About this file

This is a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process issued by the Utah Department of Transportation (UDOT) Procurement division for the acquisition of AASHTOWare HaulHub EDOT Portal Software. UDOT is seeking a one-year software license from the American Association of State Highway and Transportation Officials (AASHTO), with a procurement quantity of one license. The document does not specify response deadlines, due dates, site visits, or bidder conferences, as this is a sole source procurement notice published to determine if other qualified providers exist for the specified item. No award date or contract renewal options are indicated in the filing.

The estimated total contract cost is $50,000 with no freight costs, as this is a software license procurement. UDOT justifies the sole source award under the premise that AASHTOWare HaulHub is proprietary software developed exclusively by AASHTO, a nonprofit association representing transportation departments in the 50 states, the District of Columbia, and Puerto Rico. The software is cooperatively developed by transportation professionals across member states and is not available from any other vendor. No cost-benefit analysis, transitional cost comparison, or competitive market research was conducted, as UDOT asserts the software is unique and only available from AASHTO. The accounting coding for this procurement is 2800 810 8205 XCD 6593. No personal, financial, or fiduciary relationships between UDOT and AASHTO were disclosed.

and

● If transitional costs are identified as the justification for this notice, submit a cost comparison of the identified transitional costs with the provider’s anticipated transitional costs.

Regardless of any prior communications with UDOT Procurement or the State, all providers interested in responding to this notice must submit a response to this posting containing complete responses to all of the information requested above.

DO NOT CONTACT THE REQUESTING UNIT. Any questions regarding this notice, including obtaining additional information, must be obtained through UDOT Procurement during the publication period. No action is required if you agree with this Notice.

SECTION A: ONLY ONE SOURCE

1. What is unique about this procurement item to justify an award of contract without engaging in a standard procurement process? (Explain in detail why the service or product is only available from a single supplier.)

These are AASHTO developed/engineered transportation software.

AASHTO is a group of officials from all transportation organizations. Their purpose is to develop software to support the transportation agency’s needs. The software developed is based on requirements submitted by the agencies and is proprietary.

The American Association of State Highway and Transportation Officials (AASHTO) is a nonprofit, nonpartisan association that represents the member highway and transportation departments in the 50 states, the District of Columbia, and Puerto Rico. Its purpose is to foster the development, operation, and maintenance of an integrated national transportation system.

3 revision date: 01-07-2020

AASHTO creates and distributes software it calls AASHTOWare to member states and territories. The AASHTOWare program is a technical service program administered by AASHTO that provides software solutions developed by transportation professionals for transportation professionals. The AASHTOWare Program is self-supporting and managed as a not-for-profit enterprise.

Program funding is secured through voluntary participation in cooperative software development, maintenance and support activities.

No other software is cooperatively developed and continually updated by experts from state transportation agencies across the nation. Pooling knowledge and resources enable costs to be distributed across many users, so agencies procuring AASHTOWare realize vast cost savings and receive quality software that matches precise needs.

AASHTOWare is built to help you comply with Federal Highway Administration regulations, AASHTO standards and industry best practices, but it easily accommodates state-to-state differences. Easy to download, customize and deploy, AASHTOWare efficiently monitors costs, schedules, inventories, inspections, performance, displacements, and safety.

The primary goal of the program is to provide a mechanism for AASHTO member departments to pool their resources on a voluntary basis to produce mutually acceptable computer software products that are generally not available, would be cost prohibitive to create on their own, and to:

● Provide an opportunity for substantial cost savings compared to individual development

● Allow the development of complex and innovative software products that meet the specific unique needs of departments of transportation

● Produce standardized software products

● Optimize scarce and skilled resources

● Incorporate best practices

● Ensure products receive necessary functional and technology upgrades throughout the software lifecycle

● Support program management and oversight by agency (DOT) personnel

● AASHTO staff provides project management and administrative assistance
