About this file

This is a Required Affidavit form for Bidders, Offerors, and Contractors issued by the Commonwealth of Kentucky for state and local contract opportunities. The document serves as a compliance and disclosure instrument applicable to all bids and contracts in general. The affidavit is effective for a maximum length of one year and requires execution before a notary public. Bidders and offerors must affirm compliance with multiple Kentucky statutes and regulations, including campaign finance laws (KRS 45A.110 and 45A.115), disclosure requirements (KRS 45A.485), sales and use tax registration (KRS Chapter 139), state tax obligations, and trade-related restrictions outlined in Executive Order No. 2018-905. The form further requires affirmation that neither the bidding entity nor its subcontractors have violated prohibitions set forth in KRS 11A.236 during the previous ten years.

For non-bid contracts specifically, contractors must provide additional affirmations regarding campaign contribution limits and restrictions under KRS 121.056, KRS 121.330(1) and (2), and KRS 121.330(3) and (4). The document includes separate affidavit sections for entities claiming resident bidder status (requiring authorization to transact business in Kentucky, one year of prior tax filings, unemployment insurance fund payments, and workers' compensation coverage) and qualified bidder status (for nonprofit corporations furthering KRS Chapter 163 purposes or qualified nonprofit agencies for individuals with severe disabilities meeting the seventy-five percent employment threshold for individuals with severe disabilities). The bidding agency reserves the right to request supporting documentation and may disqualify bidders or terminate contracts for failure to provide such documentation or non-compliance with any affidavit statements.
