About this file
This document is Exhibit E - Consideration for County of Ventura's RFP 6227, issued by GSA/Procurement Services, pertaining to Incarcerated Person communication services. The exhibit outlines the financial arrangements between the County and a communication services contractor for providing communication services to incarcerated individuals.
The contract establishes a revenue-sharing model where the contractor will pay the County a percentage of service fees for various communication services, including Streaming Tablet Content, Email/Text/Photo Sharing, Video Visitation Services, and phone communications. The contractor will pay 28.5% of phone revenue and an unspecified percentage for other services. The agreement recognizes FCC regulations allowing facilities to be reimbursed up to $0.02 per minute for administrative and operational expenses. The contractor will offset these expenses by providing services like call recording and investigative technology. The contract includes a minimum monthly guarantee (MMG) provision, where the contractor will pay the County either the earned revenue sharing amount or the MMG, whichever is greater, starting from the first full month of tablet-based services.

County of Ventura RFP 6227 GSA/Procurement Services
Exhibit E – Consideration
Current Federal Communications Commission (FCC) regulations recognize that facilities may incur certain administrative and operational expenses (“Expenses”) in connection with the provision of Incarcerated Person communication services, and that those Expenses are reimbursable in an amount up to $.02 per minute of communication services. County is expected to incur such Expenses, which are estimated to be in excess of $0.02 per minute, and that are necessary to enable the provision of Incarcerated Person communication services. In order to minimize costs to the County, the parties agree that, in lieu of requiring the County to invoice Contractor for these Expenses, Contractor shall utilize this permissible reimbursement to offset the costs associated with providing certain services and features such as call recording and investigative technology, which collectively have an estimated value of $0.02 per minute of communication services.
To the extent that a material difference is determined to continuously or recurringly exist between the County’s Expenses and Contractor's cost of providing the services and features that are not deemed to be directly related to the provision of Incarcerated Person communication services, then the parties shall negotiate in good faith to address such difference and amend this Agreement accordingly.
Additionally, Contractor shall pay to County _____ percent (__%) of any service fees collected with respect to Streaming Tablet Content, Email/Text/Photo Sharing services, and Video Visitation Services (hereinafter, “Revenue Sharing”), and twenty-eight and one-half percent (28.5%) of phone revenue. Commencing with the first full month in which tablet-based services are operational (“First Month”), the foregoing Revenue Sharing shall be subject to a minimum monthly guarantee of $______ (the “MMG”). For each month following the First Month, Contractor shall pay to County the greater of such earned Revenue Sharing amount or the MMG.
