SECTION 1: OVERVIEW

OBJECTIVE

1. The primary purpose of this Statement of Work (SOW) is to obtain rentals associated with construction equipment to construct a Running Track at the 934th Airlift Wing, Minneapolis, MN. This SOW covers rental of equipment, the delivery to the specified location, required equipment maintenance and rental agreements. This SOW provides the general requirements. The Contractor shall be responsible to provide all rentals to the specified location within the specified timeframe.

1.1. The purpose of this action is for the Government to engage a Contractor to provide the rental, delivery, technical support, operational training, and pick-up of construction-type equipment at Minneapolis Air Reserve Station, Minneapolis, MN.

1.2. The rental equipment shall meet all specification listed in Section 2: Rental Equipment and Appendix A:

Equipment List. Attachments shall be interchangeable between equipment where applicable. All equipment proposed by the contractor should have sufficient information to be evaluated against the requirements of this SOW, including Appendices. The information provided will be evaluated against these requirements and ‘or equal’ determinations.

LOCATION

2. Project site and delivery of equipment will be at the 934th Airlift Wing, Minneapolis, MN.

SCOPE INFORMATION

3. The Contractor shall provide a variety of construction equipment necessary to complete the construction of a running track. All equipment shall be approved by the Contracting Officer (CO) with the recommendation of the Contracting Officer Representative (COR), free of defects and in good condition. All equipment shall conform to the Specification outlined in the SOW, unless otherwise approved by the CO. The Contractor shall remove defective equipment from the site at no additional cost to the Government.

3.1. All equipment shall include a full tank of fuel upon initial delivery and all necessary equipment essential to intended operation. The Government will not be responsible for returning the equipment with full fuel tanks. The Contractor shall respond to all maintenance calls within four (4) hours and repair or replace the vehicle within 12 hours. All repairs or replacements for the leased equipment shall not be charged to the U.S. Government.

3.2. The Contractor shall have 24-hour emergency services and be capable of being onsite for repair within four (4) hours of a service call. All backup units used in the event of primary failure shall be at no additional cost to the Government.

3.3. The Contractor and the COR will conduct a joint inspection of the equipment to ensure that equipment is serviceable prior to accepting the equipment. All pre- and post-inspection/acceptance sheets must be provided to the Contracting Officer. Pre- and post-inspection sheets will be hard copies only and not that of a Contractor/vendor’s portable electronic device or hand-held device. The COR is not authorized to sign any electronic device.

3.4. The Government will return the equipment with any unused fuel and is not responsible for refueling nor any fees associated with refueling of equipment at the end of the period of performance for each piece of equipment.

3.5. The Contractor must label their equipment near the fuel tank with the correct wording of the type of fuel, for example: “Diesel Fuel Only.”

3.6. The Contractor shall remove all contracted/leased equipment form the specified location(s) within 48 hours after the period of performance ends. Should contracted/leased equipment remain in place beyond 48 hours, the Government is not liable for usage, theft, loss, damages, or replacement costs due to the Contractor’s negligence to take possession of owned items. If for some reason the Contractor is unable to remove the equipment within the prescribed time, the Contractor shall notify the Contracting Officer in writing.

PROJECT DOCUMENTATION

4. Project documents may be provided with each order issued under this contract. Examples of such documents may include, but are not limited to, formal design drawings, sketches, site-specific specifications, guide specifications, design analysis, and other documents appropriate to the project.

The intent is to provide sufficient project-specific information to allow for a complete understanding of the project.

SUBMITTALS

5. Contractor shall supply submittals with technical/product data for the equipment to be supplied.

Submittals will include equipment information sheets, prior usage history, cleaning documentation, and equipment Manuals.

ENVIRONMENTAL

6. During delivery, maintenance and pick-up periods, all waste oil and fuel spills will be cleaned up immediately and disposed of properly by the Contractor. Hazardous materials will be appropriately disposed of in accordance with applicable state and federal regulations.

EQUIPMENT

7. All vehicles and equipment shall be operated in accordance with base traffic regulations. If equipped with communications devices, equipment shall comply with all base and local frequency regulations.

Cell phone use while driving is restricted to “hands free” while on base.

QUALITY CONTROL PLAN

8. Inspection and testing of equipment is the responsibility of the Contractor. However, representatives of the Contracting Officer can and will inspect equipment as considered appropriate and will monitor that equipment in compliance with SOW and the order. Government inspection or testing will not relieve any CQC responsibilities.

SAFETY REQUIREMENTS

9. The Contractor shall follow all applicable USACE EM385-1-1 standards; specifically, the Contractor shall ensure that Employees are supplied and use proper safety equipment (e.g., gloves, safety glasses, boots, etc.) and follow proper work procedures, which protect contractor employees and U.S. soldiers in vicinity of job site. The Contractor shall establish a safety zone around the work area and establish a safety system with warning markers and other devices to prevent injuries to pedestrians and others who may be on the site. The Contractor shall assume any liability for any injury incurred by contractor personnel while working on site.

