performed or the products to be provided hereunder, the Contractor shall request such clarification from the CO. No interpretation of any provision of this BPA or individual orders, including applicable specification, shall be binding on the Government unless furnished or agreed to in writing by the CO.
10. INSPECTION AND ACCEPTANCE - Inspection and acceptance of work performed under the BPA orders will be handled by the COR to ensure the Contractor is compliant with the service requirements. The COR will review the services to ensure that requirements are met in accordance with the BPA and BPA order.
11. NON-PAYMENT FOR ADDITIONAL WORK - Any additional services rendered or products provided by the Contractor, either at its own volition or at the request of an individual other than a duly appointed CO, except as may be explicitly authorized in the BPA order, will be done at the financial risk of the Contractor. Only a duly appointed CO is authorized to bind the Government to a change in the specifications, terms, or conditions of this BPA and associated BPA orders. No work shall be performed, and no payment shall be made except as authorized by issuance of a BPA order executed by a CO.
12. BPA TERM AND ORDERING PERIODS - The overall term of this BPA is a 12-month base with 4 (four) 12-month option ordering periods. Continuance of this BPA through the exercising of each option ordering period shall be at the sole discretion of the Government.
13. ANNUAL BPA REVIEW - In accordance with FAR 8.405-3(e), the BPA will be reviewed annually.
14. ESTIMATED AMOUNT- The Government anticipates a single BPA call limit of $25,000.00 and the maximum ceiling amount for the Blanket Purchase Agreement of $249,000.00.

1052.201-70 CONTRACTING OFFICER’S REPRESENTATIVE (COR) APPOINTMENT AND
AUTHORITY (APR 2015)
(a) The COR(s) are named on the award form. Should a change to the COR(s) be necessary in the future, they will be named on the modification SF-30.
(b) Performance of work under this contract is subject to the technical direction of the COR identified above, or a representative designated in writing. The term “technical direction” includes, without limitation, direction to the contractor that directs or redirects the labor effort, shifts the work between work areas or locations, and/or fills in details and otherwise serves to ensure that tasks outlined in the work statement are accomplished satisfactorily.
(c) Technical direction must be within the scope of the contract specification(s)/work statement. The COR does not have authority to issue technical direction that:
(1) Constitutes a change of assignment or additional work outside the contract specification(s)/work statement;
(2) Constitutes a change as defined in the clause entitled “Changes”;
(3) In any manner causes an increase or decrease in the contract price, or the time required for contract performance;
(4) Changes any of the terms, conditions, or specification(s)/work statement of the contract;
(5) Interferes with the contractor's right to perform under the terms and conditions of the contract; or
(6) Directs, supervises or otherwise controls the actions of the contractor's employees.
(d) Technical direction may be oral or in writing. The COR must confirm oral direction in writing within five workdays, with a copy to the Contracting Officer.
(e) The Contractor shall proceed promptly with performance resulting from the technical direction issued by the COR. If, in the opinion of the contractor, any direction of the COR or the designated representative falls within the limitations of (c) above, the contractor shall immediately notify the Contracting Officer no later than the beginning of the next Government workday.
(f) Failure of the Contractor and the Contracting Officer to agree that technical direction is within the scope of the contract shall be subject to the terms of the clause entitled “Disputes.”
52.204-13 SYSTEM FOR AWARD MANAGEMENT MAINTENANCE. (OCT 2018)

The Contractor, or any entity or representative acting on behalf of the Contractor, shall not refer to the supplies or services furnished pursuant to the provisions of this contract in any news release or commercial advertising, or in connection with any news release or commercial advertising, without first obtaining explicit written consent to do so from the Contracting Officer.
Should any reference to such supplies or services appear in any news release or commercial advertising issued by or on behalf of the Contractor without the required consent, the Government shall consider institution of all remedies available under applicable law, including 31 U.S.C. 333, and this contract.
Further, any violation of this clause may be considered during the evaluation of past performance.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The rate for the extension will be at the same rate of the last option exercised. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of contract expiration.
52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor prior to the expiration of each contract period; provided, that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months, unless FAR Clause 52.217-8 is exercised.
52.232-18 AVAILABILITY OF FUNDS (APR 1984)
LAPSE FUNDING
In the event of a lapse funding resulting in a government shutdown, the status of Fiscal Year funding and any necessary action required of the Contractor will be made available at the following website:

1052.232-39 UNENFORCEABILITY OF UNAUTHORIZED OBLIGATIONS (January 2016)
(a) Definition. As used in this clause-
"Commercial supplier agreements" means terms and conditions customarily offered to the public by vendors of supplies or services that meet the definition of commercial item set forth in FAR 2.101 and intended to create a binding legal obligation on the end user. Commercial supplier agreements (CSA) are particularly common in information technology acquisitions, including acquisitions of commercial computer software and commercial technical data, but they may apply to any supply or service. The term applies-
(1) Regardless of the format or style of the document. For example, a CSA may be styled as standard terms of sale or lease, Terms of Service (TOS), End User License Agreement (EULA), or another similar legal instrument or agreement, and may be presented as part of an offer or quotation responding to a solicitation.
(2) Regardless of the media or delivery mechanism used. For example, a CSA may be presented as one or more paper documents or may appear on a computer or other electronic device screen during a purchase, software installation, other product delivery, registration for a service, or another transaction.

