This document is a technical specification and bid document from the Oklahoma City Water Utilities Trust (OCWUT) for a Unit Price Small Diameter Water Main Repair contract citywide. The contract is designed to provide repair and construction services for small diameter water distribution mains (2-24 inches), service lines, valves, and hydrants on an as-needed basis throughout the Oklahoma City water service area. The Utilities Department estimates approximately 500 waterline leaks and breaks per year, including 300 non-emergency and 200 emergency repairs. The contract will be awarded to one or more pre-qualified contractors based on unit pricing, with work assigned through individual Work Orders. The contract term is one year from the award date or until the contract capacity is achieved, with no renewal options.

The contract has a not-to-exceed amount of $2,500,000, with reimbursement based on unit prices bid for specific repair items. Materials will be supplied by the Utilities Department, and contractors will be responsible for excavation, repair, and restoration. The bidding process will evaluate contractors based on their unit prices applied to estimated typical quantities. Contractors must provide performance, statutory, and maintenance bonds. The work includes responsibilities such as utility coordination, traffic control, emergency mobilization, surface restoration, and adherence to specific technical requirements for water main repairs, service line replacements, and related infrastructure work.

Unit Price Small Diameter Water Main Repair Citywide

SPECIAL PROVISIONS

BACKGROUND

The City of Oklahoma City is the state’s largest drinking water provider, treating and delivering an average of 100 million gallons of water daily to more than 1.4 million residents through retail and wholesale service connections. The Oklahoma City Water Utilities Trust (OCWUT) finances municipality-owned critical assets to deliver the water services as well as wastewater and solid waste collection services.

The Oklahoma City water service area includes the corporate limits of Oklahoma City (City) (~621 square miles), select cities within the combined statistical area, and areas along the raw water pipelines to Lakes Atoka and McGee Creek. The City of Oklahoma City Utilities Department (Utilities Department) manages the operation of these critical services, which are distributed over a vast geographical area that consists of approximately 4,245 miles of pressurized water mains, service lines, gravity mains, and the Atoka raw water line. Of that total, there are approximately 3,400 miles of pressurized water distribution mains ranging from 4 to 24 inches in diameter and 700 miles of City water service lines.

STATEMENT OF PURPOSE

OCWUT is soliciting competitive bids and intends to award contract(s) for the purpose of providing repair and other construction services on small diameter distribution mains, service lines, valves, and hydrants on an as-needed basis throughout the Oklahoma City water service area described above and hereafter referred to as the Unit Price Contract(s). For this Unit Price Contract, small diameter is defined as water distribution mains between 2-inches to 24-inches. The work and services provided under the awarded contract(s) must be performed by pre-qualified contractors based on a Work Order process identified and assigned by the Line Maintenance Division of the Utilities Department (Line Maintenance) in separate Work Orders. The Contractor will invoice the OCWUT and will be reimbursed on a unit price basis for work completed in accordance with the Unit Price Contract. The costs of all labor, tools, and equipment needed to restore water service will be included in the unit prices bid on Bid Items as established in the Electronic Bidding Process and shown in the Summary of Bid Items provided and attached to these Bidding Documents. Materials listed in these Special Provisions will be supplied by the Utilities Department at 621 N. Pennsylvania Oklahoma City, OK 73107.

The Summary of Bid Items shall be bid in quantities of one. Provided, however, Work Orders may include more than one quantity of any item bid.

The Utilities Department currently estimates approximately 500 waterline leaks and breaks within the City water service area in need of repair to stop or reduce water loss and damage. This repair estimate includes 300 non-emergency breaks and 200 emergency breaks which are subject to change and may result in fewer or additional repairs.

It is anticipated that the Contractor(s) may receive additional Work Orders if the work demands of the Line Maintenance Division of the Utilities Department (Line Maintenance) exceed present operational capabilities.

LEGISLATIVE DETERMINATION

By competitively bidding public construction contract(s) as a service area-wide unit price contract, the OCWUT has determined and established a process that efficiently and effectively provides the needed improvements and repairs. By awarding construction contracts for improvements and repairs to one or more bidders, the OCWUT expects to accrue efficiencies in water loss and damage reduction and savings in contract administration through the timeliness and effectiveness of issuing Work Orders and completing waterline improvements and repairs.

PART 1 – SPECIAL PROVISIONS GENERAL

It is the intent of these Special Provisions to provide for the necessary Work including, but not limited, to water main and service line construction and repair. These Special Provisions are included and are made a part of and apply to the Bidding Documents for this Unit Price Contract. Where in conflict with the Standard Specification, these Special Provisions shall govern. Copies of the "Standard Specifications for the Construction of Public Improvements" may be viewed or downloaded at www.okc.gov/departments/public-works.