CLEANUP

10. The Contractor shall perform a jobsite cleanup after delivery and remove any debris and refuse related to the SOW, to the satisfaction of the Contracting Officer.

WORK PERIOD

11. The Contractor shall complete all deliveries within the prescribed period identified in the purchase order. See Appendix A for specific dates.

ACCEPTANCE

12. The COR or authorized Government representative will provide acceptance of equipment. A joint inspection at the time of delivery shall be conducted with the Contractor and the designated COR.

GOVERMENTS ON-SITE REPRESENTATIVE

13. The Government Points of Contact at the project site will be identified upon contract award and/or via notification from the Contracting Officer. The Contractor will need to coordinate with the government point of contact for scheduling equipment deliveries, equipment inspection, repairs, acceptance, and return of equipment at the end of the respective rental periods.

INSTALLATION ACCESS

14. All personnel and subcontractors employed by the Contractor in the performance of the services specified in this contract or any representative of the Contractor entering the work area shall conform and comply with all applicable 934th Airlift Wing security policies and procedures (briefed by the Government at the beginning of the contract). All Contractor employees or subcontractors must carry pictured identification at all times. They must show I.D. upon request by City/State/Government personnel. The Contractor's employee must carry a copy of the contract requirements with them during the implementation of this contract. The Contractor shall submit to the Contracting Officer at least three days prior an Entry Access List (EAL) containing the name of the Contractor or Sub-Contractor, the Full Name of the individual requiring access, their date of birth, driver’s license number, and the state issued.

No access will be granted to any individual with a criminal history in the past 10 years or an outstanding warrant. Foreign nationals without a green card will not be granted access

PUBLIC HEALTH

15. The Department of Defense (DoD) is committed to taking every precaution to ensure the health and wellbeing of our Service members, DoD civilian employees, families, and the Nation in response to the Coronavirus Disease 2019 (COVID-19) pandemic. DoD supports, and will continue to implement, all measures necessary to mitigate risks to the spread of the disease, consistent with the Department's priorities to protect our people, safeguard our national security capabilities, and support the government's whole-of-nation response. The Centers for Disease Control and Prevention (CDC) recommends wearing cloth face coverings in public settings where other social distancing measures are difficult to maintain, especially in areas of significant community-based transmission. DoD contractors are strongly encouraged to follow CDC guidelines on the use of cloth face coverings in public settings or where other social distancing measures are difficult to maintain. Effective immediately, to the extent practical, all individuals on DoD property, installations, and facilities will wear cloth face coverings when they cannot maintain six feet of social distance in public areas or work centers. This includes all DoD Contractors and other individuals on DoD property, installations, and facilities.

SECTION 2: REQUIRED EQUPIMENT

EXCAVATOR (200 HP, W/ 3CY BUCKET W/ THUMB ATTACHMENT & JACKHAMMER

ATTACHMENT)

1. Excavate and prepare existing ground surface for a current sheet pile project. The equipment will be required to move material consisting of small boulders down to loose sand in the work area. It will also be used to mobilize, lift, and support sheet pile materials. The equipment will be used on a variety of surfaces ranging from small cobble stone, sand, and clay. Therefore all equipment must be fitted to work reliably in this terrain, e.g. tracked equipment shall be equipped with adequate tracks, and buckets. Blades shall have suitable cutting edges and teeth for rock work.

1.1. The excavator will perform limited clearing and grubbing of trees and brush located within the project area.

SKID STEER EQUIPMENT (80 HP, W/ 1CY BUCKET & AUGER ATTACHMENTS)

2. Excavate and prepare existing ground surface for the establishment of a new road. The equipment will be required to move material consisting of boulders of various sizes down to loose sand in the work area. The sweeper will be used to remove loose material from the established roadway and to clean the road area for any passing traffic. The equipment will be used on a variety of surfaces ranging from small cobble stone, sand, gravel and various clay. Therefore all equipment must be fitted to work reliably in this terrain, e.g. tracked equipment shall be equipped with adequate tracks, and buckets and blades shall have suitable cutting edges and teeth for rock work.

8' ASPHALT PAVING MACHINE

3. Install new asphalt paving on to properly prepared roadway/running track.

BITUMEN TRUCK (2000 GALLONS, 38 HP)

4. Apply an asphalt binding agent for asphalt mat installation.

RUBBER TIRE LOADER (4CY)

5. Transport material consisting of small boulders down to loose sand throughout the construction site as well as load dump trucks for the transport of said material to and from the construction site.