(b) Except as stated in paragraph (c) of this clause, when any supply or service acquired under this contract is subject to any CSA, that includes any language, provision, or clause requiring the Government to pay any future fees, penalties, interest, legal costs or to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-Deficiency Act violation (31 U.S.C. 1341), the following shall govern:
(1) Any such language, provision, or clause is unenforceable against the Government.
(2) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the CSA. If the CSA is invoked through an "I agree" click box or other comparable mechanism (e.g., "click-wrap" or "browse-wrap" agreements), execution does not bind the Government or any Government authorized end user to such clause.
(3) Any such language, provision, or clause is deemed to be stricken from the CSA.
(c) Paragraph (b) of this clause does not apply to indemnification or any other payment by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.
1052.232-7003 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (APR 2015)
(a) Definitions. As used in this clause—
(1) “Payment request” means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), "Content of Invoices" and the applicable Payment clause included in this contract.
(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Invoice Processing Platform (IPP). Information regarding IPP, including IPP Customer Support is available at www.ipp.gov or any successor site.
(c) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing in accordance with Treasury procedures.
(d) If alternate payment procedures are authorized, the Contractor shall include a copy of the Contracting
Officer’s written authorization with each payment request.

OVERPAYMENTS
In accordance with 52.212-4 section (i) 5 Overpayments: Accounts Receivable Conversion of Check Payments to electronic funds transfer (EFT): If the Contractor sends the Government a check to remedy duplicate contract financing or an overpayment by the government, it will be converted into an EFT.
This means the Government will copy the check and use the account information on it to electronically debit the Contractor's account for the amount of the check. The debit from the Contractor's account will usually occur within 24 hours and will be shown on the regular account statement.

The Contractor will not receive the original check back. The Government shall destroy the Contractor's original check, but will keep a copy of it. If the EFT cannot be processed for technical reasons, the Contractor authorizes the Government to process the copy in place of the original check.
MARKING OF SHIPMENTS AND INVOICES
The Contractor shall ensure the contract number is clearly visible on all shipping/service documents, containers, and invoices.

Alternate I (JAN 2017) If the Contractor is not required to attend the postaward conference in person, but will attend via an alternate method (e.g. telephone and video conferencing), substitute paragraph (b) with the following:
(a) A postaward conference will be held with the successful offeror.
(b) The postaward conference will be held via [insert, e.g. telephone, video conferencing, or other method]. The Contracting Officer or authorized designee will provide the Contractor with the date and time along with other pertinent information, including the agenda for the postaward conference.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

GENERAL INFORMATION
Title of Project:
AmeriCorps National Civilian Community Corps (NCCC) Drug Screening Services BPA
Statement of Need, Purpose, and/or Objective:
AmeriCorps NCCC is seeking Drug Screening Services located near four regional campus locations and project sites throughout the United States, its territories (e.g. Puerto Rico, Guam, etc.) and the District of Columbia.
Drug Screening Services will be required for approximately 2% of members each month for random drug screening, and for when there is reasonable suspicion of drug use. AmeriCorps NCCC estimates that 1,540 members will serve with AmeriCorps NCCC annually. The number of tests may vary based upon the total enrollment of service members and additional unforeseen screening requirements. The number of tests are estimates, and do not guarantee services for a specific amount of individuals.
Background Information:
The Corporation for National and Community Service (AmeriCorps) is located at 250 E Street, SW; Washington D.C. 20525. AmeriCorps NCCC is a residential national service program operated by the Corporation for National and Community Service. The AmeriCorps NCCC mission is to strengthen communities and develop leaders through team-based national and community service. Built on the legacy of the Civilian Conservation Corps of the 1930s, AmeriCorps NCCC is premised on the belief that civic responsibility is an inherent duty of all citizens, and that national service can effectively solve local problems while providing opportunities to learn practical skills and engender a life-long commitment of service to others.
The AmeriCorps NCCC mission is accomplished through the engagement of young people (ages 18 – 24) in team-based service on projects in local communities throughout designated regions of the country. AmeriCorps NCCC currently has 4 regional campuses which operate throughout the U.S. and are based in McClellan Park, California; Vicksburg, Mississippi; Aurora, Colorado and Vinton, Iowa.
Period of Performance:
The anticipated period of performance is for one (1) twelve-month base period and four (4) twelve month option periods.
Place of Performance:
The Vendor must have screening locations for testing located throughout the United States, its territories, and the District of Columbia. The Vendor must be able to provide screening locations nationally. The screening location should be no greater than a maximum of 60 miles from a project site. These sites change throughout the year, therefore, the Vendor shall have many screening locations through the United States. At least one screening location must be located within 60 miles of each regional campus.
NCCC intends to procure two BPA calls per year with two regional campuses being on each of those calls at 6-month intervals or one call per year with four regional campuses represented on each call depending on resources and requirements. The COR and ACOR will reside at the HQ General Services level while they will procure services utilizing guidance from each of the regional campuses represented (points of contact listed below) and indicated on each BPA call.
