About this file
This is a Request for Proposals (RFP) issued by the Oregon Legislative Assembly's Office of the Legislative Administrator for low and medium voltage electrical services at the Oregon State Capitol. The procurement seeks an Oregon-licensed firm in good standing with the Construction Contractors Board to provide on-call low voltage cabling installation, voice and data infrastructure, and medium voltage electrical cabling, infrastructure installation, repair, and maintenance services. The RFP was issued on December 14, 2021, with proposals due by January 14, 2022, and an anticipated contract award date of February 21, 2022. The resulting Price Agreement will have an initial term of 24 months, from February 21, 2022, through February 21, 2024, with the Legislative Administrator retaining the discretion to extend the contract for additional periods. Compensation will be provided through Time and Materials (up to a maximum not-to-exceed amount) or fixed price methodologies, with travel time excluded since the work site is exclusively the Oregon State Capitol.
Minimum qualifications require proposers to have at least five years of experience in low and medium voltage cabling installation, repair, and maintenance, maintain current CCB licensure and valid Oregon Building Code Division licenses, and provide on-call staff including a Registered Communications Distribution Designer, journeyman low-voltage electrician, apprentice low-voltage electrician, Class "A" limited energy technician, and general journeyman electrician. The anticipated procurement value ranges from $150,000 to $200,000. Proposers must submit labor rates and materials/equipment markup using the specified form, with rates remaining firm for 120 days after proposal submission and effective for at least one year following contract execution. The RFP is structured as a multi-step sealed proposal process where technical proposals are evaluated first based on experience in historic building electrical services, ability to meet Service Level Agreements, key staff qualifications, references, cost proposal, and COBID participation plans, with scoring up to 100 points. After technical evaluation, the top-ranked proposer's labor rates and materials/equipment markup will be opened for cost consideration; if negotiations are unsuccessful, LA will proceed with the next-ranked proposer. All work must comply with prevailing wage requirements in Marion County (BOLI Region 3) and meet detailed cabling and rack standards specifications provided in the RFP attachments.

Section 1: Purpose and General Information
1.1 Introduction
1.1.1 Overview, Objectives, and Background.
The Oregon Legislative Assembly, acting by and through the Legislative Administrator (“LA”) is issuing this Request for Proposals for low and medium voltage electrical services for the Oregon State Capitol. Services will include low voltage, voice and data cabling and infrastructure installation and medium voltage electrical cabling, infrastructure installation, repair and maintenance. LA seeks an Oregon licensed firm, in good standing with the Construction Contractors Board (CCB), that can respond to the timeframes and requirements of the Oregon State Legislature. Proposers must have the adequate staff to support LA’s needs on an on-call basis for both low and medium voltage projects without sub-contracting for standard project work. LA expects that a successful proposer will negotiate a price agreement under which LA will authorize individual projects through Task Orders as required.
Projects assigned under a contract as a result of this solicitation may be subject to Oregon prevailing wage rates and certified payroll (to be submitted with the contractor’s invoice).
For purposes of determining the correct rate of pay and accessing certified payroll forms, a proposer can obtain the most recent prevailing wage rate forms and rate information at:
http://www.oregon.gov/boli/WHD/PWR/JAN_2017/January_1_2017_PWR.pdf
The work site is in Marion County, BOLI Region 3
The Legislative Administrator has authority to conduct this procurement under ORS
173.720 (2) and Legislative Administration procurement rules.

The term of any Price Agreement (defined below) that results from this solicitation, contingent on funding approval, is anticipated to be for 24 months, starting February 21, 2022 and ending February 21, 2024. LA, at its sole discretion, reserves the right to extend the Price Agreement issued as a result of the RFP for additional time as required.
1.1.3 Method of Compensation.
Compensation methodologies may include;
o Time and materials (“T&M”), up to a maximum not to exceed (“NTE”) amount.
OR
o Fixed price for all services.
Note: As the Oregon State Capitol is the only job site for this solicitation, travel time will not be compensated.

v. Negotiate any matter necessary to serve the best interest of the public;
vi. Amend any Price Agreement executed as a result of this RFP; and