TANDEM STEEL WHEEL ROLLER AND TANDEM STEEL WHEEL ROLLERS

6. Compact various material throughout the construction in preparation for asphalt or finish materials

6.1. Ride-on Double Smooth-drum Vibratory Roller, Diesel-powered, 1.5-1.7 Ton, 35-48 in. Roller

6.2. Ride-on Double Smooth-drum Vibratory Roller, Diesel-powered, 5.5-7.5 Ton, 66-69 in. Roller

RUBBER TIRE ROLLER

7. Compact various material throughout the construction in preparation for asphalt

7.1. 9-wheel pneumatic roller with an operating weight range between 11,484lb - 33,069lb providing an overall minimum compaction width of 60" with 1.4" overlap.

DUMP TRUCK

1. Haul various construction material throughout the job site as well as to and from the job site. The trucks will be registered, inspected and roadworthy. Dump trucks will come with a tarp mechanism so loads can be covered if transported to and from the military installation. Minimum requirements for Dump Truck hauling capacity shall be no less then twelve (12) cubic yard capacity, without sideboards.

GRADER

2. Leveling various material throughout the construction in preparation for asphalt and seeds. Minimum requirements for Grader blade shall be no less than ten (10) feet. Grader shall also be gas/diesel powered and not a tow behind attachment

HYDRO SEEDER

3. Mix, spray and apply new grass seed mixture on to prepared soil beds. Hydro Seeder shall hold 300-

500 gallons and be a pull type that can be moved with a standard a 6 Pax truck.

MILLING MACHINE

4. To remove existing pavement and be utilized for new pavement. Milling Machine shall have at a minimum a 79 to 86 inches cutting widths and be wide enough to cut half of a twelve (12) foot road.

TELESCOPIC HANDLER

5. Used for lifting pallet boards and moving heavy loads to high up, tough to reach areas. Telescopic Handler shall have a minimum lifting capacity of 5,000lbs and reach of 16-20 feet.

TRENCHER

6. Used to dig trenches, especially for laying pipes or electrical cables, for installing drainage. Trencher shall have minimum of 35 horse power with a max cutting depth of 48 inches and allow operator to ride on.

SECTION 3: DELIVERY OF EQUIPMENT

TRANSPORTATION

1. The transportation/delivery costs of all equipment to and from the delivery site is the responsibility of the Contractor and shall be included in the item price indicated in the Price Schedule. The delivery location is the Minneapolis-Saint Paul Air Reserve Station. Delivery shall consist of a joint inspection with the Contractor and the COR, and be documented, signed by both parties, and routed to the Contacting Officer within 3 days of delivery.

DELIVERY REPRESENTATIVE

3. Delivery shall be coordinated with the Government’s on-site representative and transport vehicles shall be scheduled to arrive at the job site during normal work days and hours. This includes Monday through Friday between the hours of 07:00 to 16:00, and excludes Federal holidays. Additionally RED HORSE personnel will be on-hand to provide escort (if necessary) and guidance for delivery. .

Alternate delivery times must be approved on a case-by-case basis by the Contracting Officer in writing. The Government will provide the Contractor with a schedule detailing when each piece of equipment is needed, and the desired order of delivery. The delivery schedule shall be such that the equipment can be delivered, assembled, documented, and tested safely and efficiently at the worksite.

The Contractor shall be allowed a maximum of one week to have the equipment on site and functional after notification. The Government reserves the right to request delivery schedule changes at no additional cost to the Government. If required, variations to the delivery schedule will be coordinated by the CO, providing the Contractor as much advance notice as possible.

RECEIVING EQUIPMENT

4. All equipment shall arrive in fully functional condition and meet all OSHA safety requirements. All safety lock-outs and devices shall be functioning as intended by the manufacturer and come complete with all necessary documentation and certifications where applicable.

4.1. All equipment shall be provided with tools and necessary materials to perform minor forms of general, preventative, and/or routine maintenance, such as fluid level checks, greasing, tire pressures, etc. These tools and material include items such as equipment specific tools, grease guns, grease, and hydraulic fluid.

4.2. All equipment and accessories shall arrive ready for use, and fully functional. It is the Contractor’s responsibility to ensure items such as hydraulic and motor oil levels are topped off, fuel tanks are full, accessory attachment pins, hydraulic hoses, electrical harnesses, and fluids are provided, tires are inflated to proper pressures, equipment cab glass is not broken, etc. Equipment delivered that is not fully functional may delay start dates for the rental period.

4.3. Contractor shall ensure all scheduled equipment is delivered as scheduled. Each delivery of equipment shall be approved by Government personnel to determine actual delivered.

4.4. The Contractor shall ensure that prearranged deliveries are accomplished on time and with the requested quantities. The Government reserves the right to withhold payment if the quality of the equipment delivered is substandard and unacceptable. Any unacceptable equipment will be removed by the contractor and replaced at no additional expense to the USG. The Contractor shall furnish delivery tickets for all deliveries.

