About this file
This is a Florida Trench Safety Act Certification and Disclosure Statement required by Hillsborough County, Florida for the North Himes Avenue at West Waters Avenue intersection improvement project. The project, estimated at $2,594,198.34, involves replacing existing box span wire signals with mast arms, roadway widening, milling and resurfacing, installing miscellaneous drainage improvements, and providing ADA sidewalk and pedestrian curb ramp improvements including signing and pavement marking. The mandatory certification document requires the bidder to acknowledge compliance with the Florida Trench Safety Act and Federal excavation safety standards established under 29 CFR Part 1926.650, Subpart P, which serve as the interim State standard until the State of Florida adopts or updates requirements.
The bidder must disclose itemized trench safety measures with associated linear feet, unit costs, and extended costs in a detailed table format. The certification establishes that the bidder assumes sole responsibility for selecting geotechnical data and designing the trench safety system, using information available from the County and other sources. The disclosed amount for trench safety compliance does not limit the Contractor's obligation to comply with applicable standards, and the Contractor must expend additional funds at no cost to the County as necessary to achieve full compliance. The County's acceptance of the bid does not constitute evaluation of cost adequacy or relief of the Contractor's compliance responsibilities. A Small Business Enterprise (SBE) goal of 5% has been established for subcontractor participation in connection with this solicitation and resulting contract.

1. The bidder acknowledges the Florida Trench Safety Act and the requirements established herein.