1.0 WORK

The Work will be defined in each Work Order and will consist of furnishing all labor, equipment, transportation, and other incidental items required for the installation, relocation, or repair of water mains, City water service lines, and related valves and appurtenances with the least interference with water service to customers and to City operations.

2.0 WORK ORDER

The Work Order is the official notice received by the Project Manager or designee to authorize the Work for each written Work Order under the terms of the Unit Price Contract(s). Information included in the written Work Order will include:

1) Issuance Date

2) Location(s)

3) Estimated Scope of Work and each location

4) Estimated Project quantities and construction amounts

5) Any special instructions, notices, or directives as determined by the Project

Manager

Work Orders issued by e-mail for emergency Work Orders will be followed by written official Work Order as soon as practical.

3.0 PROJECT

The Project is defined as the total Work authorized by the Work Order and completed by the Contractor(s) at each location specified in each Work Order according to the provisions set forth in the Contract Documents and the Unit Price Contract.

4.0 PROJECT SITE

The Project Site is defined as the total area disturbed by the Work or used to store equipment and materials to complete the Work at each location in the Work Order.

5.0 CONTROL OF THE WORK

All Work shall be done under the supervision of Contractor, and its designated representatives, (collectively referred to as “Contractor”)

Project Manager. The “Project Manager” is the Utilities Director designee that establishes the sequence and priority of Work Orders for this Unit Price Contract. The Project Manager will make the final determination on the amount of Work performed at the Project Site(s) and if the quality of the Work meets the provisions of the Contract Documents.

The Project Manager’s decisions and estimates are final.

Inspector. All the Work completed in the field described in the Work Order shall be inspected by the Project Manager. Provided, however, the Project Manager may delegate another qualified inspector to the site, including, but not limited to, Line Maintenance staff or Public Works Field Service staff. The Project Manager will coordinate any needed testing or special inspections required by the Work Order.

6.0 REJECTION OF BIDS

Bids may be rejected if it is mathematically or materially unbalanced. Bids are mathematically unbalanced if the Bid contains items as lump sums or unit prices that do not reflect reasonably estimated costs plus a reasonable proportionate share of the Bidder’s anticipated profit, overhead costs, and other indirect or incidental costs. Bids are materially unbalanced if that Bid, as a whole, creates a reasonable doubt that award to the Bidder submitting a mathematically unbalanced Bid will not result in the lowest cost.

7.0 CONTRACT AWARD

A Unit Price Contract may be awarded to the lowest and best competitive bidder(s), according to the provisions set forth in these Bidding Documents. The OCWUT may award multiple contracts to the lowest and best competitive bidders, if each bidder qualifies under these Bidding Documents and the OCWUT determines that it is in the best interest of the OCWUT to award multiple contracts. The OCWUT will take into consideration that the OCWUT and the customers desire to expedite repair and improvements of water mains and City water services lines and that meeting these goals requires multiple contracts and contractors to work simultaneously. The contract amount for each awarded contract shall not exceed $2,500,000.00. Reimbursement for work performed under an awarded contract shall reflect the items listed in each work order at the actual prices they were bid.

The low factor of the bid award will be determined based upon the mathematical application of each bidder’s unit prices to estimated typical quantities in water main and City water service line construction and repair(s) as established by OCWUT before bid opening.

The OCWUT may in its discretion award additional Unit Price Contracts pursuant to this Notice to Bidders. To qualify, the bidder or bidders must be within ten (10%) percent of the low bidder, as the bids are evaluated as described above, but such qualification does not require the OCWUT to award more than one contract.

Provided further that OCWUT reserves the right to competitively bid and award other additional water main and water service line construction and repair contracts for the same or similar types of construction projects, either as stand-alone projects or unit price contracts, during the same or overlapping periods with these, other or additional funds.

The OCWUT may award one or more Unit Price Contracts each up to the not-to-exceed amount noted above. Award of Unit Price Contract(s) does not guarantee the issuance of Work Orders to any contractor, or an equal or comparable amount of Workers among contractors.

The successful Bidder(s), now known as Contractor, is neither guaranteed the issuance of any Work Orders nor the issuance of Work Orders adding up to the not-to-exceed contract amount. Additionally, the OCWUT reserves the right to not award any contract pursuant to this Notice to Bidders.

8.0 CONTRACTOR AND SUBCONTRACTOR

All Work must be performed by the Contractor, unless written approval from the Utilities Director or Project Manager is obtained in advance for subcontracting services, including but not limited to, boring, dewatering, traffic control work, or any other specific services.