4.5. Specific delivery requirements will be provided in each order.

SECTION 4: EQUIPMENT USE, MAINTENANCE AND SUPPORT

MAJOR MAINTENANCE

1. Repairs that are required during the performance period. This will include periodic oil changes as required by equipment maintenance schedules. Fuel costs are born by the Government during operation, each piece of equipment shall be delivered with full fuel tanks to demonstrate performance functionality. Fuel tanks are not required to be filled upon return to the Contractor.

EVERYDAY WEAR AND TEAR

2. The rented equipment will be used in close areas and a typical construction environment, and the Contractor must allow for equipment to be returned with normal wear that does not affect the equipment’s life and functionality. The Government will not be responsible for repairing items such as, but not limited to minor cosmetic, dents and scratches, shallow surface slices on tires, paint, and basic exterior and interior cleaning of the equipment. The Government will not be responsible for the replacement of parts with wear associated with normal use of the equipment and parts such as hydraulic hoses and components, seals, tires, buckets, teeth, blades, and pins.

CLAIMS

3. If a claim is submitted, it will require the joint inspection pre-and post-inspection/acceptance sheets to accompany the claim form. Both must be provided to the Contracting Officer at the time of claim submission. The pre-and post-inspection/acceptance sheets must only be signed by the authorized receiving representative that is indicated in the contract. Inspection/acceptance sheets must be signed and dated. Both parties’ names must be printed legible and signed.

3.1. If a claim is submitted without the pre-and post-inspection/acceptance sheets, the claim is subject to be denied. The contractor must submit their claim invoice with the following information:

• VIN/Serial Number

• Concise Damage Description to Include Date

• Repair and Material Costs

• Authorizing COR

• Pictures

TECHNICAL SUPPORT

4. The Contractor shall provide timely technical support via phone, or email on an as-needed basis for the duration of the contract 24-hours per day, seven (7) days a week. Equipment response tier classification is defined below and identified for each piece of equipment on the equipment list.

a. EMERGENCY – Response within 2-4 hours

b. URGENT – Response within 24 hours

c. ROUTINE – Response within 2 to 3 business days

4.1. The Contractor must also be capable of providing maintenance and repair parts, as well as on-site support, for equipment failure that is not related to improper use and/or accident, as needed, within the response tier classification specified. Failure to comply with this requirement may result in an extension of the rental period on a day-for-day basis for not only the non-operating equipment, but also for the equipment supporting its operation. If nonoperational equipment cannot be repaired within the specified tier classification, the Contractor also has the option to replace the equipment in kind.

ON-SITE TRAINING

5. The successful Contractor will provide initial on-site, equipment specific, safety and operations training, upon request from the Government’s on-site representative which is accredited and compliant with the National Center for Construction Education Research (NCCER) standards. The training shall be for up to fifteen (15) employees on a single piece of rented equipment. Training dates shall be coordinated with the Government’s on-site representative and shall be provided on the date that the equipment is assembled and operational at the worksite. The training will include basic controls for the paving machine.

SECTION 5: SECURITY REQUIREMENTS

SECURITY ACCESS

1. All personnel and subcontractors employed by the Contractor in the performance of the services specified in this contract or any representative of the Contractor entering the work area shall conform and comply with all applicable U.S. Army Corps of Engineers, facility access, security policies and procedures (provided by the Government). The Contractor’s workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

SECURITY CHECKS

2. All Contractor employees or subcontractors must carry pictured identification at all times in compliance with the Federal REAL I.D. Act. They must show I.D. upon request by City/State/Government personnel. Contractor employees or subcontractors with picture I.D. not in compliance with REAL I.D. will be escorted by a Government representative at all times while on the installation. The Contractor will compile a list of all drivers and submit to the Contracting Officer.

The Contractor's employee must carry a copy of the contract requirements with them during the implementation of this contract. The Contractor's employees will be subject to such additional checks as may be deemed necessary to ensure that no violation of security rules has occurred.

SECTION 6: RENTAL LEASE TERMS

TIMELINE OF LEASE

1. Each piece of the listed equipment will be needed from one two (2) weeks to three (3) months, with one (1) month equal to 28 calendar days, and the minimum period of time shall be no less than one

(1) week; therefore interested vendors should bid accordingly. Rental costs will be paid on a month by month basis, and the equipment may be returned earlier than the full rental period. The usage date begins on the day the Government receives, inspects, and accepts each piece of equipment for use.

This will be based on the date the equipment is at the worksite, operational, and availability with the Contractor’s representative for the required safety orientation and operational training. In the event that the Government returns equipment early it will be with official notice from the Contracting Officer.