RFP 9181 Page 12 of 54 Low and Medium Voltage Electrical Services
viii. If LA receives only one (1) response/proposal to this RFP, LA will not provide for a protest of the Price Agreement award.
Although price is a consideration in determining the apparent successful proposer, the intent of this RFP is to identify a Proposal from a proposer that has a level of specialized skill, knowledge and resources to perform the Services described in this RFP. Qualifications, performance history, expertise, knowledge and the ability to exercise sound professional judgment are primary considerations in the selection process. Because of the highly technical nature of some of these tasks, the proposer with the lowest labor and materials and equipment price Proposal may not necessarily be awarded a Price Agreement. LA reserves the sole right to determine the best Proposal.
3.11 Contract Form
The apparent successful proposer shall be asked to sign a Price Agreement substantially in the contract form that is attached as Attachment C. The terms and conditions included in Attachment B, other than those identified in Section 4.7.7 of this RFP, are not subject to negotiation.
3.12 Contractual Obligation
LA is not obligated as a result of a proposer’s submitting a Proposal to enter into a Price Agreement or other contract with the proposer, and LA has no financial obligation to any proposer arising from this RFP.
Section 4: Evaluation and Award
4.1 Evaluation Process
4.1.1 Evaluation Overview.
LA shall conduct an evaluation of all Proposals received in response to this RFP. LA shall evaluate and score all Proposals on the completeness, quality, and applicability of the content of the Proposals in accordance with the following criteria:
• Experience and demonstrated expertise in providing electrical services in a historic building.
• Ability to meet SLA –Attachment E
• Key staff resumes.
• References.
• Cost Proposal.
• COBID Outreach Plan – Attachment F
Each criterion is explained in more detail below.
4.1.2 Evaluation Committee.
LA will establish an evaluation committee, which will consist of LA staff and others, to review, evaluate and score each Proposal.
RFP 9181 Page 13 of 54 Low and Medium Voltage Electrical Services
4.1.3 Disqualification.
If a proposer attempts to improperly influence a member of the evaluation committee during the proposal review and evaluation process, LA shall reject the proposer’s Proposal.
4.2 Evaluation of Proposals
The evaluation committee shall independently score all Proposals based upon each proposer’s responses to the evaluation questions detailed below. Proposals meeting all administrative pass/fail criteria (including submittal of all REQUIRED items in the time allowed, see Section 2) will be forwarded to an evaluation committee of at least three (3) members that will independently review, score and rank Proposals according to the scoring criteria set forth in Section 4.5. Evaluators will independently judge the merits of the Proposals by comparing the requirements and criteria stated in the RFP with the responsiveness and the relevance of experience and qualifications presented in the Proposal.
The outcome of the evaluation process may, in LA’s sole discretion, result in:
(a) notice to one or more proposers of selection to negotiate a Price Agreement and the possible award of the Price Agreement;
(b) further steps to gather additional information for evaluation, (e.g. checking references, notice of placement on an interview list, requesting clarification); or
(c) cancellation of the RFP and either re-issuance of the RFP in the same or revised form or no further action by LA with respect to the RFP.
LA may reject any or all Proposals and may cancel this RFP at any time if doing either would be in the public interest as determined by LA. LA is not liable for any costs a proposer incurs while preparing or presenting the Proposal or during further evaluation stages. All Proposals will become part of the public file.
4.2.1 Multistep Solicitation:
Step 1. The first step consists of each proposer’s submission of unpriced technical proposals by the due date indicated on page 1 of this RFP. The Services offered in a proposer’s unpriced Proposal must be furnished generally in accordance with the requirements of the RFP. Proposals submitted on time and meeting all administrative pass/fail and required items will then be evaluated based on the scoring criteria in Section
4.5 to determine qualified proposers.
Note: To the extent that it finds necessary, LA may conduct oral or written discussions of the unpriced technical Proposals prior to reviewing labor rates and Materials and Equipment markups from proposers determined to be qualified.
In accordance with OAR 137-047-0720, LA hereby gives notice that for this RFP, no protest is available for proposers excluded from subsequent steps or phases of this multistep solicitation.
