About this file
This is a PREA Compliance Standards exhibit for a Prison Rape Elimination Act audit services contract issued by the Texas Department of Criminal Justice (TDCJ). The contract requires certified PREA Auditors to conduct compliance audits at TDCJ facilities on a three-year cycle to assess agency and facility adherence to PREA Prisons and Jail Standards. Auditors must submit invoices within five working days of audit completion and are responsible for making their own travel arrangements. The audit scope includes reviewing all relevant Department policies, reports, internal and external audits, accreditations, and sampled documentation from the most recent one-year period, with access to observe all facility areas. Auditors must maintain strict confidentiality of all documentation, including recordings and interview notes, and must be certified by the Department of Justice and members of a correctional monitoring body independent of the audited agency.
Each audit report must include a conflict-of-interest certification and describe the audit methodology, sampling sizes, and basis for conclusions regarding each PREA standard provision, along with recommendations for corrective action. If a facility receives a "Does Not Meet Standard" finding, the auditor must submit a corrective action plan within 180 days. Payment adjustments and remedies apply for non-compliance, including $50 daily reductions for invoices submitted beyond five working days, $100 daily reductions for inaccurate or incomplete reports, and $50 daily reductions for corrective action plans exceeding the 180-day deadline. The Department will not process or pay invoices if audits are not conducted, thorough reviews are not completed, documentation confidentiality is not maintained, the auditor lacks DOJ certification, audit reports are incomplete, or corrective action plans are not submitted within the required timeframe.