Subcontracting work performed without prior written approval from the Utilities Director or Project Manager shall constitute unauthorized work.

The Contractor and any subcontractor performing the Work authorized in a Work Order must be prequalified with the City of Oklahoma City for the class of work to be performed before any Work commences.

9.0 SUPERVISION

Notwithstanding any requirement to perform Work for any Work Order, neither the OCWUT nor Oklahoma City will recognize any subcontractor related to this Work. When Work is in progress, the Contractor must always be present at the Project Site of the Work either in person or by a qualified and approved superintendent employed by the Contractor who shall be in direct charge of all operations.

10.0 CONTRACT TERM

The Contract term will expire after a period of one (1) year after commencing on the date of award as approved by the OCWUT or if the contract capacity is achieved, whichever occurs first. Any pending Work Orders issued prior to the expiration of this Contract may extend past the expiration to meet substantial completion upon approval of the Utilities Director or designee. No Contract renewals shall be granted.

11.0 BONDS

The Contractor must provide a Performance Bond, Statutory Bond and Maintenance Bond in the not-to-exceed amount of $2,500,000.00. The Maintenance Bond will be effective upon the completion of all Work Orders issued under the Unit Price Contract and will be effective for two (2) years thereafter.

12.0 SCOPE OF WORK

The Scope of Work will be stated in each Work Order. If upon uncovering the leak, the Contractor believes that additional Work will be required, then the Contractor will contact the Project Manager and request an amended Work Order before commencing Work. A Pre-Work Conference will be held with the Contractor and Line Maintenance to discuss sequencing of Work Orders and locations of repairs or installations, coordination efforts required for water isolation, estimated time of completion for each Work Order, commencement and completion dates for Work Orders and estimated costs.

13.0 WORK ORDER ISSUANCE

The Project Manager is authorized to issue Work Orders for this Project under the provisions of the Unit Price Contract(s) and the Contract Documents. Work Orders may include one or more locations as needed.

The first Work Orders will be issued first to the lowest Contractor, then to secondary low Contractors, if any. Each Work order issued will contain approximately fifteen to thirty leaks per location. Work Orders will be grouped by the Project Manager to prioritize repairs based on their Code and proximity to best address the needs of the City and OCWUT to stop or prevent water loss and damage and to provide timely and efficient construction coordination and performance. Subsequent Work Orders may be issued to each Contractor based on completion of each existing assigned Work Order so that each Contractor continues to have Work Orders as authorized until the Contractor has performed up to the Contract not-to-exceed amount. Certain Work Orders, subsequent to the initial Work Orders to Contractor(s), may be timed or delayed based by the City for the best interests of the City including, but not limited to, timing and completion of the Work Orders to have the least effect on public use of City street, the least effect on public safety services, and to obtain the best results.

14.0 PERMITS

The Contractor must obtain all required permits before work commences on each Work Order. The cost for obligatory permits under this Unit Price Contract will not be reimbursed directly but must be included in the price bid on other items.

The Contractor must continuously prosecute the Work as specified in the Work Orders issued. Unless specifically agreed with the Contractor(s), subsequent Work Orders may be withheld or Work defined in existing Work Orders reassigned to other Contractor(s) where significant progress has not been observed for three (3) consecutive days, excluding Saturday, Sunday, and holidays.

The OCWUT may withhold the assignment of additional Work Orders to any Contractor who has an outstanding Work Order that has exceeded the Work Order completion date until the Contractor completes all delinquent Work Orders.

16.0 INSPECTION

All Work described in the Work Orders and performed by the Contractor will be inspected in the field by the Project Manager or designated qualified Inspector. If any Work is determined by the Inspector to not have been constructed in accordance with the Contract Documents or if the Contractor is unable to clearly demonstrate to the satisfaction of the Inspector that the Work was completed in accordance with the Contract Documents, then the Work will not be considered complete until re-inspection by the Inspector. If the Project Manager determines the Work to be unacceptable, then the Contractor will remove and replace the Work and/or remediate the Work to become compliant with the Contract Documents or the directive of the Utilities Director at Contractor’s sole cost and expense.

17.0 PAYMENT

OCWUT will pay each Contractor for Work completed in accordance with the Contract Documents based upon the unit prices bid by that Bidder, now Contractor, and the quantities actually installed; provided the Contractor will not be paid for quantities in excess of the Work Order, unless the Work Order has been amended as provided herein.

The Contractor must submit to OCWUT an itemized for all work performed, utilizing the unit prices in that Contractor’s bid, to constitute as an authorized claim for payment. The Contractor’s unit price costs must be shown on the invoice for all compensable costs.
