General Bid Provisions Summary

This document contains the General Bid Provisions for Utah Tech University's procurement process, effective as of August 24, 2022. The provisions establish mandatory requirements and guidelines that all bidders must follow when responding to solicitations issued by Utah Tech University. The document covers general bidding rules, bid submission requirements, bid award procedures, protest mechanisms, invoicing protocols, and vendor certifications. Bidders must submit complete cost details including quantity, description, unit price, extended price, freight, and all applicable fees. All items must be new and in stock, with pricing guaranteed for a minimum of ninety days. The University reserves the right to increase or decrease quantities before placing an order, cancel solicitations at any time, award to multiple vendors, and select vendors based on "best value" judgments rather than cost alone.

All bids submitted to Utah Tech University are subject to the State of Utah Procurement Code and the University's procurement policies. Sales tax must be excluded from pricing, and bidders may not communicate with anyone outside of Purchasing Services during the solicitation period. Vendors with ten or more employees providing over $100,000 must certify compliance with the State of Israel boycott statute. Comprehensive liability insurance with minimum limits of one million dollars per occurrence and three million dollars aggregate is required when applicable. For service contracts, E-Verify participation is mandatory to verify work status eligibility of all staff and subcontractors. The University encourages purchases from State of Utah Contracts when items or services are available. Protests must be submitted in formal written form within seven days of discovering facts giving rise to the protest and directed to the designated procurement contact. No invoices will be paid without a valid Purchase Order number.

General Bid Provisions Last Updated 9/2/22

All purchases are subject to the State of Utah Procurement Code and the University’s Procurement policies. For the purposes of this document, a “bid” can mean a quote, proposal, or any other requested document or material as defined by a purchasing solicitation.

By submitting a bid you agree to the following provisions. Any bids that do not comply with the provisions may be rejected or disqualified.

Solicitations may specify additional requirements or waive any of these provisions, if a solicitation contradicts any provision, the language in the solicitation supersedes.

GENERAL RULES

1. Bidders may not communicate with anyone outside of Purchasing Services during a solicitation.

2. Bidders must fully disclose any potential conflicts of interest with any staff or students of the University.

3. Late Bids will not be accepted. The University is not responsible for internet constraints/issues.

4. Gratuities of any form cannot be accepted.

BIDS

1. Bids must clearly indicate details of all costs associated with the solicitation, including: quantity, description, unit price, extended price, freight, and any other fees. If any items/services are variable, clear indication of the rate must be provided (e.g. $xx.xx per hour; $xx.xx per user, etc)

2. All items must be new and in stock
